No. U.Ni-12/2012/296/Ra—In exercise of the powers conferred by the proviso to

Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the

following Rules, 2013 for regulating the recruitment, promotion and service conditions in

the services of the Official Language (Urdu) Cadre for successful practical implementation,

development, extension and publicity of Second Official Language Urdu at state level: -

Chapter - 1

Preliminary

Short title, extent and commencement. -(1) These rules may be called the

"Bihar Second Official Language (Urdu) Cadre Rules, 2013."

(2) It shall extend to whole of the State of Bihar.

(3) It shall come into force from the date of issue of the notification.

Definitions: - Unless anything repugnant to the matter/subject or context in these

rules:

(i)

"Governor" means the Governor of Bihar.

(ii)

"State Government" means the State Government of Bihar.

(iii)

"Appointing Authority" means the Principal Secretary with reference to non-

gazetted posts and the Governor of Bihar with reference to gazetted posts.

(iv)

"Controlling Authority" means the Director (Urdu), Cabinet Secretariat

Department (Urdu Directorate), Bihar.

(v)

"Department" means the Cabinet Secretariat Department.

(vi)

"Commission" means Bihar Public Service Commission/Bihar Staff Selection

Commission as the case may be.

(vii)

"Urdu Language Cell" means the Urdu Language Cell constituted and Organised

in the headquarter of the offices of Collectorate/Sub Division/Block.

(viii)

"Secretary" means the Principal Secretary/Secretary, Cabinet Secretariat

(Rajbhasha) Department.

(ix)

"Head of the Department" means the Principle Secretary/Secretary, Cabinet

Secretariat Department.

(x)

"District Officer" means the District Magistrate.

(xi)

"Director (Urdu)" means the Director (Urdu) posted at Urdu Directorate

(Headquarter).

(xii)

"Rajbhasha Officer (Urdu)" means a Rajbhasha Officer (Urdu) posted at Urdu

Directorate (Headquarter).

(xiii)

"Rajbhasha Assistant (Urdu)" means a Rajbhasha Assistant (Urdu) posted at

Urdu Directorate (Headquarter).

(xiv)

"Urdu Translator" means a Urdu Translator appointed under the Second Official

Language Urdu Programme and posted in the office of Collectorate/Sub

Division/Block.

(xv)

"Assistant Urdu Translator" means a Assistant Urdu Translator appointed under

the Second Official Language Urdu Programme and posted in the office of

Collectorate/Sub Division/Block.

(xvi)

"Urdu/Hindi Lower Division clerk/Upper Division Clerk" means a Urdu/Hindi

Lower Division Clerk appointed under the Second Official Language Urdu

Programme and posted in the office of Collectorate/Sub Division/Block.

(xvii)

"Urdu Service" means the services approved by the State Government under

Second Official Language Urdu programme, and

(xviii) "Member" means a member of the Bihar Second Official Language (Urdu)

Service.

Constitution of Service/Cadre.—There shall be posts of following categories in

the Bihar Second Official Language (Urdu)

"The number of said posts shall be determined by the Government (Cabinet

Secretariat Department, Urdu Directorate) from time to time".

Employees appointed and working on above posts prior to the enforcement of these

rules shall deemed to be governed by these rules keeping their inter-se seniority intact.

Chapter - 2

Source of Direct Recruitment.—Except as otherwise provided, the recruitment in

this service may be made as follows: -

(a) By direct recruitment as per chapter-3 of these rules,

(b) By promotion as per chapter-4 of these rules.

Reservation

Vacancies.—The

rules

regarding

reservation/act

for

appointment/promotion determined by the State Government from time to time

must be Complied with.

Requisition may be sent to the concerned commission by the appointing authority

after calculating the vacancies to be filled through direct recruitment on 1^st April of

every year.

Chapter - 3

Procedure and qualification for direct recruitment.—

(i) The direct appointment to the post of Rajbhasha Officer (Urdu) shall be made on

the recommendation of Bihar Public Service Commission on the basic of

departmental requisition.

