No=O]icââMCMNCQS]OMNM]PRPV-D.M—In exercise of Powers conferred by section-14 &78 of the

Disaster Management Act, 2005 (53 of 2005), the Governor of Bihar is pleased to make the following

Rules to amend the Disaster Management (Term of Office and Conditions of Service of Members of the

State Authority and Pay and Allowances to Members of Advisory Committee) Rules, 2008:-

1. Short title, extent and commencement .—(1) These rules may be called Disaster Management

(Term of Office and Conditions of Services of Members of the State Authority and Pay and Allowances

to Members of Advisory Committee) (Amendments) Rules -2011.

(2) It shall come into force at once:

Provided that in case of existing vice chairman and members of the authority, it shall be

deemed to be come into force from their dates of assuming their posts.

2. The sub-rule (v) of rule 4 of the Disaster Management (Term of Office and Condition of

Service of Members of the State Authority and Pay and Allowances to Members of Advisory Committee)

Rules, 2008 shall be substituted by the following:-

"(v)(a) A person nominated as the Vice-Chairman of the State Authority shall exercise his option to

choose either :-

(i) pay (less pension in case of a retired officer), dearness allowance, House Rent

Allowance, ( in case Govt. accommodation is not available), medical facilities,

travelling allowance, leave travel concession as admissible to the officers of Chief

Secretary level in the Government of Bihar and leave as admissible to a

Government servant under the All India Services (Leave) Rules 1955;

or,

(ii) Pay, daily allowance as admissible to a Cabinet Minister in the Government of

Bihar, and pension (without dearness relief in case of Vice-Chairman who is a

retired officer), accommodation, medical facilities and travelling allowance as

admissible to a Cabinet Minister of the Government of Bihar in accordance with the

Ministers of Bihar (Pay & Allowances) Rules 2006 as amended from time to time.

(b)

A person nominated as a full time member of the State Authority shall exercise his/her

option to choose either :-

(i) Pay (less pension in the case of a retired officer), dearness allowance, House rent

Allowance (in case Govt. accommodation is not available), medical facilities,

travelling allowance, leave travel concession as admissible to a Principal Secretary

All India Services (Leave) Rules, 1955;

or,

(ii) Pay, daily allowance as admissible to a Minister of State in the Government of Bihar,

of State in the Government of Bihar in accordance with the Ministers of Bihar (Pay

& Allowances), Rules 2006, as amended from time to time:

Provided that, the pay and allowances or other service conditions of the Vice Chairman/Member

shall not be varied to their disadvantage after their appointment."

proviso of Article 309 of the constitution of India, the Hon'ble Governor of the State of Bihar,

hereby makes the following rules for determining the grounds and process for recruitment and

promotion to the post of "Editor" of Information and Public Relations Department.

CHAPTER-1

Preliminary

1. Short title, extent and Commencement-

a. These rules may be called Bihar Information Editor Cadre Service recruitment &

conditions rules -2011.

b. These rules will be operative in the whole state of Bihar.

c. They shall come into force from the date of publication of the notification in the

official gazette.

2. Definitions- In these rules, unless the context otherwise requires.—

a. "Governor" means the Governor of Bihar.

b. "Government" means Government of Bihar.

c. "Department" means the Department of Information And Public Relations

Department.

d. "Commission" means Bihar State Employees Selection Commission.

e. "member or Member of the Service" means person appointed in editor service.

f. "Schedule" means- Schedules prescribed with these rules.

g. "Service" means - Bihar Information Editorial Cadre Service.

3. Constitution of Service.— The cadre shall be constituted in the name of Bihar

Information Editor Cadre Service.

4. Service Structure.—

a. This service will be under the administrative control of Information and Public

Relations Department.

b. The state govt. will determine the strength of posts and may approval for the

creation of permanent / temporary posts of this service in addition to the approved

posts.

5. Status of posts.— The member of this service will be Non-gazetted.

CHAPTER-2

Recruitment

6. Source of Recruitment.— The appointment in basic grade of this service will be

through direct recruitment in accordance with chapter -3 of the Rules. The remaining higher

posts such as Assistant Director (Magazine) and Deputy Director (Magazine) will be filled by

the recommendation of Department Promotion Committee.

7. Determination of the vacant posts and to inform the commission.— The department

will assess the requirement prevailing on first April of every year after preview of the vacant

posts the proposal for direct recruitment would be sent to the commission by 30^th April.

8. Reservation.— The reservation policy of the govt. would be implemented in

appointment and promotion in this service besides Roaster Clearance would also be taken.

CHAPTER-3

Direct Recruitment

9. Direct recruitment through the commission.—The Commission will select the eligible

candidates for recruitment in the basic grade (Editor, Hindi & Urdu) of this service by obtaining

applications from the eligible candidates through an advertisement, and conducting eligibility

examination as per schedule III.

10. Eligibility.— The qualification for this service in basic grade would be according to

schedule-1.

11. Recommendations of candidates by the commission.— The commission on the basis

of the marks obtained in the written examination or/ and oral examination will prepare a merit

list. . In the list so prepared, the commission will recommend such number of candidates to the

state government which has been requisitioned by the state govt. The recommendation of the

commission will be valid for one year only.

CHAPTER-4

Seniority and Training

12. Seniority.– Under these rules, the inter se seniority of the Editor (Hindi & Urdu) will

be decided on the basis of the merit list recommended by the commission and as per the circulars

of General Administration Department issued time to time.

13. The member of this service may be sent for training inside or outside the state or

abroad for the period determined by the state govt. On the completion of training, the

performance evaluation shall be kept in mind by the Departmental Promotion Committee.

CHAPTER-5

Probation and Confirmation

14. Probation Period.—

a. Two years from the date of the joining of the recruited personnel against the

basic vacancy will be the period of probation.

b. During the probation period or after its completion, the appointment of the

recruited personnel may be terminated if the performance of the personnel be

unsatisfactory during the probation period or for other reasons if the personnel is

not eligible for being made permanent.

15. Confirmation.—

a. The service of the recruited personnel will be confirmed after his satisfactory

performance during the probation period and have passed the departmental

examination.

b. After the first annual increment, the next increment will be available after passing

the departmental examination.

CHAPTER-7

Promotion

17. The promotion shall be made on the basis of the recommendation of Departmental

Promotion committee.

(3) Member (Sc or St)

(4) Member

CHAPTER-8

Posting

18. Contract for working sphere.— The members of this service would be deputed in

any department of the state govt. or outside the state at any place.

19. Other service condition.— The other service condition such as disciplinary action

leave, retirement benefit, which has not been mentioned in this service would be in accordance

with the circular and other suitable rules and regulations of the state govt. in this regard.

20. The state govt. has the power to amend/ alter of any prevision of this service. The

department would enact the laws for the prevision of this rule.

21. Commencement and super session-

All orders / instruction relating to appointment/ promotion etc in for the Bihar

Information And Public Relations Editorial service rules, issued earlier shall

be supersede these policy of the Bihar Bihar Information Editor Cadre Service

Rules.

After super session all the worked any work done or under any circular /

orders issued earlier or work done under the rules/ orders relating to
