No. Fish/settlement-95/2006-1035—In terms of section 11(B) of Bihar Co-operative

Societies (Amendment Act) Act, 2010, after reorganization of Block level Fishermen Co-

operative Societies for managing the affairs of the re-organized society and all such

affiliating societies of which Fishermen Co-operative Society is a member, an ad-hoc

Managing Committee for a period not exceeding one year was constituted and also there

was a direction to constitute a legally elected Managing Committee by the State Election

Authority. However, due to unavoidable/unusual circumstances, the election formalities of

the same could not be held within stipulated time frame, which was beyond the control of

Bihar State Election Authority.

However, keeping in view the constitution of ad-hoc society during 2011-12, its

validity and legal complications emerging during the period, as a short term alternative

arrangement, circular no. 1598 dt. 31.08.2010; 1007 dt. 01.07.2011; 1151 dt. 27.07.2011

and 1375 dt. 02.09.2012 were issued under which the validity of the settlement of Jalkars

was limited up to 30th June 2012 (Fish Jalkar) and 30th Sept. 2012 (Makhana Jalkar).

In pursuance to ensuing settlement of Jalkars/Sairats to be made during the year

2012-13 under the provisions of Bihar Fish Jalkar Management Act, 2006 and also to

dispense with the likely impediments , a meeting under the chairmanship of Secretary,

Animal & Fish Resources Department was convened on dated 13.04.2012 in which

Secretary, Co-operative Deptt., Registrar, Co-operative Societies, Bihar, Patna, Officers of

the Fisheries and Co-operative Deptt. as well as officer bearers of the COFFED and

Federation also participated . During the discussion, it emerged that in the present context

the election formalities for election of Fisheries Co-Operative Societies have already been

initiated by the Bihar State Election Authority and the same is likely to be completed soon.

Furthermore , during the discussion, it also emerged that Hon'ble High Court vide

its orders dated 20.03.2012 (cwjc 4773/2012) and dated 30.03.2012(cwjc 20207/11) and in

similarly placed matters , has been pleased to upheld the settlement/agreement made with a

few ad-hoc socities for seven year during 2011-12, against which the Govt. has initiated

steps for filing an LPA before the Hon'ble High Court which is underway.

In view of the above facts and exercising the powers as conferred under section (19)

of the Bihar Fish Jalkar Management (Amendment Act 2007 & 2010) Act, 2006 , the State

Govt. is hereby issuing following directions/guidelines for the settlement of Jalkar Sairat

during 2012-13 which are as under:—

1. The settlement of Jalkars u/s-7 of the Bihar Fish Jalkar Management Act, 2006

shall be made with the legally constituted elected body of the Fishermen Co-

operative Societies (1935) within one month after receipt of the settlement claim

(i.e. not exceeding one month) ensuring the recovery of all Govt. dues amount.

2. In the event of issuance of delayed Parwana i.e., after 30th June 2012, an

affidavit shall be had before issuance of such delayed Parwana indicating

therein that the settlee is willing to pay the due revenue to the Govt. w.e.f form

01.07.2012 and the same will be clearly indicated in the Parwana to be issued.

3. Where the Reserve Jama Fixation of Jalkars has already been made during 2011-

12 u/s-4 of the Act, 2006 , after expiry of validity of the same during 2015-16,

the Reserve Jama Fixation of the Jalkars for the rest three settlement years shall

be made by enhancing five percent of the previous Reserve Jama of the Jalkars

in question and accordingly the same(enhanced Reserve Jama) shall be recovered

from the settlee/society during the period as per law.

4. The above directions/guidelines shall not be effective in case of settlement made

with the 38 ad-hoc societies during 2011-12.
