provisio of Article 309 of the Constitution of India the Governor of Bihar makes the

following Rules for the Clerks of the field establishments of the S.C. & S.T. Welfare

Department :-

1. Short title, extend and commencement :-

(1)

These Rules may be called “S.C. & S.T. Welfare Department Clerical

(State Cadre) Rule, 2008.

(2)

It shall extend to the whole of Bihar.

(3)

It shall come in force on the date of the publication in the official

Gazette.

2. Definitions :- In these rules unless the context otherwise requires.

(a) “Appointed day” means the date of commencement of these Rules.

(b)

“Cadre” means S.C. & S.T. Welfare Department Clerical Cadre.

(c)

“Grade” means the grade specified in Rule-3.

(d)

“Person appointed by direct recruitment” means the person appointment

to the post of Lower Division Clerk on the basis of the result of

competitive examination organized by the commission.

(e)

“Appointing Authority” means Director, S.C. & S.T. Welfare

Department Bihar.

(f)

“Cadre controlling Authority” means Director, S.C. & S.T. Welfare

Department, Bihar.

(g)

“Department” means S.C. & S.T. Welfare Department, Bihar.

(h)

“Probationer” means the person appointment on probation in the grade

of Lower Division Clerk.

(i)

“Common Gradation List” means the gradation list of the employees of

the cadre on the position at the appointment day and revised from time

to time as per regulation to be made by the S.C. & S.T. Welfare

Department for the purpose, which will be maintained by the S.C. &

S.T. Welfare Department.

(j)

“Commission” means Bihar Employees Selection Commission. (Bihar

Karmchari Chayan Ayog).

3. Constitution of the Cadre :- This cadre shall comprise the following grades :-

(i)

Lower Division Clerk

(3050-4590)

(ii)

Upper Division Clerk

(4000-6000)

(iii)

Head Clerk

(4500-7000)

(iv)

Head Clerk-cum-Accountant

(5000-8000)

4. Authorized Strength of the Cadre :-

(1)

The re-assessment of the authorized strength of the cadre shall be

made, from time to time as per need, by the S.C. & S.T. Welfare

Department with the consent of the Finance Department and with

consultation of the Division Deputy Director, S.C. & S.T. Welfare.

(2)

Out of the sanctioned strength of the Lower Divisional Clerk/Upper

Division Clerk/Head Clerk/Head Clerk-cum-Accountant on the

appointed day, 50 percent posts shall be deemed to be Lower

Division Clerk grade and rest 50 percent of Upper Division Clerk

grade. In addition to that the post of odd number will be deemed to

be of Lower Division Clerk grade. Provided that if the working

strength of the Upper Division Clerk and Upper Grade would be

more than the 50 percent, such posts shall continued to be deemed in

the Upper Division Clerk and Upper grades till the retirement or

promotion of the working personnel in the Upper Division Clerk

grade and upper grade. Until the strength of the Upper Division

Clerk and Upper grade comes below 50 percent, no promotion would

be made to the posts of Upper Division Clerk.

5. Reservation :- The provisions of reservation notified by the State Government

from time to time shall be applicable in the appointment/promotion in the service.

6. Recruitment in the Lower Division Clerk grade :-

(I)

The minimum educational qualification/other qualification and

procedure of recruitment shall be as per the provisions of the

regulation.

(II)

The requisition for vacancies of each calendar year will be sent to

the Commission upto the month of December of the preceding

calendar year. The qualifying age will be determined as on 1^st

January.

(III)

The eighty five percent (85%) posts of the authorized strength of

the Lower Division Clerk shall be filled by direct recruitment on

the basis of the competitive examination organized by the

commission for the purpose.

Provided that, maximum five percent (5%) posts, out of the

posts to be filled by direct recruitment, shall be filled by

appointment on compassionate ground from amongst dependents

of the Government servants died in harness and having all the

qualifications, for which the recommendation of the Commission

not to be required.

(IV)

The persons appointed and working on the appointed day in the

Lower Division Clerk grade and the persons appointed and

working in the Lower Division Clerk grade on the compassionate

ground shall automatically be deemed to be included in this grade.

Provided that, such Lower Division Clerks who have been

deemed to be automatically included in this service and are less

then the age of 50 years on the appointed day shall have to acquire

the requisite qualification, as determined by the State Govt., in

typing and computer within two years of the appointment dya,

failing which no further increment be payable to them.

