No. 5@fuñ@vañinkñLFkkñ&25@06&4624—In exercise of powers conferred under

proviso to Article 309 of the Constitution of India the, Governor of Bihar is hereby

pleased to make the following rules for recruitment, promotion and regulation of other

service conditions for the Bihar Cooperative Auditors Cadre.

1. Short title extent and commencement - (1) These rules may be called the

”Bihar Cooperative Auditors Cadre Rules, 2008”.

(2) It extends to the whole State of Bihar.

(3) It shall take effect at once.

Definition - In these rules, unless there is anything repugnant in the subject

or context-

(a) ‘Department’ means Cooperative Department.

(b) ‘Cadre’ means Bihar Cooperative Auditors Cadre.

(c) ‘Appointing Authority’ means the Registrar, Cooperative Societies,

Bihar.

(d) ‘Registrar’ means a person appointed by the State Government to

function as Registrar for Cooperative Societies.

(e) ‘Commission’ means Bihar Staff Selection Commission.

The Cadre Constitution - (1) This Cadre shall be of State level.

(2) This Cadre shall constitute the following grade of post:-

The persons appointed and working on the above mentioned posts before the

commencement of this Rule shall be deemed to belong to this cadre.

(3) Strength - The sanctioned posts of different grades in this cadre may

be modified as per requirement of the State Government by way of

creation and submission.

4. Method of Recruitment - (1) Direct recruitment shall be made on the post

of Auditor, Cooperative Societies in this cadre.

(2) The minimum educational qualification required for recruitment on the

post of Auditor, Cooperative Societies shall be graduate (with

Mathematics) or Commerce graduate passed from any recognised

University.

(3) The minimum age limit shall be 21 years and the maximum age limit

shall be the which determined by the State Government from time to

time.

(4) The requisition shall be sent by the Appointing Authority to the

Commission by 30^th April after calculation on the basis of vacancies

determined on 1^st April of every year.

(5) The candidates recommended on the basis of the competitive

examination conducted by the Commission shall directly be recruited.

(6) The syllabus and marks for the conduct of competitive examination shall

be determind by the State Government in consultation with the

Commission.

5. Probation Period - The probation period after appointment shall be of two

years. The probation period may be extended up to one year if the service

and conduct is not found satisfactory during the period. The appointment of

such personnel shall be terminated if service and conduct is not found

satisfactory during the extended period of probation.

6. Training - (1) The appointing authority shall arrange for conduct of training

schedule during the probation period for the members of this cadre.

(2) A Short Time Refresher course shall be arranged for the members of

this cadre as per requirement from time to time.

7. Confirmation - The members appointed in this cadre shall be confirmed

after satisfactory completion of probation period and necessary training.

8. Promotion - (1) The confirmed Auditors, Cooperative Societies in the

cadre shall be promoted to Senior Audit Officer and from Senior Audit

Officer to Sub Divisional Audit Officer on the basis of seniority cum merit

recommended by the Department Promotion Committee.

(2) The minimum time period required for promotion from one grade to

next grade shall be determined by the State Government (Department

of Personnel and Administrative Reforms) from time to time.

9. Deputation - The members of this cadre shall be deputed in State

Government fully/partially owned or controlled Cooperative Societies,

undertaking or Project against the identified posts.

10. Removal of Difficulty - If any difficulty arises in course of implementation

of any provision of this Rule the State Government may issue orders for

removal of such a difficulty.

11. The Department shall be competent for defining any provision of this Rule

and if required advice from Finance/Personnel and Administrative Reforms

Department may be sought.

12. Rules/Instruction enforced for the time being for the employees of the state

shall be applicable regarding such subject and issues which have not been

provided in this Rule.
