No. 15/DLA Policy-Lok Adalat-03/03 - 1495/Rev.—Vide Notification No.

1217/Rev. dated 28th September 1996, the following decision was taken by the

State Government:-

“The attention of the State Government has been drawn that a large

number of First Appeal cases pertaining to Land Acquisition are pending for

disposal in the Hon’ble High Court for a long period. Considering the issue

comprehensively, the State Government has taken a decision that all the First

Appeal cases pending in the Hon’ble High Court, in which the amount does not

involve more than Rs. 25000.00 (Rupees twenty five thousand) should be

withdrawn with the immediate effect or compromise should be made with the

concerned parties as per need. It will not mean that the amount fixed as

compensation in the concerned cases will be cited in other cases as pre-example.

The decision shall be taken on the merit of each case in other cases.”

Thereafter, in the matters of First Appeal pertaining to Land Acquisition,

the limit of Rs. 25,000.00 (Rupees twenty five thousand) was raised to Rs.

50,000.00 (Rupees fifty thousand) vide Notification No. 2618/Rev. dated 10th

November 2006.

The Hon'ble Patna High Court, while hearing 8 cases of First Appeal i.e.

F.A. No.- 730/1978 Kanhaiya Lal & others Vs. The State of Bihar and Others and

other similar cases, passed orders on 21st October 2008 and 27th March 2009

through which clarification was sought on the point "or compromise should be made

with the concerned parties as per need" as mentioned in the Notification No.

2618/Rev. dated 10th November 2006.

After reviewing the subject, the Government has taken the following

decisions by amending the previous Notifications pertaining to First Appeal

cases of Land Acquisition vide Notification No.-1310, dated 9th December 2009

of Revenue & Land Reforms Department:-

1. All the First Appeal cases of Land Acquisition filed by the State

Government, pending in the Hon'ble High Court in which total compensation

amount involved (except the amount of interest) is not more than Rs. 50,000.00

(Rupees fifty thousand), should be withdrawn with immediate effect.

2. "Or compromise should be made with the concerned parties as per need" is

being deleted from the previous Notification No.- 1217/Rev. dated 28th

September 1996 and Notification No.- 2618/Rev dated 10th November 2006.

In C.W.J.C No.- 13895/2006 Brahmadeo Thakur vrs the State of Bihar

and others, the Hon'ble High Court vide its order dated 2nd December 2009 as

contained in Para- 2 Sub Para- (IV) directed that the upper limit of total

compensation amount of Rs. 50,000.00 (Rupees fifty thousand) in Land

Acquisition cases should be re-determined by the State Government.

After reviewing the subject, the Government has taken following

decisions by amending the previous Notifications pertaining to First Appeal

cases of Land Acquisition :-

1. In the matters of First Appeal pertaining to Land Acquisition, the limit

of Rs. 50000.00 (Rupees fifty thousand) is raised to Rs. 100000.00 (Rupees One

lac).

2. First Appeal Cases pertaining to land acquisition filed by the State

Government in which total compensation amount involved is up to Rs. 100000.00

(Rupees One lac) should be withdrawn with immediate effect.

3. Now First Appeal Cases up to the compensation amount Rs. 100000.00

(Rupees One lac) in the matter of land acquisition cases would not be filed by the

State Government.

4. First Appeal may be filed after scrutinizing the merit of each

individual case in which the amount involved is more than Rs. 100000.00

(Rupees One lac) pertaining to Land Acquisition. Filing of an appeal is a legal

process and it will continue depending on merit of individual case.

Clarification: - "Compensation amount" means amount involving value of

land that is to be acquired, value of assets existing on the land, extra

compensation amount and solatium as per provisions under section-23 of Land

Acquisition Act, 1894 (amended as 1984).
