(Recruitment and Terms and Conditions of Service of Officers and Employees)

Regulations, 2014

No. BERC-Estb-05/14-02—In exercise of the powers conferred by sub section 2(zk)

of Section 181 read with sub-sections (1) (2) and (3) of Section 91 of the Electricity Act,

2003 (36 of 2003), the Bihar Electricity Regulatory Commission with the approval of the

State Govt., makes the following Regulations to regulate recruitment, terms and conditions

of service of officers and staff under its control.

CHAPTER – I

GENERAL

Short Title, extent and Commencement

(1) These regulations shall be called the Bihar Electricity Regulatory Commission

(Recruitment and Terms and Conditions of Service of Officers and employees)

Regulations, 2014.

(2) These Regulations shall come into force on the date of their publication in the

Official Gazette.

(3) These Regulations shall apply to all officers and employees of the Bihar Electricity

Regulatory Commission.

Definitions- In these Regulations, unless the context otherwise requires :

(1) (a) "Act" means the Electricity Act, 2003 (36 of 2003);

(b) "Commission" means the Bihar Electricity Regulatory Commission;

posts and Secretary or any other officer of the Commission to whom such powers

have been delegated by the Commission in respect of Group-C and D posts.

(d) "Chairman" means the Chairman of the Bihar Electricity Regulatory

Commission;

(e) "Disciplinary Authority" means the Chairman, Bihar Electricity Regulatory

Commission in respect of all Group A and B posts and Secretary or any other

officer of the Commission to whom such powers have been delegated by the

Commission for all Group C and D posts or any other functionary of the Bihar

Electricity Regulatory Commission to whom disciplinary powers under the

relevant statute have been delegated in respect of any specific category of

officers/staff by the Commission provided that in respect of those

officers/employees who are on deputation, the relevant rules of his/her parent

organisation shall govern the disciplinary matters;

(f) “Competent Authority" means the Chairman and such other officer or officers

in the Commission designated from time to time for this purpose by the

Commission;

(g) “Officers” means personnel of group ‘A’ and ‘B’ and staff means personnel of

group ‘C’ and ‘D’;

(h) “Function” means and includes all works and related activities of the

Commission;

(i) "Member" means the Member of the Bihar Electricity Regulatory Commission;

(j) "Secretary" means the Secretary of the Commission or any other officer of the

Commission authorized by the Chairman to discharge the responsibilities of the

Secretary in his/her absence for a limited period;

(k) "Selection Committee" means a Committee constituted by the Commission for

all Group – A to D posts in accordance with the provisions of these regulations

for making appointments to the posts existing in the Commission;

(l) "Service" means the service rendered by officers and staff of the Commission;

(m) "State Govt." means the Government of Bihar;

(n) "Year" means the financial year;

(o) “Direct Recruitment” means appointment made by the Bihar Electricity

Regulatory Commission other than appointment made by transfer on deputation

or on contract basis.

(p) “Appointment on contract basis” means appointment made by the appointing

authority in accordance with the provisions of these regulations for a limited

period on contract basis.

(2) Words and expressions used in these Regulations but not defined herein, unless

the context otherwise requires, shall have ordinarily the same meaning as assigned to

them in the Electricity Act, 2003.

CHAPTER – II

CLASSIFICATION OF POSTS, SANCTIONED POSTS & MODE OF

APPOINTMENT

Sanctioned Posts-

(1) The designation and classification, sanction strength and scales of pay of the posts

borne on the establishment of the Commission, as approved by the State

Government shall be as specified in Schedule-I appended with these Regulations and

the same may be amended, on the basis of proposal made by the Commission based

on requirement of human resources as assessed by the Commission subject to

consultation with the State Government. Action for filling up of the posts shall be as

per requirement at the discretion of the Commission.

(2) It shall not be construed from Regulation 3(1) that services of employees on all

categories of posts are always required by the Commission.

