No. ds0@dkjk@v0fu0&21@2008&8123 In Exercise of the powers conferred by proviso

to Article 309 of the Constitution of India, the Governor of Bihar makes following rules to

regulate the recruitment and services on the post of Lower Division Clerks of Bihar Jails.

1. Short title, extent and commencement.-

(1) This rule may be called Bihar Jails Lower Division Clerks Cadre

Rules, 2008.

(2) It shall extends to the whole of Bihar.

(3) It shall come in force with immediate effect.

2. Definitions.- In this Rules, unless there is anything repugnant in context,

(i)

“State Government” means the Government of Bihar.

(ii)

“Order of the Government” means executive order in exercise of the

power conferred by Executive Rule formulated under article 166 of

the Constitution of India;

(iii)

“Appointing Authority” means Inspector General of Prisons, Bihar;

(iv)

“Controlling Authority” means Inspector General of Prisons, Bihar;

(v)

“Department” means as mentioned in Executive Rules- The Home

Department:

(vi)

“Personnel and Administrative Reforms Department” means as mention

in execution Rule, the Personnel and Administrative Reforms Department;

(vii) “Inspectorate of Prisons” means office of the Inspector General of Prisons.

(viii) “Commission” means Bihar Staff Selection Commission.

(ix)

“Lower Division Clerk” means sanctioned and notified post of lower

division clerk and accounts clerk in Bihar Jails and those sanctioned and

notified posts of Jail Clerks, which shall be designated as lower division

clerk when vacated by the present incumbents.

(x)

“Accountant” means the first stage of promotion from the post of Lower

Division Clerk.

(xi)

“Accounts Officer” means the ministerial post of Central Jail under group

‘C’ and the second stage of promotion.

3. Constitution of Cadre.- This cadre comprises number of posts/strength as

sanctioned and notified by the State Government from time to time.

4. Reservation.- The reservation policy for appointment determined by the State

Government from time to time shall be applicable.

5. Recruitment.-

(i) Recruitment shall be made on the regular posts in the scale as decided by

the Govt. from time to time.

(ii) Recruitment shall be made on the post of Lower Division clerks of the Jails

situated in the state.

6. Qualification.-

(a) Educational Qualification. –(i) Matric Pass or equivalent degree approved by

the Center/ State Government.

(b) Qualifying knowledge of Typing/Computer.

7. Basis and Mode of the recruitment:-

(a) The Commission shall take action for appointment against the vacancies

calculated and reported by the Inspectorate of Prison.

(b) The Commission shall make its recommendation for this cadre through

the examination conducted for the appointment of Muffassil clerks.

8. Hierarchy of the cadre.

(a) Hierarchy of the cadre shall be as follows:-

(i)

Lower Division Clerks/ Bill Clerks

Pay seale-3050-4590

(ii) Accountants/Jail Clerks

Pay seale-4000-6000

(iii)

Accounts officer

Pay seale-5000-8000

NOTE:- Existing posts of Jail Clerks, when vacated by present occupants shall

automatically be converted in to the posts of Lower Division Clerks.

(2)

Appointment on the higher posts than L.D.C/ Bill Clerks shall be made by

promotion from its just lower post. Recommendation of the DPC

(Department Promotion Committee) constituted in Inspectorate of

Prisons, shall be obtained in the proposals of the promotions of the

procedure and time span (Kalawadhi) laid down by the Govt. (Personnel

and Administrative Reforms Department) from time to time. Promotion

within the cadre shall be given on seniority-cum-merit basis.

(3)

Promotion on the post of Accountant shall be given to those LDCs/

Accounts Clerks who have passed Intermediate or equivalent

examination with Math/ Commerce and accountancy/ Statistics or

Economics on the date of consideration for promotion.

(4)

Promotion on the post of Accounts officer shall be given to those

Accountants/Jail Clerks, who have passed graduation or equivalent

examination from recognised University with Mathematics/ Commerce

and accountancy/ Statistics or Economics on the date of consideration

for the promotion.

(5)

If no eligible candidate is available for promotion in any year on the post

specified in sub rule (3) and (4), then backlog vacancies of that year shall

be filled by direct recruitment through Commission.

The Commission shall follow the process and criteria for the recruitment

according to rule-7 sub rule (3).

Entry Point of the cadre:-

(1)

Entry point of the cadre shall be LDC/Accounts clerks- selected through

two-stage written examination, conducted by the Commission.

(2)

If no eligible candidate is available for the promotion on the post of

Accountant and Accounts officer, the post shall be filled according to

the provision in rule 8 (5).

10. Probation Period:- Newly appointed employees shall be declared probationer

with effect from the date of appointment. The period of probation shall be of

two years, which may be extended for one year in case of service and

performance not being satisfactory. In case of service not being satisfactory

during the extended period also, the service of the employee on probation

may be terminated.

11. Confirmation:- A probationer shall be eligible for the confirmation if he has

passed the departmental accounts exam and has completed his probation to

the satisfaction of appointing authority .

12. Pay Scale:- The pay scale and allowances for the posts of the cadre shall be as

notified by the Government from time to time.

13. Seniority:-

(1) The relative seniority shall be fixed according to the merit list issued/

provided by the Commission.

(2) All the employees directly appointed under 8(5) shall be ranked Junior to

those Accountant and Accounts officer working on the date of their

appointment.

14. Category of the Cadre:-The cadre shall be of Group C or other, according to

the classification made by the Government form time to time. It shall be a

state cadre.

15. Discipline, Appeal and Punishment:- Provisions of the Bihar Government

Service (classification, control and Appeal) Rule 2005, shall apply on all the

members of the cadre.
