THE BIHAR STAMP (PREVENTION OF UNDER VALUATION OF INSTRUMENTS)

AMENDMENT RULES, 2014

No. I/M¹-1-54/2014- 3152—In exercise of the powers conferred by Section-75 of the

Indian Stamp Act,1899 (Act II of 1899), the Governor of Bihar is pleased to make the

following Rules to amend the Bihar Stamp (Prevention of Under Valuation of Instruments)

Rules, 1995 (as amended from time to time): --

1. Short title, extent and commencement.— (1) These Rules may be called the Bihar

Stamp (Prevention of Under Valuation of Instruments)(Amendment) Rules, 2014.

It shall extend to the whole of the State of Bihar.

(3)

It shall come into force with effect from the date : 01.04.2014.

2. The words "every year" used in sub-rule (1) of Rule-6 of the Bihar Stamp (Prevention

of Under Valuation of Instruments) Rules,1995 shall be substituted by the words,

figures and brackets "in accordance with the provisions mentioned in sub-rule (2)(c)

or sub-rule (2)(f) of Rule-6."

3. The words "every three years" used in clause (c) of sub-rule (2) of Rule-6 of the Bihar

Stamp (Prevention of Under Valuation of Instruments) Rules,1995 shall be substituted

by the words "after decision of the necessity of revision by the State Government."

4. Sub-rule (2)(d) of Rule-6 of the Bihar Stamp (Prevention of Under Valuation of

Instruments) Rules,1995 is here by deleted.

5. Sub-clause (i) of clause (f) sub-rule (2) of Rule-6 of the Bihar Stamp (Prevention of

Under Valuation of Instruments) Rules,1995 shall be substituted by the following: -

"(i) Inspector General of Registration shall get the approval of State Government in

the month of November every year on the necessity for revision of guidance

Sub-Registrars about it. After receiving the information of approval, District-

Sub-Registrars shall obtain for all categories of land/property figures of average

of five conveyances having highest valuation rates in every category of

land/property of all villages/wards of urban area muhalla-wise/location-wise

registered within the period from the month December of the previous year to

the aforesaid month of November from all registering officers of the sub-district

of their jurisdiction including his own jurisdiction and shall present all figures

before the District Valuation Committee by 31^st December."

6. A new sub-rule (2)(f)(ix) shall be inserted after sub-rule (2)(f)(viii) of Rule-6 of the

said the Bihar Stamp (Prevention of Under Valuation of Instruments) Rules,1995 as

follows: -

"In course of revision the District Valuation Committee after finding any rate of

previously fixed estimated minimum value more than the existing market rate, may

recommend it equal to the existing market rate."

7. The first sentence "That the valuation done by the committee shall not be less than the

average value of five conveyances having highest value as supplied to it under clause

(2)(f)(i) by the District-Sub-Registrars." used in first proviso of sub-rule (2)(f) of

Rule-6 of the Bihar Stamp (Prevention of Under Valuation of Instruments) Rules,

1995 is here deleted.

8. Sub-rule (1), (2) & (3) of Rule-8 (except provisos) of the Bihar Stamp (Prevention of

Under Valuation of Instruments) Rules,1995 shall be substituted by the following: -

(1) Estimated minimum value of land/property of urban/peripheral/rural areas shall

be revised accordingly after deciding the necessity of revision by the State

Government.

(2) Revised Estimated Minimum Value shall be implemented from the date next to

the notification by the District-Sub-Registrars.
