The 28th September 2011
S.O. 374, dated 29th September 2011—In exercise of the powers conferred by
clause (b) sub-section (1) of section- 3 of the Minimum Wages Act, 1948 (11, of 1948)
read with sub-section (2) of section-5 of said Act and having considered all the
representations received on the proposal notified clause (b) sub-section (1) of section-5
of the said Act and also after consulting to Bihar Minimum Wages Advisory Board, the
Governor of Bihar is pleased to revise the minimum rates of wages fixed by Labour
Resources Department vide notification no. 3325, 3326, dated 01st July 2008 as
specified in column 3 of the schedule hereto annexed against each of the Agriculture
Operations and category of employees specified in the corresponding entry in column 2
thereof, which shall be payable in the whole of the State of Bihar to agriculture worker
in respect of the different operations in agriculture and the operations ancillary to
agriculture.
2. The Minimum rates of wages so revised shall be within the meaning of clause
(iii) of sub-section-(1) of section-4 of the said Act.
3. This notification shall come into force with effect from the dated 01 October,
2011.

Note :- (a) The minimu rates of wages above are based on the All India Average
Consumer Price Index Number (1960-100) 4120.07 point which is average of the
indices of the Second half of the year, 2010 (July-December) and as per decision taken
in the meeting of the Minimum Wages Advisory Board held on dated 16th September
2011, this revision includes the average of first half of All India Consumer Price Index
of year, 2011 i.e 4260.83 point, increase i.e 4.81 percent in the wage hike of 15 percent.
Next Variable Dearness Allowance will be applicable on the average of All India
Consumer Price Index of second half (July-December) of the year, 2011.
(b) In addition to the above minimum rates of wages the agricultural workers
will also be entitled to other traditional benefits available, if any.
(c) Minimum wages has been revised on the suggestions made by the Minimum
Wage Advisory Board on 16th September 2011 by adding 15 percent of wage and the
100 percent neutralization in the Consumer Price Index.

(d) The Minimum rates of wages above are inclusive of remuneration payable to
the workers in respect of the day of rest in any period of seven days.
(e) A worker shall for the work done on the weekly day of rest, be entitled to
over time payment as the rate prescribed in rule 25 of the Bihar Minimum Wages Rules,
1951.
(f) Men and women workers shall get the same rates of wages for the same work
or work of a similar nature of work.
(g) Conversion of the monthly rates of wages into daily rates of wages (on vice-
versa) shall be worked out by dividing the monthly rates by 26 and by multiplying the
daily rates by 26.
(h) In case of any dispute about the price of grains, the decision of Inspector
under the Minimum Wages Act shall be final and binding on the parties.
(i) If on the basis of mutual arrangement with employer the worker is willing to
get wage in gain in lieu of wages fixed in cash then any kind of grain (other than
"Kehsari") of equal value of the rates of wages fixed in cash may be paid to the
workers.
