The 10th March 2010

G.S.R. 2 dated 25th March 2010—By the order of the Government of India in the

Ministry of Consumer Affairs, Food and Public Distribution, Published under order 2461

(A), 25^th September 2009, the words expression used in respect of purchase, movement,

sale, supply, distribution or storage for sale in the Removal of (Licensing requirements,

Stock limits and Movement Restriction) on Specified Foodstuffs Order, 2002 shall be

kept in abeyance for commodities namely Pulses for a further period upto 30^th September

2010. In exercise of the powers conferred by section-3 of the Essential Commodities Act

1955 (Central Act 10 of 1955) read with above order the Governor of Bihar is pleased to

make the following amendment in the order issued vide notification No. GSR - 49, dated

17^th October, 1985 for the stock limit of trade Articles under clause (3) and clouse 18 of

Bihar Trade Articles (Licencing Unification) order 1984 Published by Food and

Consumer Protection Department, Bihar, Patna under order G.S.R. 9, dated 19^th April,

1984.

(1) No recognized dealer of Pulses shall hold any stock of Pulses and for a period

exceeding 30 (thirty) days from the date of receipt by him of such stock and shall not

keep in stock at any time Pulses in excess of quantities mentioned below :-

(a) Muncipal Corporation Areas - 750 (Seven Hundred Fifty) qunitals

(b) All Other Areas - 500 (Five Hundred) quintals

Provided that nothing contained in this order shall apply to the holding or

keeping of stock of Pulses by the following

(i) Stock held on Government account or

(ii) Stock held by

the

recognised dealers nominated by

the State

Government or an officer authorized by it for distribution, through Fair Price

Shop .

(iii) Stock held by the Food Corporation of India/Bihar State Food Corporation .

(2) The provisions of Bihar Trade Article (licensing unification) order 1984 shall remain

applicable in respect of licence related to dealer of Pulse. The licence fees, renewal

fees and duplicate fees specified for wholesale dealers in aforementioned order shall

be applicable for the license in respect of above dealer and respective District

Magistrate shall be the licensing authority.

(3) The stock limits fixed as above shall not be crossed in any case without prior

approval of the State Government.

(4) Dealers for Pulse shall have to obtain licence from respective District Magistrate

whithin 30 (thirty) days from the date of commencement of this order.

(5) Above order shall not be applicable for dealers Trading/Storing Pulse upto 100

(Hundred) quintals.

(6) Corresponding notifications/orders issued previously shall deem to be ammended

upto this extent.

(7) This notification shall come into force at once.

(8) This Notification shall remain in force concurrently with the validity of the Central

Order issued under No. S.O. 2461(E) dated 25^th September 2009 referred to in the

preamble of this Notification.
