The 1st January 2009

No- 1/Estt-5003/2005-01—In the exercise of the powers conferred under proviso to

Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the Rules for

the appointment and service conditions of clerks in the Employment wing of the Department of

Labour Resources.

1. Short title and commencement.— (a) These ‘Rules’ may be called the “Bihar

Employment Clerical Cadre Rules, 2008”

(b) These ‘Rules’ shall come into force with immediate effect.

2. Definitions.— In these Rules, unless there is anything repugnant to the subject

or the context-

(a) “Appointed Day” means the date of commencement of these rules;

(b) “Cadre” means the Bihar Employment Clerical Cadre;

(d) “Person appointed by the direct recruitment” means a person recruited to

the post of Lower Division Clerk on the basis of result of a competitive

examination held by the competent authority;

(e) “Attached offices” means offices so notified by the State Government;

(f) “Appointing Authority” means the Director, Employment & Training,

Bihar;

(g) “Probationer” means a person recruited to the post of Lower Division

Clerk grade on probation;

(h) “Common seniority list” means the seniority list of employees of the

cadre, as on the appointed day and revised from time to time in accordance

with the Regulations to be framed for the purpose by the State

Government, which shall be maintained by the Directorate of Employment

& Training Bihar, and;

(i) “Commission” means the Bihar State Staff Selection Commission.

3. Cadre.— The Cadre will be a state level cadre. There shall be following grades

of post in the Cadre- Lower Division Clerk, Upper Division Clerk, Head Clerk and Office

Superintendent.

4. Authorised strength of the service.— The authorized strength of the service

shall be determined from time to time by Labour Resources Department with the

concurrence of the Personal and Administrative Reforms Department / Finance

Department.

Provided that on the appointed day 50% of the sanctioned strength of posts of

clerk shall be deemed to be the post of Lower Division Clerk Grade and

50 % post shall be deemed to be the post of Upper Division clerk and other

higher grade. The odd number of posts shall be deemed to be of the Lower

Division Clerk grade. But if the working strength of Upper Division Clerk

grade is more than 50% in that case such post shall be deemed to be the

post of Upper Division Clerk Grade till the retirement or promotion of the

concerned Upper Division Clerk. Promotion to the Upper Division Clerk

Grade shall not be given till the number of post in the grade of Upper

Division Clerk becomes less than 50%.

5. Reservation.— The provision of reservation issued by the State Government

from time to time shall be in the force in the recruitment / promotion in this service.

6. Recruitment in the grade of Lower Division Clerk:-

1. For appointment in the Lower Division Clerk the minimum educational

Qualification shall be Matric pass or equivalent with knowledge of Hindi

typing in addition to competency in computer operation and computer

typing.

2. After Calculation of vacancies for each calendar year as on 1^st April, the

category wise requisition for vacancies shall be sent to the commission

latest by 30^th April. The eligibility of age shall be on the basis of 1^st

August.

The recommendation sent by the commission shall be valid for a period of

one year from the date of its receipt in the department.

3. Eighty five percent (85%) of the authorized strength of Lower Division

Clerk Grade shall be filled up by direct recruitment on the basis of result of

competitive examination held for this purpose by the Commission.

Provided that, maximum up to ten percent (10%) of the post to be

filled up by direct recruitment shall be filled up from amongst the

dependents of the Government servant who have died in harness, on

compassionate basis in accordance with the prescribed procedure and on

fulfilling all requisite qualification for being appointed to this grade for

which recommendation of the Commission shall not be required.

Provided that, in case of Regular appointment and Appointment on

Compassionate Ground at the same time, the appointees on Regular

Appointment shall rank senior to those appointed on Compassionate

ground.

4. Person appointed and working as Lower Division Clerks as well as the

person appointed on compassionate ground on the appointed day shall be

deemed to be automatically included in this grade.

Provided that such Lower Division Clerks who have been deemed

to be automatically included in this cadre and whose age is less than 50

years on the appointed day shall be required within two years from the

appointed day to obtain competency in Typing and Computer, as

determined by the State Government. In case of not obtaining such

competency within the said period they will be deprived of further annual

increments.

5. Remaining fifteen percent (15%) of the authorised strength shall be filled

up from amongst the group ‘D’ employees working for minimum five

years in the regular establishment of field offices, having requisite

qualifications / eligibility, on the basis of limited competitive examination

held by the Commission.

6. On the basis of vacancies reported by the field offices, the Department of

Labour Resources shall send reservation categories wise requisition to the

Commission.