Qualification, Experience & Mode of Appointment

(1) The educational qualification and qualifying service, pay scale and experience for

appointment to the posts on the establishment of the Commission shall be as

prescribed in Schedule-II appended with these Regulations. The employees shall be

appointed by the Commission either

(a)

on direct/regular recruitment basis, as mentioned at serial no.27,28,29,32,33

and 34 of schedule-II of these Regulations;

(b)

on deputation or, if suitable person is not available for deputation, on contract

as mentioned at serial no. 1 of schedule II of these Regulations;

(c)

by promotion or, if suitable person is not available for promotion, on

deputation and if suitable person is not available for deputation, on contract

basis as mentioned at serial no. 2,3,4,5,6,7,8,9,10,11,14,19,21,24 and 25 of

schedule II of these Regulations; or

(d)

on deputation or, if suitable person is not available for deputation, on

contract/direct recruitment as mentioned at serial no. 12, 13, 15, 16, 17, 18, 20,

22, 30 and 31 of schedule II of these Regulations; or

(e)

by promotion or, in case of non-availability of candidate for promotion, on

deputation and in case of non-availability of person for deputation, by direct

recruitment/on contract as mentioned at serial no. 23 of schedule-II of these

Regulations; or

(f)

by promotion or, if suitable candidate is not available for promotion, by direct

recruitment as mentioned at serial no. 26 of schedule-II of these Regulations.

(2) The Commission shall have the power to determine the mode of recruitment/

appointment to a particular vacancy or a group of vacancies or all vacancies.

(3) Promotion- The provision of promotion as contained in schedule-II of these

Regulation together with the provision of promotion issued by the government from

time to time shall be applicable to the employees appointed by direct recruitment by

the Commission.

(4) The provision of Modified Assured Career Progression Scheme issued by

government from time to time shall also apply to direct recruit of the Commission.

Chapter – III

ELIGIBILITY AND TERM FOR APPOINTMENT

Eligibility for appointment

No person shall be appointed to the service of the Commission–

(a)

unless he/she is a person bearing a good moral character as certified by a

gazetted class-I officer of the Central or State Govt.

(b)

if he has been dismissed or removed from any government or private service

(job) on the ground of misconduct or moral turpitude.

Term of Appointment on Deputation or on Contract Basis

(1) Deputation under these regulations shall be initially for a period not exceeding 3

(three) years which may be extended for further successive term of 1 (one) year each

for maximum period of 2 (two) years at the discretion of the Commission based on

performance appraisal report submitted by the designated authority as nominated by

the Commission.

(2) The appointment on contract basis under these regulations in case of retired persons

shall be initially for two (2) years which may be extended as per requirement for

successive periods of 1 (one) year each upto maximum age limit of 65 years after

review of his performance. The appointment on contract basis, in case of non retired

candidate, shall be initially for one year which may be extended as per requirement

for further period if his work after review is found satisfactory.

CHAPTER – IV

PROCEDURE FOR RECRUITMENT & APPOINTMENT AND OTHER

CONDITIONS

Procedure for Recruitment

(1) Subject to the general guidelines issued by the State Government appointment shall

be made for filling up the vacancies against the sanctioned posts of the Commission

as per educational qualification and experience contained in Schedule-II appended to

these regulations.

(2) The Commission, when required, to fill up certain vacancies by direct

appointment/deputation/contract basis as it considers appropriate shall notify the

number of vacancies to be filled up by direct recruitment / on deputation/ on contract

basis, as it deems proper, through press, circulation to Government departments

(both Central and State Govt.), public sector undertakings, educational institutions

and autonomous bodies with complete details of job requirement, requisite

educational and professional qualification, pay structure, etc. providing not less than

4 (four) weeks time for the prospective applicants to respond to the job requirement.

In case of exigencies for appointments on contract, this period may, for the reasons

to be recorded, be reduced to a reasonable period. Appointment to various posts as

given in Schedule-I except that of Secretary of the Commission, shall be made, on

the recommendations of the Selection Committee constituted by the Commission.

(3) The Selection Committee shall recommend candidates for appointment to the posts.

The recommendations of the Selection Committee shall remain valid for a period of

one year or up to a period as extended by the Commission.

(4) All appointments except on deputation shall be made in a manner as the Commission

considers appropriate subject to verification of character and antecedents of the

candidates.

(5) Reservation- The provision of reservation issued by the Govt. from time to time

shall apply to appointments made by the Commission.