(V)

Rest fifteen percent (15%) of the authorized strength shall be filled

up from amongst the group-D employees working in the regular

establishments of the field offices of the State Govt., having

requisite qualifications as specified by the regulation, through the

limited competitive examination organized by the Commission.

(VI)

On the basis of the intimation received from the offices concerned

the reservation category wise requisition shall be sent to the

Commission by the Department. On the basis of the result of the

competitive examination, the allotment of candidates in each cadre

shall be made by the Department on the basis of the merit-cum-

option. The procedure of allotment on the basis of merit-cum-

option shall be determined by the regulation.

The qualification, rules and curriculum for the competitive examination referred

in Rule 6(III) and 6(V) shall be the same as may be decided by the regulation.

Probation period :- Any appointment in the category of the Lower Division

Clerk, whether made by direct recruitment or Limited Competitive Examination or on

compassionate ground, shall initially be on probation. The period of probation will be of

two years, which may be extended by the appointing authority.

Provided that, the personnel appointed as Lower Division Clerk prior to

the appointed day shall be deemed to be appointed on probation;

Provided further that, the total period of extension of probation shall not

exceed more than three years. If even in the extended period of probation, the

services are not found to be satisfactory, the incumbent may be removed from

service.

Training :- The Lower Division Clerk on probation shall have to undergo such

training as may be prescribed by the regulation.

10.

Confirmation :-

(1) A person appointed on probation in the grade of Lower Division Clerk,

may be confirmed by the appointing authority on being successful in

typing and computer test.

(2) The test referred in sub-rule (1) shall be conducted by the Board of

Revenue. The determination of procedure etc. for the test of typing and

knowledge of computer under sub-rule (1) and proviso of sub-rule (4)

of rule 6 and proviso of sub-rule (3) of rule 11 shall be made by the

Department in pursuance of the regulation in consultation with the

Board of Revenue.

(3) No increment will be granted to the personnel appointed in the grade

of Lower Division Clerk without being successful in the test of typing

and knowledge of computer.

11.

Determination of Seniority in the grade of Lower Division Clerk :-

(1)

A common gradation list shall be prepared on the basis of existing position

for the holders of the posts of Clerk, Head Clerk and equivalent posts in

all the offices.

(2)

The seniority of the persons appointed on the recommendation of

Commission under sub-rule (3) of rule 6 shall be in accordance with the

merit list prepared by the commission.

(3)

The Inter-se seniority of the personnel appointed on compassionate ground

shall be in accordance with the their date of appointment.

(4)

All the personnel appointed in any year on the basis of competitive

examination organized by the Commission under rule 6(III) or all the

personnel appointed under rule 6(V) shall be senior to all the personnel

appointed collectively on compassionate ground in the same recruitment

year.

The Inter-se seniority of the personnel appointed under rule 6(V) shall be

in accordance with the merit list of the result of the Limited Competitive

Examination.

All employees appointed under rule 6(V) shall be junior to the employees

appointed on the recommendation of the commission in the same

requirement year.

12.

Promotion in the grade of Upper Division grade and higher grade :-

(1) The authorized strength of this grade shall be filled up in accordance with

Appendix-1 on the basis of merit cum fitness by such clerks of the Lower

Division Clerk grade, who are confirmed, and fulfilling the fixed tenure

(Kalawadhi) as determined from time to time by the Personnel and

Administrative Reforms Department.

(2) The promotion in the grade of Upper Division Clerk may be granted on the

recommendation of the promotion committee constituted in the Chairmanship

of Director, SC & ST Welfare.

(3) All the clerks/senior clerks appointed on or prior to 20.12.2000 and working

in the field offices shall automatically be the member of the grade of Upper

Division Clerk.

Provided that, such clerks/senior clerks, who have been automatically

included in the grade of Upper Division Clerk and are less than 50 years of

age on the appointed day, shall have to acquire the knowledge of typing and

computer within two years of the appointed day. In case of failing to acquire

such qualification within the said period, no further increment will be

admissible to him/her.

Common Gradation List : The common gradation list of this service shall be

prepared and maintained by the Department in accordance with the principles and

procedure as determined in the regulation.

14.

Interpretation : Where any doubt arises in the interpretation of any provision of

these Rules, that matter be referred to the Department, whose decision on that shall be

final.

15.

Power to make regulation : To make the provisions of these Rules effective the

Department may make regulation as per necessity.

16.

Miscellaneous : Notwithstanding any thing contrary to these Rules contained in

any other Rules in reference to the Lower Division Clerk and Upper Division Clerk, the

provisions of these Rules shall prevail.
