No. 7/ME-401-70/2009-4579—In exercise of the powers conferred by the proviso to Article 309 of the

Constitution of India, the Governor of Bihar hereby makes the following Rules for recruitment and service

conditions of Clerks of Commercial Taxes Department –

1. Short title, extent and the date of commencement.— These Rules shall be called “The Bihar

Commercial Taxes Department Regional Clerical Service Condition Rules 2011”

(2) It shall extend to the whole of the State of Bihar

(3)This notification shall come into force with effect from the date of its issue.

2. Definitions.— In these Rules, unless otherwise requires in the context-

(a) “Appointed Day” means the date of commencement of these Rules;

(b) “Service” means the Bihar Commercial Taxes Clerical Grade Service;

(d) “Person appointed by direct Recruitment” means a person recruited to the post of Lower

Division Clerk on the basis of result of a competitive examination held by the competent

authority;

(e) “Appointing Authority” means the Commissioner and Principal Secretary /Secretary of the

Commercial Taxes Department;

(f)

‘Probationer” means a person recruited to the Lower Division Grade on probation.

(g) “common Seniority List” means the seniority list of employees of the service, as on the

appointed day and revised from time to time in accordance with the regulations to be framed in

this behalf by the State Government, such list shall be maintained by the Commercial Taxes

Department;

(h) ”Commission “means Karmchari Chayan Ayog, Bihar.

3. Constitution of cadre :- In this service there shall be three grades

(A)

Lower Division clerk

(B)

Upper Division clerk

(C)

Head Clerk

4. Cadre.— The cadre of this service shall be regional :-

5. The authorised strength of service.— The Authorized strength of the service shall be determined

from time to time by the Commercial Taxes Department in consultation with Finance Department according to

the necessity.

6. Reservation.— The provisions of reservation Act of the State Government shall apply in

recruitment / Promotion, in the service and the compliance of the resolutions/ Instructions roster issued

there under will be essential. All the rules of the reservation will be followed in recruitment to the post

of clerk and the concerned authorities will be responsible for it. The requisition for appointment will be sent to

the Commission after getting the roster clearance from the competent authority as per the reservation policy. If it is

found that the prescribed procedures for recruitment have not been followed correctly by the concerned

officer, then in that case the Commercial Taxes Commissioner cum Principal Secretary/Secretary, shall

order an enquiry by competent authority and if irregularity is proved , proper action will be initiated

against erring staff. If the concerned official has retired then action will also be taken according to rules.

7. Grades of post :-The grades of the clerical cadre shall be prescribed in the following manner.—

After the commencement of these Rules only the post of Lower Division Clerks shall be filled up

by direct recruitment and the post of Upper Division Clerk and Head Clerk shall be filled up by

promotion.

8. Minimum educational qualification for recruitment .—(1) The minimum educational

qualification for appointment to the post of Lower Division Clerk, shall be Matriculation or equivalent

and knowledge of Hindi, English, Computer typing shall be essential and for this, holders of Diploma in

Computer application will be eligible.

(2) Minimum age limitation: The minimum age limit for direct recruitment shall be 18 years and

the maximum age limit shall be the same which may be fixed by the State Government from time to

time.

9. Recruitment to the post of lower division clerk.—(1) Reservation Roster categories

wise requisition for vacancies on the basis of vacancies as on 1^st April each year shall be sent to the Bihar

Karmchari Chayan Ayog by 30^th April . The qualification of age shall be according to the age as on 1^st

August.

There will be no interview in process of the direct recruitment to the post of Lower Division

Clerk and the Commission shall prepare the merit list on the basis of marks obtained in the written

examination.

(2) Eighty-five percent (85%) of the authorized strength of the LDC grade shall be filled up by

direct recruitment on the basis of the result of competitive examination to be conducted by the Bihar

Karmchari Chayan Ayog.

Provided that, maximum five percent of the authorized post, to be filled up by direct recruitment

shall be filled up from amongst the dependents of the Government servants who died in harness, on

compassionate ground, in accordance with the prescribed procedures laid down by General

administration Department from time to time, on fulfilling all requisite qualifications for being appointed

to this grade. For which the recommendations of the Bihar Karmchari Chayan Ayog shall not be

required.