Period of Probation in case of Direct Recruitment

(1) All direct recruits shall be on probation for a period of 2 (two) years from the date of

their joining and the rules of the State Govt. in this regard shall be applicable to

them.

(2) The period of probation, however, shall not include the period spent on earned leave

or extraordinary leave or medical leave or any period of unauthorised absence from

duty as decided by the Commission.

(3) In case performance of any appointee during the period of probation is not found

satisfactory or up to the mark, the period of probation may be extended by a

maximum of 6 (six) months or the Commission at its discretion, may terminate the

appointee from service forthwith subject to payment of one month's salary.

(4) In cases relating to appointment of a serving employee, he/she shall have to quit the

previous job first before joining the Commission. Any suppression of fact may

render him/her liable for termination from the service of the Commission.

Superannuation

All employees appointed on regular basis shall retire from the service of the

Commission on attaining the age of superannuation as laid down by the State Govt.

from time to time.

Resignation

An employee of the Commission appointed on a regular basis may resign from his

post by giving ninety day's clear notice to the Commission. However, the

Commission, at its discretion, may relax this condition in exceptional cases after

recording the reasons thereof.

Appointment on Deputation

(1) The eligibility criteria for posts to be filled on deputation shall be as per details given

in Schedule-II of these Regulations provided that the Commission shall have the

discretion to relax such eligibility conditions (except educational qualification) for

reasons to be recorded in writing, in deserving cases.

(2) The Commission may fill vacancies by deputation but period of deputation shall be

of a maximum of three years. However, period of deputation may be extended

beyond three years with the concurrence of Finance Department, Government of

Bihar .

(3) The period of service of persons appointed on deputation from Central Govt., State

Govt. or Public Sector Undertaking shall be treated as continuous for the purpose of

all service benefits.

(4) The pay, allowances and other benefits and conditions of service of a persons

deputed from a Government Department / Public Sector Undertaking, Autonomous

Body, etc. shall be governed by the standard terms and conditions as prescribed by

the State Govt. from time to time.

(5) Persons joining on deputation shall have an option to elect to draw either pay in the

scale of pay of the deputation post fixed under normal rules or basic pay in the

parent organisation from time to time plus personal pay, if any, and deputation

allowance as prescribed by the State Govt. from time to time.

(6) Persons joining the service of the Commission on transfer on deputation shall be

liable to repay the loans, advances and other sums due against them on the date of

joining the Commission or, otherwise admitted obligations by them to the parent

organisation which remain outstanding against them on the date of joining as per the

original term and conditions.

(7) In case of a deputationist opting for his/her grade pay in the parent organisation plus

deputation allowance, the allowance and perquisites available under the Commission

shall be calculated at the rates admissible to him in his parent organisation.

(8) Persons joining on deputation shall be governed by provisions applicable in their

parent organisation as regards General Provident Fund/Contributory Provident Fund

/Contributory Pension Scheme as the case may be.

(9) The Commission shall have the discretion to approve the repatriation of any

employee serving on deputation to his parent organisation on arriving at a conclusion

that the services of such employee are not required, notwithstanding the fact that the

employee has not completed the period of deputation in the Commission.

(10) Other terms and conditions of the service shall be governed by the rules as

prescribed by the State Govt. from time to time.

12.

Other admissibility for appointment on regular or deputation basis

The employees appointed otherwise than on contractual basis shall be eligible for

facilities of transport, telephone, travelling allowance and dearness allowance as

admissible to State Govt. employees of equivalent scale of pay, subject to suitable

modification by the Commission keeping in view the nature of job or assignment

entrusted to them.

13.

Appointment on Contract

(1) The eligibility criteria for post to be filled up on contract basis shall be as prescribed

in Schedule-II appended to these Regulations subject to guidelines issued by the

State Govt. In deserving cases the Commission shall have the discretion to relax

eligibility conditions for all Group – A to D posts (except educational qualification)

for reasons to be recorded.

(2) Persons appointed on contract basis shall enter into an agreement which shall govern

their broad service conditions of appointment in a format to be prescribed by the

Commission.

(3) Persons appointed on contract basis shall be entitled to a fixed remuneration.

Remuneration shall be determined in accordance with resolution/circulars issued by

State Govt., General Administration Department and amendment made to them

from time to time.

