The 14th August, 2009

G.S.R. 5, dated the 15th September 2009 —In exercise of the powers conferred by

section-3 of the Essential Commodities Act 1955 (Central Act 10 of 1955) read with the order

of the Government of India in the Ministry of Consumer Affairs, Food and Public Distribution,

published under order 649(E), dated 9th March 2009, S.O.-1621(E), 2nd July, 2009 and

GSR-531(E), dated 16th July 2009 and in view of Removal of (Licensing Requirements, Stock

Limits and Movement Restrictions) on specified Foodstuffs (Fifth Amendment) order 2009 and

clause (V) of the Central Government sugar (control) order, 1966 and with prior concurrence of

Government of India the Governor of Bihar is pleased to make the following Amendment in the

order issued vide Notification no. GSR 49 dated 17^th October 1985 for the storage limit of trade

articles under clause (3) of Bihar Trade Articles (Licensing Unification) order 1984, published

by Food and Consumer Protection Department, Bihar, Patna under order GSR 9, dated 19^th

April 1984.—

AMENDMENT

No recognized dealer of sugar shall hold any stock of vacuum pan sugar or khandsari

(open pan sugar) for a period exceeding thirty days from the date of receipt by him of such

stock and shall not keep in stock at any time vacuum pan sugar/khandsari in excess of the

quantities mentioned against each.—

(a) Wholesale dealer -2000 quintals

(b) Retail dealer-50 quintals

Provided that nothing contained in this order shall apply to the holding or keeping of

stock of sugar/khandsari .—

(i) On Government account; or

(ii) By the recognized dealers nominated by the State Government or an officer

authorised by it to hold stock for distribution through fair price shops; or

(iii) By the Food Corporation of India/Bihar State Food Corporation, stock;

2. Previously issued corresponding notifications/orders shall deem to be amended upto

this extent.

3. This notification shall come into force at once.