(3) Persons appointed and working as Clerks/ Lower Division clerks as well as the persons

appointed in the offices of the department on compassionate ground on the appointed day shall be

deemed to be automatically included in this grade.

Provided that such Clerks/ lower Division clerks who have been deemed to be automatically included in

the clerical cadre and whose age is less than 50 years on the appointed day, shall be required to obtain

competency in Computer Typing in the manner mentioned in rule 13 of these Rules, within two years

from the appointed day. In case of failure to obtain the Computer typing test within the period they will

not be allowed any annual increment.

(4) Remaining Fifteen percent (15%) posts of the authorized strength shall be filled up from

amongst the Class 4 employees working in regular field establishment of the Commercial Taxes

Department, and holding the requisite qualification, on the basis of limited competitive examination held

for this purpose by the Commission. Only those Class IV employees will be eligible to appear in the

limited competitive examination, who have completed at least 5 years of regular service.

(5) The following shall be the compulsory subjects in the examination conducted by the

Commission

Subject relating to Computer knowledge

100 marks

Besides this two optional subjects shall have to be selected from the following subjects.

Mathematics

Book Keeping

(6) Reserve category wise requisition will be sent to the Commission on the basis of information

obtained regarding vacancies from the Divisions of Commercial Taxes. The Commission shall prepare a

merit list on the basis of marks obtained in the written examination. The Commission shall recommend

names of only such numbers of candidates to the Department for which requisition have been made. In

case of non joining or increase in the number of vacancies, the candidates can be recommended from

that merit list for one year. The validity of the merit list shall be for one year from the receipt of the

merit list. The candidates whose names have been recommended by the Commission shall be

appointed by the Commercial Taxes Commissioner cum Principal Secretary/Secretary. The

Commissioner shall post the appointed clerks on the basis vacancy of posts, in different Divisions.

10. Posting/Transfer/Deputation.—(1)The employees of this cadre, shall be posted/ transferred/

deputed in the field subordinate offices to the Commercial Taxes Department. In the matters of

transfer, the directions issued by the Cabinet Secretariat Department, shall be deemed to be in force.

Provided that, Departmental secretary, on administrative ground or on representation shall be

competent to transfer any employee from one division to another.

Provided further that representation for transfer from one division to another on compassionate ground

shall be considered only after the employee has competed minimum of 10 year’s of service in that

division.

(2) In the matters of pension and provident fund, for employees recruited under the provisions

of these Rules, the provisions of Bihar state Government Employees Contributory Pension scheme 2005

(as amended from time to time) shall be in force.

(3) The prevailing directions/resolutions/Rules of the State government regarding service

conditions like disciplinary action, leave, retirement benefit etc, not specifically mentioned in these

Rules shall be apply for the purposes for this service.

11. Probation period.— Every direct recruitment to the post of Lower Division Clerk grade

whether direct recruited or recruited by limited competitive examination or on compassionate ground

shall initially be recruitment on probation. The probation period shall be for two years which may be

extended if required, by the appointing authority.

Provided the employees appointed as lower Division clerk before the appointed date shall be

deemed to have been appointed on probation with effect from the appointed date. In case of service

being unsatisfactory during the probation period, the service of the employee may be terminated.

12. Training.—During the period of probation the Lower Division Clerks shall have to participate

in such training necessarily which is prescribed by these rules. During the period of probation employees

have to participate in program in modern office practices conducted by institutions recommended by the

State Government.

13. Confirmation.— A person appointed to the post of Lower Division Clerk on probation, after

satisfactory completion of probation period as well on satisfactory completion of determined training and

after passing the requisite test for typing and Computer Competency and after passing Departmental

accounts examination may be confirmed by the appointing authority.

(2) Determination of test for typing and Computer competency and process of Accounts

Examination shall be made by the Board of Revenue.

