MEMORANDOM OF ASSOCIATION

The State Government of Bihar for the promotion and protection of the activities of Visual Arts, a

State level autonomous and fully funded Bihar Lalit Kala Academy and his regulate and constitute at to

develop nurture and coordinate the activities of visual Arts make the following hereby pleased to with

immediate effects ;

The State Government will establish a State Academy called Bihar Lalit Kala Academy.

Area of works – The area of work will be whole State of Bihar.

OFFICE :- The mean office of Bihar Lalit Kala Academy will be located at Patna.

The aims and objects of the Academy will be ;

(a)

The Academy shall be a registered body. It shall have a perpetual seal and may sue and

be sued in its registered name.

(b) It shall have the following power and function ;

(i)

To encourage and promote study and research in the field of Panting, Sculpting,

Printmaking, Local art, Photography, Vediography, art of critical comments etc.

(ii)

To evaluate the working of voluntary organizations engaged in cultural activities

in the field of visual art and to coordinate and provide assistance for their growth

and development.

(iii)

To encourage the exchange of ideas between various Art schools/Art Institutions

and to promote enrichment of techniques by organizing conferences, lectures

demonstration, festivals, exhibitions, camps and workshops.

(iv)

To encourage artists and organizations to achieve artistic excellence by

organizing competitions/events/nominations for giving awards, fellowship,

scholarships and conferring titles.

(v)

To interact with similar bodies, as there may be and other institutions and

associations for the furtherance of its objects and for enrichment of Indian culture

as whole.

(vi)

To encourage the establishment of the centres for different performing arts such

as drama, music, dance and others) to ensure co-ordination among such centres.

(vii)

To encourage artists for development of dramatic and folk art activities in the

that as well as out that the state at different important centres.

(viii)

To accord recognition to artists for outstanding achievement in the field of visual

art.

(ix)

To encourage the setting up of institution to provide training and research in

different fields of visual art.

(x)

To publish and to promote publication of literature, bulletins, magazines,

journals, etc. on visual art.

(xi)

To award scholarship and prizes to deserving artists in the field of visual art.

To encourage the study, research, survey and development of folk traditional

and tribal arts and crafts.

(xiii)

To identity the dying visual arts and lesser known crafts and the provide

opportunity to promote and develop then of the people about their cultural

heritage.

To raise funds and to accept grants of money contributions, securities,

endowments of property of any kind for attainment of the objectives of the

academy.

(xv)

To make rules, regulations and Bye-laws for the conduct of the affairs of the

Academy and to amend or rescind them with the prior approval of the State Govt.

(xvi)

To do all such other acts and things as may be necessary for the furtherance of

the objectives of the academy.

(xvii)

In particular and without prejudice to the generality of the foregoing power such

Rules of Executive Business may be provided for all or any of the following

matters, namely:-

5. The Business of the Academy shall be carried on in accordance with the provisions of the

rules framed by the Academy with approval of the State Govt.

6. The General Council may with the approval of the State Govt. make rules consistent with its

Memorandum of Association for the purpose of giving effect to the provisions thereof.

7. In particular and without prejudice to the generally of the fore foregoing power such rules of

Executive Business may be provided for all of any of the following matters, namely ;

(a) Service Rule, Retirement Benefits, Leave and other related Rules for the employees of

the Academy.

(b) The powers and functions of authorities and officer other than those mentioned in the

Memorandum of Association.

(c) Formation of sub-committees such as-Programme Committee, Documentation and

Publication, Research and Finance Sub-Committee and other relevant Sub- Committees.

(d) The Institution of Fellowship, Medals and Prizes.

(e) To condition of award of the fellowship, scholarships, exhibitions, research, medals and

prizes.

(f)

The classifications, the method of appointment and the determination of the terms and

conditions of service of staff of the Academy.

(g) The in-service and the retirement benefits of the officers and the staff.

(h) The allowances to be paid in terms of honorarium and other facilities such as housing,

conveyance etc to the Chairman, Vice-Chairman, Secretary and the Members of the

General Council.

(i)

The authentication and authorization of the orders and decisions of the General Council.

(j)

Planning and execution of programme to attain the objectives of the Academy.

(k) The condition and mode of appointment and duties of those imparting training in

different programmes of performing art and also of the invited judges/ jury members for

State and National level performance and competitions and for any other competitions

and programmes.

(l)

The maintenance of discipline among the staff and those associated with the Academy's

day to day activities.

(m) Any other matter, which may be necessary for achieving the aim and object of the

Academy.

(n) After dissolution of the Academy all the assets remains after the payments of orders and

debts will not be distributed and paid among members. The State Government will take

decision in this regard.

Bihar Lalit Kala Academy Rules 2013

(Under Society Registration act, 1860)

1. These Rules shall be called ''The Bihar Lalit Kala Academy Rules- 2013'' Which will

be effective from the date of Registration under society Registration Act, 1860.

2. DEFINITIONS- In the interpretations of these Bye-laws, the following expression shall have

the following meaning unless in consistent with subject or context:-

(i)

"Academy" means the Bihar Lalit Kala Academy.

(ii)

"General Council" means the General Council of the Academy.

