No. 2P/VI-6-118/2008 - 4383—In exercise of the powers conferred by section 152 of the

Bihar Panchayat Raj Act, 2006 & Bihar Panchayat Raj (Amendment) Act 2007, the State

Government hereby authorises the concerned District Magistrate in a District to inquire into any

matter with regard to affair of any Gram Panchayat and Panchayat Samiti. In case of matter

related with Gram Panchayat and Panchayat Samit, the District Magistrate, himself or may get the

matter enquired by any of his subordinate officers, but such officers shall not be below the rank of

Sub-Divisional Officer.

The concerned Divisional Commissioner is hereby authorised to inquire into any matter

related with Zila Parishad.

The Sub-Divisional officer and the District Panchayat Raj Officer can also enquire into

the matter related with Gram Panchayat and Panchayat Samiti, within his jurisdiction on receipt

of application in that respect and submit the enquiry report to District Magistrate. The Sub-

divisional Officer and the District Panchayat Raj Officer shall give prior information before

initiation of such enquiry to the concerned District Magistrate.

2. The government may cause, from time to time for reasons to be recorded, an enquiry

to be made by any other authority also of the cases of three tier Panchayats.

3. The enquiry officers shall have the powers of the Civil Court under the Code of Civil

Procedure, 1908 to take evidence and to compel attendance of witnesses and production of

evidences and documents for the purpose of enquiry.

4. The District Magistrate shall forward the enquiry report with his opinion to the

Government. The Government, after its proper review, shall take action in accordance with law.

5. This order shall come into force at once.
