Bihar Environment and Forest Department field Stenographer Cadre Rules-2013.

No. Non-Gazatted/Estb.(Seva.Rule)-94/2007-2942/E&F.—In exercise of the

powers conferred by proviso to Article 309 of the Constitution of India, the Governor of

Bihar is pleased to make the following Rules to regulate the recruitment, Promotion and

other service conditions of the Stenographer/Steno Typist working in the field

establishment of Environment and Forest Department.

CHAPTER-I

Short Title, Extent and Commencement.-

(a)

These "Rules" may be called Bihar Environment and Forest Department

field Stenographer Cadre Rules-2013.

(b)

It shall extend to whole of the State of Bihar.

(c)

It shall come into force with immediate effect.

Definition.-

In these rules, unless the otherwise required in the context-

(a)

"Department" means the Department of Environment and Forest;

(b)

"Cadre" means the cadre of Stenographer/Steno Typist working in the field

offices of Department of Environment and Forest, which shall also include

the personnels appointed under these rules;

(c)

"Appointing Authority" means the Chief Conservator of Forest,

Administration and Human Recourse Development, Bihar;

(d)

"Commission" means the Bihar Staff Selection Commission;

(e)

"Field establishment" means all establishments of the department, which

are not offices attached to Secretariat.

Constitution of the Cadre-

Employee appointed and working at present on the post of Stenographer/Steno

Typists in the field offices of the Department shall be deemed to be automatically included

in this cadre alongwith those to be appointed under these rules.

(b)

The Cadre shall be state level and shall be under the administrative control

of the Principal Chief Conservator of Forest, Bihar.

(c)

Appraisement of number of Stenographer of different categories shall be on

the basis of their sanctioned strength by the State Government.

(d)

The grades of Stenographer cadre shall be prescribed in the following

manner :-

Stenographer/Steno Typist Grade III

Basic Grade

Stenographer/Steno Typist Grade II 1^st promotion

Stenographer/Steno Typist Grade I 2^nd promotion

The pay Scale of above posts will be same as determined by Government (Finance

Department) from time to time for these posts.

Procedure of Recruitment-

(a)

The minimum educational qualification for appointment to the post of

Stenographer Grade III shall be matriculation, besides, competency in

stenography and typing as well as competency in computer typing.

(b)

The minimum age shall be 18 years and the maximum age shall be such as

may be determined by the State Government (General administration

Department) from time to time.

(c)

The category wise requisition shall be sent to the commission by the

Appointing authority every year on the basis of actual vacancies.

(d)

The commission shall prepare a merit list of candidates obtaining minimum

qualifying marks on the basis of written competitive examination and practical

skill test and send its recommendation to the appointing authority. The syllabus for

written competitive Examination and minimum qualifying marks shall be

determined by the commission. The qualifying speed for short hand test shall be 80

words per minute and for typing and computer competency, it shall be 30 words

per minute on typewriter and 8000 key depressions per hour in computer typing.

For being successful, there must not be more than 10% errors in the short hand test

and 1.5% errors in typing.

Probation Period.-

The appointment shall be made on probation which shall be for two years. In case

the service, evaluated on the basis of performance of work and conduct of the

employee, appointed on probation is not found satisfactory, the probation period

may be extended by one year. If the service evaluated on the basis of performance

of work and conduct of the employee, appointed on probation is not found

satisfactory even during the extended period, he/she shall be discharged form

service.

Training.-

During the probation period, the staff appointed shall be required to

participate in the training program of modern office practice in the Administrative

Training Institute or any other Institute recognized by the State Government.

Departmental Examination and Confirmation-

(i)

The departmental examination shall be conducted each year by the Central

Examination Committee, Board of Revenue.

(ii)

The departmental examination shall be to test competency in short hand,

typing and computer in which qualifying speed for short hand typing and computer

shall be 80 and 30 words per minutes and 8000 key depressions per hours,

respectively. In case of failure in the departmental examination further increment

after the First increment shall be withheld till passing the departmental

examination.

(iii)

The staff may be confirmed in the cadre after successful completion of

probation period and training and passing the departmental examination.

Promotion .-

(1)

Promotion of the Stenographer confirmed in the cadre shall be from Grade

III to Grade-II and from Grade-II to Grade I on the basis of Merit-Cum-Seniority

on the recommendation of Departmental Promotion Committee. The Departmental

Promotion committee will be constituted as under-

and human Resource Development, Bihar-

(3)

Joint Secretary/Deputy Secretary

Environment and Forest Department-

(4)

(ii)

On completion of duration (kalawadhi) determined by the General

Administration Department, Bihar, Patna from time to time promotion will be

considered from one grade to another.

Reservation.-

The provisions of the Bihar Reservation of vacancies in posts and services (for

Scheduled Caste, Scheduled Tribe and other Backward Class) Act, 1991 and the

Rules and roster there under as prescribed by the State Government from time to

time shall be applicable for making appointment to and for granting promotions.

10.

Posting. -

(i)

Stenographer/Steno Typists appointed shall be posted in the field offices

under the control of Principal Chief Conservator of Forest.

(ii)

Chief Conservator of Forests, Administration and Human Resource

Development, may transfer the Stenographer/Steno Typists in field offices under

the control of Principal Chief Conservator of Forest.

11.

If provision cannot be made for any matter in these Rules, the provisions of

relevant service code/Rules/Resolutions/Circulars being in force shall be

applicable in that matter.

12.

Government (Environment and Forest Department) may issue such general/special

orders which are essential to rectify the difficulties encountered in implementation

of any provision of these Rules.

13.

Repeal :- (1) All Rules and orders relating to Forest Guards and Foresters in force

immediately before coming in force of this Rule shall, to the extent they are

repugnant to these Rules, stand repealed from the date of coming in force of the

these Rules:

Provided that any action taken before coming into force of these Rules,

under such repealed Rules and orders, shall be deemed to have been taken under

these Rules as if these Rules were in force at the time of taking such action.

(2) Notwithstanding such repeal as under sub rule (1) and to the extent they

are not repugnant to these rules, any right accrued or deemed to have been accrued

there under or any liability or obligation incurred there under shall not be affected.