(iii)

"Executive Committee" means the Executive Committee of the Academy.

(iv)

"Chairman" means Chairman of the Academy.

(v)

"Member Secretary" means Secretary of the Academy.

(vi)

Words used in singular number shall include the plural numbers and vice-versa and

words used in masculine gender shall include feminine gender and vice-versa.

(vii)

"Central Government" means the Government of India.

(viii)

"Bihar Government" Means the Government of Bihar.

(ix)

"Artist" means any artist engaged in any performing art field.

(x)

''Object'' mean object of the Academy.

3. OFFICE .— The office of Bihar Lalit Kala Academy will be located at Patna town.

4. The Area of work will be the whole state of Bihar.

6. AUTHORITIES OF THE ACADEMY:-The following shall be the authorities of the

(vi) Any other body or committee which may be constituted by the General Council or

Executive Committee for any specific purpose.

7. CONSTITUTION OF THE GENERAL COUNCIL AND ITS POWERS AND

FUNCTIONS :-

7.1 The General Council shall be constituted in the following manner:

(i)

Chairman

(ii)

Vice- Chairman

(iii) Member Secretary

(iv) Member Ex- Officio (nominated)

(v)

Member Nominated

7.2 THE CHAIRMAN:-

The Chairman of the Academy will be an artist person in the field of

visual/performing art and shall be nominated by the State Govt. for a maximum period

of three years. The nomination will be at the pleasure of the State Govt. By virtue of

his office, the Chairman shall also be the head of the Academy and the Chairman of

the General Council and Executive Committee and shall when present preside over the

meetings of the General Council and Executive Committee. Service conditions will be

decided by the State Govt.

Provided that the chairman shall not vote in the first instance but shall have a

casting vote in the event of an equality of votes.

The Chairman shall have power to issue directions to any officer authority of the

Academy for the furtherance of its aims and objects and it shall be the duty of such

officer or authority to comply with such directions.

Tenure of the Chairman shall be at the pleasure of the State Government or maximum

for a period of three years.

He can request to the State Government to free him from the post of Chairman due to

any personal or other reason.

Nobody can be Chairman for more than two consecutive tenures.

The State Government can appoint Adhoc Chairman till the appointment of a regular

Chairman.

Under special circumstances in the absence of General Council the Chairman shall

have power to take decision on held programmes, which compulsorily should be

approved in the next meeting of the General Council.

7.3

VICE- CHAIRMAN:-

The State Govt. can nominate maximum two eminent persons from visual art as Vice-

chairman.

Tenure of the office of the Vice-chairman shall be at the pleasure of the State Govt.

He can request to the State Govt. to free him from the post of Vice-Chairman due to

personal or any other reason.

In the event of Chairman's absence the person nominated by Chairman/General

Council shall preside over meeting of the General Council and in such event shall

exercise the powers and perform all the functions of the Chairman.

7.4

MEMBER SECRETARY:-

1. Secretary of the Academy Secretariat shall be the Member Secretary of the General

Council.

2. The approval of the Chairman the Member Secretary shall take action to call the

meeting of the General Council.

3. The Member Secretary will prepare the Agenda, etc. and present the same record in

the meeting.

Visual art critic/ art historian

7.7 POWER AND FUNCTION OF THE GENERAL COUNCIL.—The General Council

shall have the following functions and powers:-

(i)

To draw up plans and programmers for the furtherance of the aims and objectives of

the Academy.

(ii) To consider and approve the annual budget of the Academy drawn up by the

Executive Committee.

(iii) To consider and approve programmes and specific projects proposed by the

Executive Committee.

(iv) To frame its Regulations, Bye-laws and Rules of procedure.

(v) To prescribe rules of procedure of the Executive Committee and Finance and

Administrative Committee.

(vi) To grant recognition of the recommendation of the Executive Committee to

organizations and institutions rendering useful service to performing art.

(vii) To select, on the recommendation of the Executive Committee, Eminent Artist or

Eminent Art Critics, Eminent Art Historians or those who have rendered outstanding

service to the cause of art as fellows of the Academy.

NOTE :- "Artist" means artist engaging in works of visual art of any kind.

"Artist" means an artist whose eminence has been widely recognized at the national

level, who has participated in the National or International programme an artist who has enjoyed

as dedicated career in his chosen field of art for at least 10 (Ten) years. Eminent Art Critic or

Art Historian means an art critic or art historian who has published in reputed art journals and has

published books on art on a regular basis for at least 10 years.

Subject to the provision of the Memorandum of Association and the Rules, to do

any or all such acts as may be necessary for the furtherance of the aims and objectives of the

Academy.

(viii)

To nominate in its first meeting, from amongst its members the nominated members

of the Executive Committee, Finance and Administrative Committee, Programme

Committee and other committees as it deems fit for proper functioning of the

Academy.

(ix)

All properties movable, immovable or of any other kind shall stand vested in the

General Council.

(x)

To issue appeals and applications for money and funds in furtherance of the said

objects of the society and to accept both from Government and Non-Governmental

agencies, Indian and Foreign grants, Gifts, Donations, Benefaction, Bequests, funds

in trust, subscription of cash and securities and any property movable or immovable

to utilize for the purpose of the society.

