The 11th October 2012

No. 8P/Vi-4-105/2012/P.R./6132—In exercise of powers conferred by Section-146,

read with Sections-147, 148, 149 and 150 of the Bihar Panchayat Raj Act, 2006 (Bihar Act

6, 2006) the Governor of Bihar makes the following Rules :-

Bihar Panchayat (Procedure of making By-laws and Regulation) Rules, 2012

Short title, extent and commencement–(1) These Rules may be called Bihar

Panchayat (Procedure of making By-laws and Regulation) Rules, 2012.

(2)

It shall extend to the whole of the State of Bihar.

(3)

It shall come into force from the date of its publication in the official gazette.

Definitions - In these Rules, unless other wise required in the context —

(a)

“Act” means the Bihar Panchayat Raj Act, 2006 (Bihar Act 6, 2006);

(b)

All other words and terms used in these Rules but not defined shall have the

same meaning as have been assigned to them in the Act.

STANDARD BYE-LAWS/REGULATION TO BE MADE BY GOVERNMENT

Subject to the provisions of the Act and Rules made thereunder and to carry out the

purposes of the Act and Rules, the State Govt. may make separate Model Regulations

for the Panchayat Samitis and the District Boards and Model By-laws for the Gram

Panchayats constituted within the State. The respective Panchayat Samitis and the

District Boards may by their respective resolution adopt the Model Regulations, and

the Gram Panchayats may adopt the Model By-laws. Such Regulation/By-laws, as the

case may be, shall come into force within their respective areas with effect from the

date of publication of the notice after such adoption.

In case of any specific objections and suggestions on account of any special reasons,

the Gram Panchayats may before adoption of the model By-laws refer the same to the

concerned District Board for its approval and on receipt of such approval can adopt the

same by passing a resolution. Similarly the Panchayat Samiti/District Board, in case of

any specific objection and suggestion with respect to the Model Regulation may

before adoption refer it to the State Govt. for sanction and approval and on receipt of

such approval the same can be adopted by passing a resolution.

Before finalizing the draft of model standard By-laws/Regulation and its amendments

made by the government under rule 3, a notice, along with the draft of proposed model

By-laws/Regulation or its amendments, shall be caused to be published in the 'Bihar

Gazette' and sent to the Gram Panchayats, Panchayat Samiti and District Board, stating

the date on or after which that draft will be considered and that will be at least thirty

days after the date of its publication. The Gram Panchayat, Panchayat Samiti and

District Board may consider the draft of Model standard By-laws/Regulation and make

available to the government any objections and suggestions. The Gram Panchayat,

Panchayat Samiti and District Board shall also cause to display the said draft on their

notice boards. Any person, who will file any objection and gives his suggestion before

the date so mentioned will be made available to the government. Any person may also

forward objections and suggestions directly to the Secretary, Department of

Panchayati Raj before the date so mentioned. The draft will be finalized after the

disposal of the objections received.

After finalizing the draft of model standard By-laws and Regulation or its

amendments, the government shall cause it to be published in the "Bihar Gazette" and

send its copies to all the Gram Panchayats, Panchayat Samiti and District Board. The

Gram Panchayat, Panchayat Samiti and the District Board may adopt the model

standard By-laws or Regulation as the case may be, under rule 3, by passing a

resolution as such.

The model standard By-laws and Regulation made under rule-3 to 6 will come into

force within the jurisdiction of the Gram Panchayat, Panchayat Samiti or District

Board with effect from such date as may be specified by the Gram Panchayat,

Panchayat Samiti or District Board, as the case may be, in notice published.

BYE-LAWS TO BE MADE BY GRAM PANCHAYAT/REGULATION TO BE

MADE BY PANCHAYAT SAMITI/ZILA PARISHAD

Subject to the provisions of the Act and the Rules made thereunder, which relates to its

powers and duties, and in case of any specific reason or objection to the Model By-

laws or any part thereof having remained unresolved a Gram Panchayat may make or

amend it's By-laws with previous sanction of the concerned District Board. Similarly a

Panchayat Samiti/District Board may in case of any specific reason or objection to its

respective model regulation or any part thereof, having remained unresolved, make or

amend its regulation with previous sanction of the State Govt.

Before finalizing the By-laws/Regulation or its amendment made by the Gram

Panchayat/Panchayat Samiti and District Board under rule 8, as the case may be, it

shall cause to publish the proposed By-laws/Regulation or amendments in the 'District

Gazette' and display it on their respective notice board stating the date on or after

which the draft will be considered and that date shall be at least 30 days after the date

of such publication. Any claim or objection(s) in respect of the said draft before the

date so mentioned, will be considered by the Gram Panchayat, Panchayat Samiti or

District Board. If the draft of the regulation or its amendments has been prepared by

the Panchayat Samiti or District Board, then a copy of the draft will be displayed on

the notice boards of all the concerned Gram Panchayats/Panchayat Samitis. After the

disposal of the claims and objections received, the draft will be finalized.

10. After finalizing the draft of the By-laws or its amendments made by it under rule 9, the

Gram Panchayat will send a copy of the said draft to the District Board. The District

Board will consider the said draft in its meeting and grant sanction / approval with

necessary modifications if any and return it within one month from the receipt of the

said draft. Thereafter, the draft will be finally published in the District Gazette after the

approval by the Gram Panchayat and its copies shall be displayed on the notice boards

of the offices of the concerned Gram Panchayat, Panchayat Samiti and District Board.

11. After finalizing the draft regulation or its amendments made by the Panchayat Samiti /

District Board under rule 9, a copy of the said draft will be sent to the government.

The government will consider the said draft and after necessary modifications, if any,

may grant sanction and approval and return it within three months from the receipt of

the draft. Thereafter, the final draft will be published in the "District Gazette" and its

copies shall be displayed on the notice boards of the offices of the concerned Gram

Panchayat, Panchayat Samiti or District Board.

12. Any By-laws /Regulation or its amendment after final publication in the "District

Gazette" under rule 10 and 11 shall come into effect from date of such publication.

13. Miscellaneous :- The State government may clarify any provision of these Rules by a

notification/ instruction and remove the difficulties arising in its implementation.