7. The qualification, rules, syllabus etc for competitive examinations referred

to the sub rule (3) and (5) shall as determined by the State Government

through the Regulation.

7. Probation period.— Every recruitment to the Lower Division Clerk Grade

whether it is by way of direct recruitment or limited competitive examination or on

compassionate grounds shall initially be on probation. The probation period shall be for

two years which may be extended to one year by the Appointing Authority. While

granting the extension, the shortcoming be also indicated so that the employee concerned

may get the opportunity to improve in the same.

Provided that the extension of probation period shall not be more than one

year. In case of the services being unsatisfactory even in the extended period the

service of the person may be terminated.

8. Training.— In the probation period, the Lower Division Clerk shall have to

participate in such training as prescribed by Regulation or decided by the Government.

9. Confirmation:-

(1) A person appointed to Lower Division Clerk grade on probation, after

satisfactory completion of probation period as well as on completion of

required training and on passing test for typing, Computer competency and

Departmental Accounts examination prescribed under relevant rules of

Bihar Board of miscellaneous rules shall be confirmed by the appointing

Authority.

(2) The test referred under sub rule (l), shall be conducted by the Board of

Revenue. The procedure etc. for test of typing and computer competency

shall be determined by regulation in consultation with the Board of

Revenue.

(3) On confirmation in service, the period spent on probation shall be counted

in the total length of service.

10. Determination of Seniority in the Lower Division Clerk Grade:-

(1) A seniority list shall be maintained at the level of Directorate of

Employment and Training (Employment).

(2) The inter-se-seniority of the person appointed on the recommendation of

the Commission under sub rule (3) of Rule-6 shall be in accordance with

the merit list recommended by the Commission.

(3) The inter-se-seniority of the employees appointed on compassionate basis

shall be according to their date of appointment.

(4) All the employees appointed in a year on the basis of competitive

examination held by the Commission under rule 6 (3) or appointed under

rule 6 (5) shall be senior to all the employees en bloc appointed on

compassionate basis in that year.

(5) The inter-se-seniority of the employees appointed under rule 6(5) shall be

in accordance with the merit list of the result of the limited competitive

examination.

(6) All the employees appointed under rule 6 (5) in a year shall be junior to

the employees en bloc appointed on recommendation of the Commission

under rule 6(3) in that year.

11. Promotion.— Steps of promotion in this cadre shall as follows:-

(1) The post of Upper Division Clerk Grade shall be filled up on the basis of

seniority cum merit from such clerks of the Lower Division Clerk Grade,

who are confirmed and completed the KALABDHI as determined from

time to time by the Personal & Administrative Reforms Department and

passed the final Departmental Account Examination in both papers as

prescribed under the relevant rules of Bihar Board of Miscellaneous Rules.

(2) The promotion in the Upper Division Clerk shall be made on the

recommendation of the Departmental Promotion Committee.

(3) All clerks working in the scale of Upper Division Clerk on the appointed

day shall automatically become the member of this cadre in the grade of

Upper Division Clerk.

Provided that such clerks whose age is below 50 years, shall have to

obtain competency in typing and computer within two years of appointed

day. If such competency is not obtained within the said period no further

increment shall be admissible to them.

(4) Promotion to the post of Head Clerks and Office Superintendent shall be

given on the basis of seniority-cum-merit from amongst those employees

working on the post of Upper Division Clerks and Head Clerk

respectively, who have completed the ‘KALABDHI’ as determined from

time to time by the Personal and Administrative Reforms Department.

(5) The promotion to the post of head clerk and office superintendent shall be

made on the recommendation of the Departmental promotion Committee.

12. Common Seniority list.—The common seniority list of this cadre shall be

prepared and maintained by the Directorate of Employment & Training (Employment),

Bihar as per the principles and procedure determined under regulation.

13. Interpretation.—Should any doubt arise as to the interpretation of any of the

provision of these Rules the matter shall be referred to the Labour Resources Department

whose decision there on shall be final .

14. Power to make regulation.—The Directorate of Employment & Training

(Employment) may make regulation as necessary to give effect to the provisions of these

Rules with the concurrence of the Labour Resources Department.

15. Miscellaneous.— Not withstanding anything contained contrary to these Rules

in any other rules with respect to Bihar Employment clerical cadre, the provision of these

Rules shall have over riding effect.

16. Repeal.—All the previous Rules/resolution/circular/instruction etc. in respects

of this Cadre stand repealed with the coming in to force of these Rules.