(xi)

To construct, maintain, alter, extend, improve, develop or repair any immovable

property belonging to or held by the Academy.

(xii)

To grant scholarship and stipends in furtherance of the said object.

(xiii)

To raise funds for the academy from gifts, donations or otherwise.

In the discharge of its functions, the General Council shall be guided by the cultural

policy of the State Govt.,

(xviii) To appoint auditors for auditing the Accounts of the Academy.

(xix)

To give scholarships and grant to artists, critics and art historians for research works.

(xx)

To form and run Artists Assistance Fund.

(xxi)

Article, Publication, Art Work, Library and Archives of the Academy.

(xxii)

Marketing of the publications of the Academy.

(xxiii) Admission in the facilities related to the studio of the Academy.

7.8 MEETING OF THE GENERAL COUNCIL :-

(i)

The General Council shall normally meet twice in a year on date and time fixed at the

previous meeting of the General Council or at any office time. The Chairman or

Executive Committee may call extraordinary meeting of the Council on its own

initiative or at the written request of not less than one-third of the total number of

members of the Council.

(ii)

Two week prior notice shall be given to members for a general meeting of the

General Council and for extraordinary meeting the members shall be given at least

one week's prior notice.

(iii) Presence of one third (1/3) of the total number of members of the council shall

constitute quorum for the meeting of the council. However no quorum will be

required for an adjourned meeting.

(iv) Every meeting of the council shall be presided over by the Chairman or in his

absence by the Vice- Chairman. When both of them are absent the members will

select one of the members from amongst themselves to preside that meeting.

8.2. Powers and Functions of the Executive Committee:-The Executive Committee

shall have the following powers and functions, namely:-

(i)

To exercise the executive authority of the academy subject to policy

directives of the General Council.

(ii)

To be responsible for the supervisions and control of the work of the

Academy.

(iii)

To consider and recommend programmes of the Academy and special

projects for the consideration of the General Council.

(iv)

To draw up one annual budget of the Academy subject to the financial limits

prescribed and obtain approval of the General Council and the State Govt.

(v)

In the absence of the meeting of the Committee, the Chairman shall take

decision regarding needful next Committee of will get administrative

approval.

8.3. Meetings of the Executive Committee:-

(a) The Executive Committee shall ordinarily meet once after every three

months. Extraordinary meetings of the Committee may be called by the

Chairman on his own initiative or on a request in writing given by not less

than half of the total number of members of the Committee.

(b) Presence of half of the total number of members of the Executive Committee

shall constitute a quorum at any meeting of the Committee. However no

quorum will be required for an adjourned meeting

in his absence by the person nominate by the chairman of chosen by

members present in the meeting.

9. CONSTITUTION OF THE FINANCE & ADMINISTRATIVE COMMITTEE :-

9.1. The Finance & Administrative Committee shall be constituted consisting of the

a. One representative of Art, Culture & Youth department of the State Govt-

Chairman

b. One representative of Finance Department of the State Govt. - Member

c. One representative of the General Council elected by the members of the

Council form amongst its own members- member

d. One representative of the Executive Committee elected by the members of the

Committee from amongst its own members- Member

e. The Secretary of Academy- Member Secretary

9.2. Powers and Functions of the Finance and Administrative Committee.—The

Finance and Administrative Committee shall have the following powers and functions:-

(i)

Advise the Academy on any matters affecting its finance.

(ii)

Prepare the annual estimates of income and expenditure of the Academy

(iii)

To scrutinize every item of a new expenditure not provided in the budget

estimates of the Academy.

(iv)

Be responsible for observance of rules relating to maintenance of accounts,

income and expenditure of the Academy, and

(v)

Discharge such other function of financial nature as may from time to time be

prescribed by the rules or entrusted to it by the General Council or the Executive

Committee.

10. CONSTITUTION OF THE PROGRAMME COMMITTEE :-

10.1 The programme shall be constituted consisting of maximum of 05 (five) members

nominated by the General Council from amongst its members. It will be chaired by vice

chairman, nominated by the chairman.

10.2 The Programme Committee shall have powers & functions namely :-

(i)

To prepare the detailed calendar for the whole year of activities, programmes

and events of the Academy.

(ii) To study programme proposals sent to the Academy by different

organizations and approve or disapprove thereof.

(iii) To prepare a budget estimate for each programme.

11. ACADEMIC SECRETARIAT AND SECRETARY:-

11.1 General Council Cell shall constitute a secretariat of Bihar Sangeet Natak

Academy consisting of following officers:-

Programme Officer (Folk art)

(d)

Programme Officer (Contemporary Art)

(e)

Programme Officer (Exhibition)

They will be appointed by the Competent Authority under Service byelaws of the Academy and

appointments will be vetted by the Govt.

11.2 THE SECRETARY: -

The Secretary shall be appointed by the State Govt. He may be appointed by

direct recruitment/ departmental promotion or on deputation/ transfer from any

government department or public undertaking for three years.

The Secretary will be person of recognized ability and experience in the field of

art, culture or administration.

The Secretary shall be a full term executive officer of the Academy and in this

capacity he will make sure timely execution of all programmes decided by the

Academy. The Secretary shall be the member secretary of the General Council

and the Executive Committee, Finance Committee and all other committee which

may be constituted by the Academy.

