The 12th January 2010

S.O. 1, dated the 19th January 2010—In exercise of the powers conferred under

Section 112 of the Factories Act, 1948(LXIII of 1948), the Governor of Bihar is pleased

to make the following amendments in the Bihar Factory Rules, 1950:-

1. Short Title, Extent and Commencement.— These Rules may be called the Bihar

Factory(Amendment) Rules, 2009.

(2) It shall extend to the whole of Bihar.

(3) It shall come into force at once.

2. Substitution of Sub-Rule(2) of Rule 5 of the said Rules-Sub-Rule(2) of Rule 5

of the said Rules shall be substituted by the following.

“(2) Every licence granted or renewed under this chapter shall remain valid for a

period of five years and in force up to the 31st December of the year up to

which it is granted or renewed.

Provided that every licence granted to a factory, declared under Section 85 of

the said Factories Act, 1948, shall remain valid till the closure of the

concerned factory.”

3. Substitution of Schedule A, B and C of the said Rules-Schedule A, B and C of

the said Rules shall be substituted by New Schedule A, B and C which are annexed

hereto.
