The 11^th November 2011

S.O. 395, dated the 15^th November 2011—Whereas the State Government is

satisfied that it is necessary to provide grant to the domicile migrant labourers of the State

in the event of their permanent and partial disability on account of an accident. To

achieve the said object, it is necessary to amend the Bihar State Migrant Labour Accident

Grants Scheme Rules 2008.

Now, therefore, in exercise of the powers conferred by Article 39 (a) of the

Constitution of India, the State Government of Bihar hereby amends the “Bihar State

Migrant Labour Accident Grants Scheme Rules, 2008” as follows:-

Bihar State Migrant Labour Accident Grants Scheme (Amendment) Rules, 2011

1. Short title, extent & commencement:—These rules may be called the Bihar

State Migrant Labour Accident Grants Scheme (Amendment) Rules, 2011.

(2) It shall extend to the whole of the State of Bihar.

(3) It shall come into force from 1^st April, 2011.

2. Definitions:—(1) The definition of “accident’ as given in sub-rule 1 (a) of Rule

2 of the “Bihar State Migrant Labour Accident Grants Scheme Rules, 2008” shall be

replaced by the following—

“(a) “Accident" means permanent total disability, permanent partial disability

or death due to accident caused by external violence which is apparent in

nature and shall include:

Train or road accident, electric shock, snake-bite, drowning, fire, falling from tree

or building, attack by wild animals, terrorist or criminal attack etc. However, this list is

illustrative and not exhaustive.

Provided that, it shall not include death, total or partial disability caused by self

inflicted injury or suicide or accident caused under inebriated condition or

total disability, partial disability or death caused while committing

criminal offences.

Provided further that, permanent total/partial disability and death occurring

within 180 days of the happening of the bodily injury resulting solely and

directly from the accident by external violence as above and independently

of any other cause shall be covered under this scheme.

This scheme shall also apply in cases of permanent total/partial disability or death

caused by atomic radiation and war.

(2) The following shall be inserted after sub-rule 1 (i) of Rule 2:

(j) “Permanent Partial Disability” means loss of one eye or one limb.

(k) “Permanent Total Disability” means loss of two eyes or two limbs or loss of

one eye and one limb.

3. The following Rule shall be inserted after Rule 5:

5A. (a) In case of permanent total disability of a migrant labourer, a grant of Rs.

75,000 (seventy five thousands) by way of crossed cheque/ demand draft shall be paid to

him.

(b) In case of permanent partial disability of a migrant labourer, a grant of Rs.

37,500 (thirty seven thousands five hundred) by way of crossed cheque/ demand draft

shall be paid to him.

4. In the sub-rule (a) of Rule 6, the word “Form -1” shall be replaced by the word

“Form-1 or Form -1A, as the case may be,” .

5. In the Rule 7, the word “Form -2”, shall be replaced by the word “Form 2 or

Form -2A, as the case may be”.

6. In the sub-rule (a) of Rule 8, the word “death” shall be replaced by the word

“death or permanent total disability or permanent partial disability, as the case may be”.

7. In the sub-rule (b) of Rule 9, the word “dependant(s)”, shall be replaced by the

word “claimant (s)”.

8. In the Rule 13, the word “his dependant(s)” shall be replaced by the word “he

or his dependant(s), as the case may be”.

9. Form -3 and Form- 4 in the Rule has been modified and appended below.