The Secretary including other things will perform following functions:-

To be the custodian of the records and such other property of the

Academy as the Executive Committee may commit to his charge.

To conduct the official correspondence on behalf of the authorities of the

academy

To issue all notices for convening meeting of the authorities of the

Academy and of all committees appointed by the authorities.

To keep the minutes of the meetings of the authorities of the academy

and of all committees appointed by authorities.

To maintain accounts of the Academy

Subject to the control of the Executive Committee, he will manage the

property and investments of the Academy and will be responsible for the

preparation of the annual estimates and statements of accounts and for

their presentation to the Executive Committee and the General Council.

Subject to the power of the Executive Committee, he will be responsible

for seeing that all moneys are spent for the purposes for which they are

granted or allotted.

To sign all contracts and assurance of property made on behalf of the

academy as to the same have been approved by the Executive

Committee.

To exercise such other powers as may be assigned to him by the

Executive Committee or the General Council.

The receipt given by the Secretary for any moneys paid into the accounts

of Academy shall be sufficient discharge for the same.

11.3 FUNCTION AND POWER OF THE ACADEMY SECRETARIAT:-

(i)

Academy Secretariat shall consist of Secretary, other officers and staff.

(ii)

The said Secretariat shall be responsible for the management of day-to-day

activities of the Academy. The Academy will manage the execution of its work.

(iii) The Secretariat shall be responsible for achieving the aims and objects mentioned

in the Memorandum of Association and implementing the decisions of the

Executive Body.

(iv) Academy Secretariat shall act as advisory agency for the Directorate of Cultural

Affairs to help Directorate shall tender necessary advice to prepare panel of

experts of concerned field to achieve the aims of the Academy.

12. TERM OF OFFICE OF THE MEMBERS :-

12.1 The term of office for members, other than ex-officer members of the General

Council, Executive Committee and the Finance Committee, shall be three years from the date of

their nomination or election as the case may be, at the end of which they can be nominated or

elected for another term not exceeding three years.

12.2 When a member of the Academy has been nominated or elected because of holding

an office, his membership shall be terminated when he ceases to hold that office.

12.3 A member of the General Council, Executive Committee, Finance and

Administrative Committee or any other authority of the Academy shall cease to be a member of

such body, if he fails to attend three consecutive meetings thereof without leave of the Chairman

concerned.

12.4 The General Council, the Executive Committee, the Finance and Administrative

Committee or any other authority or committee of the Academy shall perform its function not

withstanding any defects in the nomination or election of the member and no act or proceeding of

the General Council, the Executive Committee and the Finance Committee or any other authority

or committee shall be invalidated or nullified by reason only of the existence of any vacancy

therein or any defect in the nomination of election of any member.

13. ACADEMY FUND:-

13.1 An academy fund, shall be created through grants, earning, subscription and

donations given by individuals or corporate bodies or government/ Non Government

establishments or any other donor and will be maintained by opening an account in any

Nationalized Bank or Scheduled Commercial Bank of India. The fund will be utilized to achieve

the objectives of the Academy.

13.2 In the light of the implementation of the recommendations of the Executive

Committee, any expenditure from the fund for programmes approved by the Academy and for

day-to-day activities must be approved by the General Council.

13.3 The Secretary and the Accounts Officer of the Academy after authorization from

the Executive Committee will operate the Bank Account of the Academy in a Nationalized/

Scheduled Commercial Bank of India.

13.4 In case of vacancy of Secretary and Accounts Officer an officer shall be deputed by

the Department of Art, Cultural & Youth Government of Bihar for the operation of the Bank

Account.

14. ACCOUNTS & AUDIT:-

14.1

The accounts of the Academy shall be audited by the auditors appointed by the General

Council.

14.2

A copy of the annual accounts of the academy together with the auditor's report thereon

shall be submitted to the State Govt. and it shall be lawful for the State Govt. to pass such

orders on the annual accounts and the audit report as it may deems fit and shall be the

duty of the Academy to comply with such orders within the time limit specified by the

State Govt.

15. Annual Report.—Annual report of the Academy will be placed before Executive and

general council for wadie and final approval respectively.

16. MISCELLANEOUS.—Any matter not provided for in the Rules of the Academy shall be

dealt with in accordance with the Rules of the State govt. If govt. will for necessary. The Academy may

be registered under Society Registration Act, 1860.

17. REMOVAL OF DIFFICULTIES:-

17.1 Notwithstanding anything to the contrary contained in these rules, the Government

of Bihar, as the principal donor of the Academy, may appoint one person to review the work and

progress of the Academy and hold enquires into the affairs there of and report there on.

17.2 The progress review reports and/or enquire reports shall be included in the written

agenda of the ensuring meeting of Executive Body.

MEMORANDOM OF ASSOCIATION

For the all round development, promotion and protection of Performing art in the State of Bihar

and for nurturing the growth of healthy Cultural tradition of the State it was felt necessary establish a

State level autonomous and fully aided organisation under the Society Registration Act 1860 and

accordingly it is resolved as hereunder. ;

1. The State Government will establish a State Academy called Bihar Sangeet Natak Academy.

2. The area of works will be whole State of Bihar.

3. HEAD OFFICE.—The Head office of the Bihar Sangeet Natak Academy will be located at

Patna.