(3) No increment will be admissible to employees appointed in Lower Division Clerks Grades,

without passing typing and Computer Competency test. The Department Examination will be conducted

for the test of the typing and computer competency in which minimum typing speed 30 words per minute.

(4) On being confirmed probation period will be counted for total service period.

(5) Passing of such persons, who have been automatically included in the lower division clerks

on appointed day and whose age is below fifty years in typing and computer competency test is not

necessary for further admissibility of increments.

(i) This test will be conducted by the Board of Revenue.

(ii) (A) One paper of 100 marks will be for knowledge of typing and computer test. Passing

marks for General & other categories will be 40 and for scheduled cast/ scheduled tribe candidates will

be 30.

(B) (i) Such lower division clerks will have to type 30 (thirty) words per minute in Hindi and 40

(forty) words per minute in English respectively on Computer and on Typewriter, which is 300 hundreds

words within 10 minutes and 400 hundreds words within 10 minutes, respectively. Error in typing must not

exceed more than 2 percent for Scheduled Cast/Scheduled tribe candidates and 1.5 percent for General

and other Categories. Otherwise they will be declared failed.

(6) Those Upper Division Clerks who are automatically included in this cadre, will have to pass

such examination as contained in sub Rule (5) (b) Increment of unpassed Lower Division Clerk will be

held up till they pass the such typing test.

(7) Such typing examination will be conducted by the Board of Revenue, Govt. of Bihar.

14. Determination of seniority in lower division clerk grade.—(1) Category wise seniority list

will be made.

(2) Inter-Se-Seniority will be maintained on the basis of the merit list recommended by the

Commission and on the basis of the order issued of General Admn. Department from time to time.

(3) Inter-Se-Seniority of the employees appointed on compassionate ground will be maintained

according to the date of their appointment.

(4) All employees who are appointed on the basis of recommendation of the Commission will

be senior to all employees appointed on compassionate ground in any year.

(5) Inter-Se-Seniority of the candidates appointed on the recommendation of the commission

will be according to the merit list.

15. Promotion.— (1) The clerks employees confirmed in the service on completion of the

prescribed “KALAWADHI” and after passing both papers of the departmental accounts examination shall

be promoted from the grade of Lower Division Clerk to the grade of Upper Division Clerk and thereafter

from the grade of Upper Division Clerk to the grade of Head Clerks according to the vacancy available

in those posts on the basis of seniority cum merit list and according to the Rules prescribed by the State

Government and the recommendation of the Departmental Promotion committee constituted for this

purpose.

(2) Promotion to the Upper Division Clerk grade and Head Clerk may be made on the

recommendation of Departmental promotion committee constituted for the purposes by the Department

of Commercial Taxes. Constitution of Departmental Promotion Committee may be made in view of the

resolution/instructions issued from time to time by the General Administration Department.

(3) The Departmental Promotion Committee will constitute of the following members:-

(a) Commissioner cum Principal secretary/secretary

Commercial Taxes Department

Chairman

(b) Additional Commissioner Commercial Taxes Department

Member

Scheduled caste/Scheduled tribe by the

General Administration Department

Member

(d) An officer of Finance Department

16. Common seniority list.— The common Seniority list of this Service will be prepared and

maintained by the Commercial Taxes Department on the basis of the principles and process determined in

these Rules and according to the instructions of the General Administrative Department issues from time

to time in the regard.

17. Interpretation.— Where doubt any arises with regard to interpretation of any provisions of

these Rules, the matter will be referred to the Commercial Taxes Department and the decision of the

department in this regard will be final.

18 Power to make regulations.— The Commercial Taxes Department will be competent to

constitute regulation if necessary for effective implementation of the provisions of these Rules

19. Repeal and savings.—All circulars/resolutions issued prior to the date of commencement of

these Rules shall be deemed to have been repealed. Notwithstanding anything contained in these Rules

any work done or any action taken under state Resolution/ Instruction/ Direction or rules before the

commencement of these Rules shall be deemed to have been done or taken as if all those State

resolutions/instruction or Rules were issued or made under these Rules.
