The 22^nd June 2011

S.O. 162, dated 22^nd June 2011—WHEREAS, in exercise of powers conferred

under Section 3 (1) of the Commissions of Inquiry Act, 1952 (No. 60, 1952), the

Government of Bihar is of the opinion that it is necessary to appoint a Commission of

Inquiry for the purpose of inquiring into the incident of police firing which took place on

3rd June, 2011 at Forbesganj in Araria district;

NOW, THEREFORE, the Governor of Bihar is pleased to constitute a single member

Commission of Inquiry in accordance with recommendation of Hon’ble Chief Justice of

Patna High Court, comprising of Hon’ble Mr. Justice Madhavendra Saran (Retired) as its

Chairman.

2. The Commission will have the following terms of reference:-

(I) To inquire into the background and the circumstances which led to occurrence

of the incident.

(II) To inquire into the sequence of events on 3^rd June 2011, role of the persons

concerned and fix the responsibility thereon.

(III) To inquire into the justification of firing by police.

3. The Governor of Bihar is further pleased to exercise powers conferred by sub-

section (1) of Section 5 of the said Act to direct that all the provisions of sub-section (2)

(3) (4) and (5) of the said section shall apply to this Commission.

4. The Commission shall submit its report within 6 months from issue of this

notification.