4. The Academy shall be a registered body. It shall have a perpetual seal and may sue and be

sued in its registered name.

5. It shall have the following objects :-

(i)

To encourage and promote study and research in the field of music, dance, drama and

other performing art etc.

(ii)

To co-ordinate and evaluate the function of voluntary organizations engaged in

cultural activities the field of performing art and to provide assistance for their

growth and developments.

(iii) To encourage the exchange of ideas between various schools of art and enrichment of

techniques by organizing conferences, lectures demonstration, festivals, exhibitions

camps and workshops.

(iv) To encourage artists and organizations to achieve artistic excellence by organizing

event/Competitions/Nominations in order to Award, Prizes, Fellowship, Scholarships

and Conferred titles.

(v)

To interact with similar bodies, as there may be other institutions and associations for

the furtherance of its objects and for enrichment of Indian culture as whole;

(vi) To encourage the establishment of the centres for different performing arts (such as

drama, music, dance and others) to ensure co-ordination among such centres.

(vii) To encourage amateur artists for development of dramatic and folk art activities and

to wider the road for their development in to professional artist.

(viii) To accord recognition to artists for outstanding achievement in the field of

performing art

(ix) To encourage the setting up of institution to provide training and research in different

To publish and to improve publication of literature, bulletins, magazines, journals,

etc. on performing art.

(xi) To award scholarship and prizes to deserving artists in the field of performing art.

(xii) To encourage the revival and development of folk songs, folk dances and folk

dramas.

(xiii) To develop and promote the rich diversity and uniqueness of various performing arts

of the State and to upgrade and enrich consciousness of the people about their

cultural heritage.

(xiv) To coordinate among various regional arts of the State and its recognition to the large

composite cultural heritage of India.

(xv) To raise funds and to accept grants of money contributions, securities, endowments

of property of any kind for attainment of the objectives of the academy.

6. It shall have following Powers and Function :-

(i)

To make rules, regulations and Bye-laws for the conduct of the affairs of the Academy

and to amend or rescind them with the prior approval of the State Govt.

(ii)

To do all such other acts and things as may be necessary for the furtherance of the

objectives of the academy.

(iii) In particular and without prejudice to the generality of the foregoing power and

functions such Rules or Regulation of Executive Business may be made for all or any

of the following matters, namely:-

(a) The Business of the Academy shall be carried on in accordance with the

provisions of the rules regulations by laws framed by the Academy with

approval of the State Govt.

(b) The General Council may with the approval of the State Govt. make rules

consistent with its Memorandum of Association for the purpose of giving effect

to the provisions thereof.

(j)

The allowances to be paid in terms of honorarium and other facilities such as

housing, conveyance etc to the Chairman, Vice-Chairman, Secretary and the

Members of the General Council.

(k) The authentication and authorization of the orders and decisions of the General

Council.

(l)

Planning and execution of programme to attain the objectives of the Academy.

(m) The condition and mode of appointment and duties of those imparting training in

different programmes of performing art and also of the invited judges/ jury

Bihar Sangeet Natak Academy Rules, 2013

Under Society Registration Act 1860 (Act xxi, 1860)

1. These Rules shall be called "The Bihar Sangeet Natak Academy Rules 2013" It shall come

into effect from the date of registration under the Society Registration Act, 1860.

2. DEFINITIONS- In these Rules unless otherwise excepted on the subject and context :-

a. "Academy" means the Bihar Sangeet Natak Academy, 2013.

b. "General Council" means the General Council of the Academy.

c. "Executive Committee" means the Executive Committee of the Academy.

d. "Chairman" means Chairman of the Academy.

e. "Member Secretary" means Secretary of the Academy.

Words used in singular number shall include the plural numbers and vice-versa and

words used in masculine gender shall include feminine gender and vice-versa.

g. "Central Government" means the Government of India.

h. "State Government" means the Government of Bihar.

"Artist" means any artist engaged in any performing art field.

''Object'' means object of the Academy.

3. OFFICE : The Head office of Bihar Sangeet Natak Academey will be located at Patna.

7. CONSTITUTION OF THE GENERAL COUNCIL AND ITS POWERS AND

FUNCTIONS :

7.1 The General Council shall be constituted in the following manner :-

(i)

Chairman

(ii) Vice- Chairman

(iii) Member Secretary

(iv) Member Ex- Officio (nominated)

(v) Member Nominated

7.2 THE CHAIRMAN:-

(1)

The Chairman of the Academy will be an eminent artists/critic and shall be

nominated by the State Govt. for a minimum period of three years. By virtue

of his office, the Chairman shall also be the head of the Academy and the

Chairman of the General Council and Executive Committee and shall when

present preside over the meetings of the General Council and Executive

Committee. Service conditions will be decided by the State Govt.

Provided that the chairman shall not vote in the first instance but shall

have a casting vote in the event of an equality of votes.

(2)

The Chairman shall have power to issue directions to any officer or authority

of the Academy for the furtherance of its aims and objects and it shall be the

duty of such officer or authority to comply with such directions.

