“Be as it may, in the aforesaid facts and circumstances, we direct the Cane

Commissioner to treat the order contained in annexure-I and published in Annexure-2

as valid for the time being till further orders of this court but the reserved area

determined by that order shall not stand in the way of the Cane Commissioner in

redeciding the claim of the writ petitioner with respect to the 15 villages which had

been earlier included in the reserved area of the writ petitioner. Further decision as per

direction of the writ court may be taken by the Cane Commissioner expeditiously

keeping in view the observations of the writ court and this interim order.

Since the cane crushing season has commenced, it is necessary that the Cane

Commissioner should pass the required order expeditiously and preferably within two

weeks from today. In order to avoid delay in the proceeding before the Cane

Commissioner both the parties are directed to appear before the Cane Commissioner

along with a copy of this order at the earliest and in any case within one week from

today.

It is made clear that since the remand has been made to the Cane Commissioner

on account of writ petition preferred by respondent no.3 and that also against the

appellant only, the Cane Commissioner is required to decide the dispute inter parties

and only if necessary he may reopen the matter with regard to other sugar producing

factories in the area.

It is also made clear that the order to be passed by the Cane Commissioner

insofar as it may relate to the parties to the dispute will be subject to result of this

appeal.”
