section 38 of the Bihar Excise Act 1915, the Board of revenue is please to direct that

Distributors license For the Sale of Bottle in Origin (FMFL/FMFW) to the BSBCL of sale

to Trade Licence in Excise Form and Pass for importing into Bihar FL/FW manufactured

outside India shall be imported in Bottle in Forms 19E and import permit Forms (52D)

contained in appendix ‘A’ and ‘B’ respectively annexed to this Notification.

APPENDIX ‘A’

Form No. 19E (Rule 6)

Distributor license for the sale of imported bottle in origin (Foreign Liquor) and

bottle in origin Wine for supplying to the BSBCL

be it known to all concerned that the sanction of Excise Commissioner, Servshri--------

---------------------------------- resident of ----------------------------- is hereby authorized by the

countersigned Collector for the sale of FMFL and FMFW to the Bihar State Beverages

Corporation from-------------------------- to ------------------------ under the following

conditions :-

1. That is required to the holder of this license as a condition of its remaining import

that he shall import FMFL and FMFW from authorized custom bond and keep the

same in the license premises approved by the Collector of the concern district for its

sale to the BSBCL, save and except the provision of Sea customs Act., Indian Tariff

Act, he shall abide by the provisions of Bihar Excise Act.

2. That he shall abide by all general or special order which may be issued by the Excise

Commissioner from time to time.

3. That he shall pay in advance Rs 3.00 (Rupees Three) per bottle for FMFL and Rs.

2.00 (Rupees Two) per bottle for FMFW to the Government of Bihar for licensing

year or a pert thereof.

4. That he shall comply with all the rules relating to import and transport of FMFL and

FMFW in respect of Indian Custom Act and Indian Tariff Act.

5. That he shall not sell FMFL and FMFW to the public nor shall he permit

consumption of such liquor/wine in his license premises.

6. That he shall not obtain FMFL and FMFW without a permit as prescribed rules for

the import and transport in this behalf.

7. No FMFL and FMFW shall be imported in the State unless the state permit fee at the

rate fixed/prescribed by the Board of revenue is prepaid by the importer of the holder

of Distributorship license.

8. That he shall maintain correct accounts of all FMFL & FMFW received in and

issued from the licensed premises.

9. No brand of FMFL and FMFW shall be imported and sold in the State of Bihar

unless its label is approved as registered by the Excise Commissioner.

10. Each bottle of FMFL and FMFW shall be pasted by the license with a separate

adhesive sticker in which Statutory warning “Drinking Liquor is injurious to

health” in red ink and its MRP shall be printed.

11. No changed in pack size and strength of FMFL and FMFW shall be allowed at any

sale point.

12. That the Government of Bihar shall not be responsible for the destruction, loss or

damage by fire, theft or any other cause whatsoever to the FMFL and FMFW stored

in the licensed premises.

13. That he shall not issue FMFL and FMFW except on a permit issued by the Collector

of the district into which the FMFL and FMFW is intended to be transported.

14. That he shall not issue FMFL and FMFW except in the presence of the officer-in-

charge of the licenced premises and except under a pass issued by such officer-in-

charge.

15. In-fraction of any of the above conditions or the general conditions applicable to

Excise Vend Licences will subject the holder of this licence to forfeiture of the

licences and to all or any of the penalties prescribed by law or rules.