(3)

Tenure of the Chairman shall be at the pleasure of the State Government or

maximum for a period of three years.

(4)

He can request to the State Government to free him from the post of Chairman

due to any personal or other reason.

(5)

Nobody can be Chairman for more than two consecutive power.

(6)

The State Government can appoint Adhoc Chairman till the appointment of a

regular Chairman.

(7)

Under special circumstances in the absence of General Council the Chairman

shall have power to take decision on held programmes, which compulsorily

should be approved in the next meeting of the General Council.

7.3 VICE- CHAIRMAN:-

(1) The State Govt. can nominate maximum two eminent person from performing

art as Vice-chairman.

(2) Tenure of the office of the Vice-chairman shall be 3 years.

(3) He can request to the State Govt. to free him from the post of Vice-Chairman

due to personal or any other reason.

(4) In the event of Chairman's absence, VC shall preside over meeting of the

General Council and in such event shall exercise the powers and perform all

the functions of the Chairman.

7.4 MEMBER SECRETARY:-

(1) Secretary of the Academy Secretariat shall be the Member Secretary of the

General Council.

(2) After the approval of the Chairman, the Member Secretary shall take action to

call the meeting of the General Council.

(3) The Member Secretary will prepare the Agenda, etc. and present the same

record in the meeting.

7.5 MEMBER (EX-OFFICIO):-

a. Secretary- Department of Youth, Art & Cultural, Bihar or his nominee.

b. Principal Secretary, Finance, Bihar or his nominee.

c. Principal Secretary, Tourism Department, Bihar or his nominee.

e. Special Secretary/Additional Secretary/Joint Secretary/Deputy Secretary, Art,

7.6 MEMBER NOMINATED.—Maximum of two eminent artists from each of 7

(Seven) following art forms will be nominated by the State Government:

(a) Classical Music- Vocal

(b) Classical Music- Instrumental

(d) Classical Dance

(e) Dramatics and playwriting

(f) Folk Dance

(g) Eminent art critic/ art historian

7.7 POWER AND FUNCTION OF THE GENERAL COUNCIL.—The General

Council shall have the following functions and powers:-

(i)

To draw up plans and programmers for the furtherance of the aims and objectives

of the Academy.

(ii)

To consider and approve the annual budget of the Academy drawn up by the

Executive Committee.

(iii)

To consider and approve programmes and specific projects proposed by the

Executive Committee.

(iv)

To frame its Regulations, Bye-laws and Rules of procedure.

(v)

To prescribe rules of procedure of the Executive Committee and Finance and

Administrative Committee.

(vi)

To grant recognition of the recommendation of the Executive Committee to

organizations and institutions rendering useful service to performing art.

(vii)

To select, on the recommendation of the Executive Committee, Eminent Artist or

Eminent Art Critics, Eminent Art Historians or those who have rendered

outstanding service to the cause of art as fellows of the Academy.

(viii)

Subject to the provision of the Memorandum of Association and the Rules, to do

any or all such acts as may be necessary for the furtherance of the aims and

objectives of the Academy.

(ix)

To nominate in its first meeting, from amongst its members the nominated

members of the Executive Committee, Finance and Administrative Committee,

Programme Committee and other committees as it deems fit for proper

functioning of the Academy.

(x)

All properties movable, immovable or of any other kind shall stand vested in the

General Council.

(xi)

To issue appeals and applications for money and funds in furtherance of the said

objects of the society and to accept both from Government and Non-

Governmental agencies, Indian and Foreign grants, Gifts, Donations,

Benefaction, Bequests, funds in trust, subscription of cash and securities and any

property movable or immovable to utilize for the purpose of the society.

(xii)

To construct, maintain, alter, extend, improve, develop or repair any immovable

property belonging to or held by the Academy.

(xiii)

To grant scholarship and stipends in furtherance of the said object.

(xiv)

To raise funds for the academy from gifts, donations or otherwise.

(xv)

To sue and defend all legal proceedings on behalf of the Academy.

(xvi)

To invest the money and funds of the society and very the investment as and

when it may seem necessary or proper.

(xvii)

To prescribe the powers, functions and duties of technical, administrative and

Executive Staff.

(xviii) In the discharge of its functions, the General Council shall be guided by the

cultural policy of the State Govt.,

(xix)

To appoint auditors for auditing the Accounts of the Academy.

(xx)

To give scholarships and grant to artists, critics and art historians for research

works.

(xxi)

To form and run Artists Assistance Fund.

(xxii)

Article, Publication, Art Work, Library and Archives of the Academy.

(xxiii) Marketing of the publications of the Academy.

(xxiv) Admission in the facilities related to the studio of the Academy.

7.8

MEETING OF THE GENERAL COUNCIL :-

(i)

The General Council shall normally meet twice in a year on date and time

fixed at the previous meeting of the General Council or at any office time.

The Chairman or Executive Committee may call extraordinary meeting of

the Council on its own initiative or at the written request of not less than one-

third of the total number of members of the Council.

(ii)

Two week prior notice shall be given to members for a general meeting of

the General Council and for extraordinary meeting the members shall be

given at least one week's prior notice.

