The 27th October 2008

No. 3/M-/054/08Kañ/7020—In exercise of powers conferred under sub-section (2) of

section-4 of the Bihar State Election Authority Act, 2008 (Bihar Act 14, 2008), the State

Government makes the following Rules for determination of Service Conditions of the Chief

Election Officer of the State Election Authority:-

1. Short title and Commencement.-(1)

These Rules may be called the Bihar State

Election Authority (Service Conditions of the Chief Election Officer) Rules, 2008.

(2) It shall come into force with immediate effect.

2. Definitions.- In these Rules, unless the context otherwise requires-

(a) 'Act' means, the Bihar State Election Authority Act, 2008 (Bihar Act 14, 2008);

(b) 'Authority' means Bihar State Election Authority;

(d) 'Chief Election Officer' means the Chief Election Officer nominated under

subsection (2) of section 3 of the Act' and

(e) The words and expressions used herein but not defined shall have the same

meaning assigned to them in the Act.

3. Salaries and Allowances.-

The Chief Election Officer shall be entitled to such pay

and allowances as admissible to the officer of the State Government of his rank and status.

4.(1) In the case of nomination of retired officer as Chief Election Officer, such Chief

Election Officer shall, at his option to be exercised within a period of six months from the date of

his appointment, be entitled to draw his pension and retirement benefits as per the rules applicable

to the service to which he belonged with effect from the date of his appointment as Chief Election

Officer, provided that, in such an event his pay as Chief Election Officer shall be reduced by an

amount equivalent to the basic pension including any portion of the pension which may have

been commuted and the pension equivalent to other retirement benefit and he shall be entitled to

draw his pension and other retirement benefits separately.

(2) If he does not exercise the option specified in subsection (1), he shall count his

service as Chief Election Officer for pension and retirement benefits under the rules applicable to

the service to which he belonged immediately before such appointment. This provision shall be

applicable in the case of appointment of working officer as Chief Election Officer.

5. Rank and Status.-The rank and status of the Chief Election Officer shall be admissible

according to the office of the State Government of his rank and status.

6. Leave.-The Chief Election Officer shall be entitled to leave as follows:-

(a) Casual Leave as admissible in the State Government.

(b) Earned Leave, half pay leave and Commutated leave in accordance with the

Bihar Service Code.

7. House Rent Allowance.- The Chief Election Officer shall be entitled to House Rent

Allowance as per Government Rules.

8. Travelling Allowance.-The Chief Election Office shall be entitled to Traveling

Allowance as admissible to the officer of the State Government of his rank and status.

9. The Conditions of service of the Chief Election Officer for which no express

provisions has been made in these Rules shall be such as applicable to the officer of the State

Government of his rank and status.
