The 4th March 2011

No. 3/C5-296/08 (Part file) 575—In exercise of the powers conferred by Section-

90 of the Bihar Excise Act, 1915 (Bihar Act-II of 1915), the Board of Revenue, Bihar

makes the following amendments in the Rules framed under Notification No.-23-137-2,

dated 29^th April 1919, as amended from time to time :-

The following Rule shall be inserted after the existing Rule 105A:-

“105 B- For the issuance of Country Liquor and Spiced Country Liquor the

required pass may be issued on the realization of movement fee at the rate of

Rs. 10 (Rupees ten only) per L.P.L. on the quantity under issue."

The sub-rule (1) of existing Rule 106, inserted by the Board's Notification No.-

23-5/94-3-3818 dated 30^th May 1994, shall be amended as follows:-

(i)

The existing sub-clause (i) of clause (a) shall be substituted as follows:-

“106 (1) (a) (i)-The licence fee of Rs 5,30,000 (Rupees five lakhs thirty

thousand only) per annum shall be payable in advance."

(ii)

The existing clause (b) shall be substituted as follows:-

"106 (1) (b) -The licence fee for sale to trade shall be Rs 1,50,000 (Rupees

one lakhs fifty thousand only) per annum and the licence fee for

distributionship shall be Rs 5,00,000 (Rupees five lakhs only) per

annum payable in advance."

The existing Rule 106 B as amended by Notification no. 2/23 - 11/90 - 2 dated

27^th August 1990 shall be substituted as follows:-

"106 B-India made foreign liquor may be imported in any place of Bihar,

provided that an import pass fee at the rate of Rs 8/- (Rupees eight only) per

L.P.L. has been levied and realised in the State of Bihar.”

The existing rule 106C as amended by Notification no.-268 dated 07^th April 2006

shall be substituted as follows:-

"106 C-India made beer may be imported in any place of Bihar, provided that, an

import pass fee at the rate of Rs 2 (Rupees two only) per bottle (650 ml) has been

levied and realised in the State of Bihar."

After the existing Rule 106C the following Rule shall be inserted, namely:-

"106CC-India made beer may be imported from the State to other States of the

country after realisation of export pass fee at the rate of Rs 1 (Rupees one only)

per bottle (650 ml) .

Provided that the brewery in the State shall not export more than 50%

(fifty percent) of the beer produced by it in a month.

The existing Rule 106E inserted by Board's Notification no.-3/S1-140-02/2003

(Part) -1296 dated 11^th December 2004 shall be omitted.

After the existing Rule 106F, inserted by Board’s Notification No.

3/S/EST/DEP/EX-1/2000-2122 dated 21^st August 2000, the following Rules shall

be inserted, namely:-

“106G- Extra neutral Alcohol (E.N.A.) may be imported in any place of Bihar,

Provided that an import pass fee at the rate of Rs 8/- (Rupees eight only) per

L.P.L. has been levied and reallised in the State of Bihar."

"106H- Extra Neutral Alcohol (E.N.A.) may be exported from the State to other

States in the country after realisation of an export pass fee in the state of Bihar at

the rate of Rs 4/- (Rupees four only) per L.P.L.."

This notification shall come into force from the date of its publication in the

Official Gazette.