(iii) Presence of one third (1/3) of the total number of members of the council

shall constitute quorum for the meeting of the council. However no quorum

will be required for an adjourned meeting.

(iv) Every meeting of the council shall be presided over by the Chairman or in his

absence by the Vice- Chairman. When both of them are absent the members

will select one of the members from amongst themselves to preside that

meeting.

8. CONSTITUTION OF THE EXECUTIVE COMMITTEE:-

8.1. The Executive Committee shall be constituted consisting of the following namely-

(i) Chairman of the General Council- Chairman

(ii) Vice-Chairmen of the General Council-Members (Ex-officio)

(iii) Director (cultural affairs)- Member

(iv) Principal Secretary/Secretary, Art, Culture & Youth Deptt., Bihar or his nominee-

Member

(v) Principal Secretary, Finance, Bihar or his nominee- Member

(vi) Maximum 5 (five) members nominated by the State Govt.

(vii) Secretary, Bihar Sangeet Natak Akademi- Member Secretary

8.2. Powers and Functions of the Executive Committee.— The Executive

Committee shall have the following powers and functions, namely :-

(i)

To exercise the executive authority of the academy subject to policy directives of

the General Council.

(ii)

To be responsible for the supervisions and control of the work of the Academy.

(iii) To consider and recommend programmes of the Academy and special projects

for the consideration of the General Council.

(iv) To draw up one annual budget of the Academy subject to the financial limits

prescribed and obtain approval of the General Council and the State Govt.

thereon.

(v)

In the absence of the meeting of the Committee, the Chairman shall take decision

regarding needful next Committee of will get administrative approval.

(vi) To accept transfers on behalf of the Academy of the movable or immovable

property to and for the purposes of the Academy.

(vii) To frame rules regulating the conditions of service of the employees of the

Academy.

(viii) To frame rules regarding conduct of affairs of the academy and to obtain

approval of the General Council and the State Govt. thereon.

(ix) To consider and propose to the General Council names of eminent artists for

election as fellows of the Academy.

(x)

To consider and propose to the General Council name of important art

organizations and institutions deserving recognition of the Academy.

(xi) To nominate persons to represent the Academy in national or international

conferences or organisations.

(xii) Subject to the budgetary limits and policy directions if any, of the General

Council to grant financial assistance to organizations and institutions recognized

by the academy, and

(xiii) Subject to the provision of the Memorandum of Association and the rules framed

there under to do any and all such other acts as may in its opinion, be necessary

for the proper management of the affairs of Academy.

8.3. Meetings of the Executive Committee:-

(a) The Executive Committee shall ordinarily meet once after every three months.

Extraordinary meetings of the Committee may be called by the Chairman on his

own initiative or on a request in writing given by not less than half of the total

number of members of the Committee.

(b) Presence of half of the total number of members of the Executive Committee

shall constitute a quorum at any meeting of the Committee. However no quorum

will be required for an adjourned meeting

9.1. The Finance & Administrative Committee shall be constituted consisting of

One representative of Finance Department of the State Govt. - Member

(c)

One representative of the General Council elected by the members of the Council

form amongst its own members- member

(d)

One representative of the Executive Committee elected by the members of the

Committee from amongst its own members- Member

(e)

The Secretary of Academy- Member Secretary

9.2. Powers and Functions of the Finance and Administrative Committee.—The

Finance and Administrative Committee shall have the following powers and functions:-

(i)

Advise the Academy on any matters affecting its finance.

(ii)

Prepare the annual estimates of income and expenditure of the Academy

(iii)

To scrutinize every item of a new expenditure not provided in the budget

estimates of the Academy.

(iv)

Be responsible for observance of rules relating to maintenance of accounts,

income and expenditure of the Academy, and

(v)

Discharge such other function of financial nature as may from time to time be

prescribed by the rules or entrusted to it by the General Council or the Executive

Committee.

10. CONSTITUTION OF THE PROGRAMME COMMITTEE:-

10.1 The programme shall be constituted consisting of maximum of 05 (five) members

nominated by the General Council from amongst its members.

10.2 The Programme Committee shall have powers & functions namely :-

(i)

To prepare the detailed calendar for the whole year of activities, programmes and

events of the Academy.

(ii)

To study programme proposals sent to the Academy by different organizations

and approve or disapprove thereof.

(iii)

To prepare a budget estimate for each programme.

11. ACADEMIC SECRETARIAT AND SECRETARY:-

11.1 General Council Cell shall constitute a secretariat of Bihar Sangeet Natak

Academy consisting of following officers:

(a) Secretary

(b) Assistant Secretary

(c) Programme Officer (Folk art)

(d) Programme Officer (Traditional art

(e) Programme Officer (Exhibition)

(f) Account Officer

(g) Accountant and other staff according to need

They will be appointed by the Competent Authority under Service byelaws of the Academy and

appointments will be vetted by the Govt.

11.2 THE SECRETARY:-

(1) The Secretary shall be appointed by the State Govt. He may be appointed by direct

recruitment/ departmental promotion or on deputation/ transfer from any

government department or public undertaking for three years.

(2) The Secretary will be person of recognized ability and experience in the field of art,

culture or administration.