(4) In case of persons retired from Government/PSU etc. where pension scheme exists,

the remuneration plus pension shall not exceed their last pay drawn.

(5) The services of an employee appointed on contract basis may be terminated on

proper and sufficient reasons to be recorded in writing, giving one month's notice or

payment of one month salary in lieu thereof.

CHAPTER – V

PAY AND ALLOWANCES

14.

Pay Fixation

(1) The pay revision of regular employees shall be at par with employees of

corresponding grade/ scale of pay under State Govt.

(2) The pay of an employee appointed on regular basis shall be fixed at the minimum

stage of the relevant scale of pay.

15.

Allowances

(1) The employees of the Commission appointed otherwise than on contractual basis

shall be entitled to Dearness Allowance, City Compensatory Allowance,

Conveyance Allowance and House Rent Allowance as admissible to State Govt.

employees from time to time.

(2) The employees of the Commission shall not be eligible for overtime allowance.

(3) The employees of the Commission appointed on regular basis shall be entitled to

such other allowances as may be made applicable to employees of the State Govt.

from time to time.

CHAPTER – VI

OTHER CONDITIONS OF SERVICE

16.

Leave and other Conditions

(1) Leave and other conditions of service shall be the same as applicable to employees

of the State Govt. of equivalent grade.

(2) Leave Travel Concession

The employees of the Commission appointed otherwise than contractual basis shall

be eligible for Leave Travel Concession as admissible to the employees of the State

Government from time to time.

(3) Medical Attendance

Regular employees and persons on deputation shall be entitled to reimbursement of

expenditure on medicial treatment in accordance with Medical Attendance Rules

prescribed by State Govt. (Health Department) as revised from time to time by

resolution/circulars.

(4) General Provident Fund

The employees of the Commission appointed otherwise than on contractual basis,

shall be eligible to subscribe (like employees of State Government/State Public

Undertaking/State Autonomous Body) to the General Provident Fund/ Contributory

Provident Fund/New Pension Scheme (as applicable in each case). If an official

appointed on deputation is a member of Contributory Provident Fund/New Pension

Scheme, the Commission shall bear employer's contribution as applicable in their

cases.

(5) Pension

The regular employees of the Commission shall be eligible/entitled to pensionery

benefits as applicable to the State Govt. employees. However, officers and

employees appointed on or after 01.09.2005 (1^st Sept. 2005) shall be eligible for

New Pension Scheme(NPS).

(6) Travelling Allowance & Daily Allowance

The employees of the Commission appointed otherwise than on contractual basis

shall be governed by the rules applicable to the State Government employees for the

purposes of traveling allowance and daily allowance.

(7) Transport

Vehicles as may be required, may be hired for the Secretary and Directors with the

approval of the Chairman.

(8) Residential Telephone

The Commission shall decide eligibility for residential telephone to its officers on

the basis of functional requirements.

CHAPTER – VII

MISCELLANEOUS

17.

Applicability of CCA and Conduct Rules

The provisions of the Bihar Civil Services (Classification, Control and Appeal)

Rules and Bihar Civil Services (Conduct) Rules as applicable to the State Govt.

employees as amended from time to time, shall be applicable to the employees of

the Commission with appropriate modifications.

18.

In respect of any service matter not specifically mentioned in these Regulations, the

direct recruit of the Commission will be governed by the service rules of State Govt.

employees till appropriate regulations are notified by the Commission.

19.

Record of Service and Work Performance

(1) Records of service of all employees shall be maintained in the form approved by the

Commission.

(2) The performance of the officers and staff shall be assessed and reviewed annually in

the manner and in the form prescribed by the Commission.

20.

Relaxation

The Commission in public interest and for reason to be recorded in writing, may

relax any provision of these Regulations including the eligibility criteria for

appointment to posts, in appropriate cases, in consultation with the State Govt.

21.

Interpretation

If any question arises relating to the interpretation of any provision of these

Regulations, the decision of the Commission shall be final.

22.

Power to remove Difficulties

The Commission may by order make such provisions or give such directions, as it

may deem fit and necessary for the removal of any difficulty that may arise in giving

effect to any of the provisions of these Regulations.