(ii) The direct appointment to the post of Rajbhasha Assistant (Urdu) shall be made on

the recommendation of Bihar Staff Selection Commission on the basis of

departmental requisition.

(iii) The direct appointment to the post of Urdu Translator, Assistant Urdu Translator

and Lower Division Clerk shall be made on the recommendation of Bihar Staff

Selection Commission on the basis of departmental requisition.

(iv) The essential qualification for Rajbhasha Officer shall be B.A. (Urdu Honours) or

M.A. (Urdu) or equivalent.

(v) The essential qualification for the post of Rajbhasha Assistant (Urdu) shall be B.A.

degree with Urdu Subject or equivalent.

(vi) The essential qualification for the post of Urdu Translator shall be B.A. degree with

Principal Urdu as well as good knowledge of Hindi or equivalent.

(vii) The essential qualification for the post of Assistant Urdu Translator shall be I.A.

Pass with Principal Urdu as well as good knowledge of Hindi.

(viii) It is essential to pass intermediate examination or equivalent and having speed of 40

words per minute in Computer Composing for the post of Lower Division Clerk.

After getting requisition of vacancy, applications shall be called by the Commission

by publishing formal advertisement and recommendation for appointment be made

by selecting eligible candidates. In view of the fixed departmental criteria the

selection procedure shall be determined by the Commission.

Recommendation of Candidates by Concerned Commission.—After getting

recommendation from the Commission the eligible candidates shall be appointed by

the Appointing Authority. The validity of the recommendation shall be for one year.

10.

Departmental Examination, Courses and Confirmation.—

(i) The persons appointed/promoted on different posts shall have to pass the Hindi

Noting and Drafting Examination Conducted by the Cabinet Secretariat (Rajbhasha)

Department for increment as per rule.

(ii) The service of the employee may be confirmed after completing three years of

service from the date of joining, after getting satisfactory report regarding

confidential remarks/work progress report and successfully passing the Hindi

Noting and Drafting Examination.

Chapter - 4

11.

Appointment by promotion.—

(i) 50% posts of Urdu Translator shall be filled by direct recruitment and remaining

50% posts shall be filled by promotion from the posts of Assistant Urdu Translator.

(ii) The promotion from Lower Division Clerk to Upper Division Clerk shall be on the

basis of seniority-cum-merit..

12.

Seniority.—

(i) The inter-se seniority of employees appointed by direct recruitment shall be

determined by the Appointing Authority on the basis of merit list rank prepared by

the Commission.

(ii) The inter-se seniority of employees appointed on any post in any year by direct

recruitment and promotion shall be determined in view of the instructions issued

from time to time by the General Administration Department.

Chapter - 5

13.

Criteria for Promotion.—

(i) The criteria of promotion under the service shall be the principle of "Seniority-cum-

Merit".

(ii) Kalavadhi - The kalavadhi (qualifying period) for promotion on different posts of the

cadre from lower post to higher post shall be the same as determined by the

Government (General Administration Department) from time to time.

14.

Selection procedure.—

The promotion shall be taken into account on the recommendation of Departmental

Promotion Committee constituted for the purpose of selection for promotion.

(a) Procedure of appointment.—

For considering promotion, the service of candidate must be satisfactory, without

any charge and confirmed.

Chapter - 6

15.

Residual Matters:—Administrative control of Administrative Department over the

members of the service.

(a) The Cabinet Secretariat (Rajbhasha/Urdu Directorate) Department shall keep

administrative control over the members of the cadre.

(b) The members belonging to Urdu Translator/Assistant Urdu Translator and

Urdu/Hindi Lower Division Clerk/Upper Division Clerk Category shall be under

control of District Officer/Sub Divisional Officer and Block Development Officer

of such district in whose district/sub division and block they will be posted.

Chapter - 7

16.

Other matters.—

Other service conditions namely, disciplinary action, leave etc for this cadre which

are not covered by these rules and not notified separately for this cadre shall be

governed by the rules applicable for the time being for employees/officers of the

State Government.

17.

Miscellaneous.—

The State Government may explain any provision of these rules by

notification/instruction and remove difficulties arising from its enforcement.