(3) The Secretary shall be a full term executive officer of the Academy and in this

capacity he will make sure timely execution of all programmes decided by the

Academy. The Secretary shall be the member secretary of the General Council and

the Executive Committee, Finance Committee and all other committee which may

be constituted by the Academy.

(4) The Secretary including other things will perform following functions:-

(a)

To be the custodian of the records and such other property of the Academy

as the Executive Committee may commit to his charge.

(b)

To conduct the official correspondence on behalf of the authorities of the

academy

(c)

To issue all notices for convening meeting of the authorities of the Academy

and of all committees appointed by the authorities.

(d)

To keep the minutes of the meetings of the authorities of the academy and

of all committees appointed by authorities.

(e)

To maintain accounts of the Academy

(f)

Subject to the control of the Executive Committee, he will manage the

property and investments of the Academy and will be responsible for the

preparation of the annual estimates and statements of accounts and for their

presentation to the Executive Committee and the General Council.

(g)

Subject to the power of the Executive Committee, he will be responsible for

seeing that all moneys are spent for the purposes for which they are granted

or allotted.

(h)

To sign all contracts and assurance of property made on behalf of the

academy as to the same have been approved by the Executive Committee.

(i)

To exercise such other powers as may be assigned to him by the Executive

Committee or the General Council.

(j)

The receipt given by the Secretary for any moneys paid into the accounts of

Academy shall be sufficient discharge for the same.

11.3

FUNCTION AND POWER OF THE ACADEMY SECRETARIAT:-

(i)

Academy Secretariat shall consist of Secretary, other officers and staff.

(ii)

The said Secretariat shall be responsible for the management of day-to-

day activities of the Academy. The Academy will manage the execution

of its work.

(iii) The Secretariat shall be responsible for achieving the aims and objects

mentioned in the Memorandum of Association and implementing the

decisions of the Executive Body.

(iv) Academy Secretariat shall act as advisory agency for the Directorate of

Cultural Affairs to help Directorate shall tender necessary advice to

prepare panel of experts of concerned field to achieve the aims of the

Academy.

12. TERM OF OFFICE OF THE MEMBERS :-

12.1 The term of office for members, other than ex-officer members of the General

Council, Executive Committee and the Finance Committee, shall be three years from the date of

their nomination or election as the case may be, at the end of which they can be nominated or

elected for another term not exceeding three years.

12.2 When a member of the Academy has been nominated or elected because of holding

an office, his membership shall be terminated when he ceases to hold that office.

12.3 A member of the General Council, Executive Committee, Finance and

Administrative Committee or any other authority of the Academy shall cease to be a member of

such body, if he fails to attend three consecutive meetings thereof without leave of the Chairman

concerned.

12.4 The General Council, the Executive Committee, the Finance and Administrative

Committee or any other authority or committee of the Academy shall perform its function not

withstanding any defects in the nomination or election of the member and no act or proceeding of

the General Council, the Executive Committee and the Finance Committee or any other authority

or committee shall be invalidated or nullified by reason only of the existence of any vacancy

therein or any defect in the nomination of election of any member.

13. ACADEMY FUND:-

13.1 An academy fund, shall be created through grants, earning, subscription and

donations given by individuals or corporate bodies or government/ Non Government

establishments or any other donor and will be maintained by opening an account in

any Nationalized Bank or Scheduled Commercial Bank of India. The fund will be

utilized to achieve the objectives of the Academy.

13.2 In the light of the implementation of the recommendations of the Executive

Committee, any expenditure from the fund for programmes approved by the

Academy and for day-to-day activities must be approved by the General Council.

13.3 The Secretary and the Accounts Officer of the Academy after authorization from

the Executive Committee will operate the Bank Account of the Academy in a

Nationalized/ Scheduled Commercial Bank of India.

13.4 In case of vacancy of Secretary and Accounts Officer an officer shall be deputed by

the Department of Art, Cultural & Youth Government of Bihar for the operation of

the Bank Account.

14. ACCOUNTS & AUDIT:-

14.1 The accounts of the Academy shall be audited by the auditors appointed by the

General Council.

14.2 A copy of the annual accounts of the academy together with the auditor's report

thereon shall be submitted to the State Govt. and it shall be lawful for the State

Govt. to pass such orders on the annual accounts and the audit report as it may

deems fit and shall be the duty of the Academy to comply with such orders within

the time limit specified by the State Govt.

15. ANNUAL REPORT.—Annual report of the Academy will be placed before the Executive

committee approval and therefore shall be placed before the general council for final acceptance.

16. MISCELLANEOUS.—Any matter not provided for in the Rules of the Academy shall be

dealt with in accordance with the Rules of the State govt. If govt. will feel necessary the academy may be

registered under Society Registration Act, 1860.

17. REMOVAL OF DIFFICULTIES:-

17.1 Notwithstanding anything to the contrary contained in these rules, the Government

of Bihar, as the principal donor of the Academy, may appoint one person to review

the work and progress of the Academy and hold enquires into the affairs there of

and report there on.

17.2 The progress review reports and/or enquire reports shall be included in the written

agenda of the ensuring meeting of Executive Body.
