इलेO शCिशयन, वेQ डर एवं टन0र) के मूल कोYट म2 क1 जायेगी।

(3) िनयु( ूािधकार ूh येक वष0 क1 1 अूील के आधार पर Uर(य* क1

गणना करेगा और उस वष0 के 30 अूील तक आयोग को अिधयाचना भेज देगा।

(4) आयोग Uर(य* को वiापत करेगा और ूितयोिगता परC<ा के अधार

पर सफल अj यिथ0य* का चयन करने के बाद संबंिधत िनयु( ूािधकार को मेधाबम से

अj यिथ0य* के नाम क1 अनुशंसा करेगा। मेधासूची क1 वैkता वभाग म2 अनुशंसा ूािl क1

ितिथ से एक वष0 तक रहेगी।

(5) स5 यक छानबीन के बाद िनयु( ूािधकार अj यथ3 क1 िनयु( परCवी<ा

पर दो वष4 के िलए करेगा।

मामले ।- ऐसे मामल* के संबंध म2 जो इस िनयमावली ारा विशं ट aप

से आ छाYदत नहCं है, संवग4 के सदः य रा. य सरकार के समुिचत ः तर के

पदािधकाUरय*/कम0चाUरय* के िलए लागू संYहता िनयमावली, विनयमावली या आदेश* से

शािसत ह*गे।

17.

कYठनाई का िनराकरण ।

कYठनाई का िनराकरण ।- यYद इस िनयमावली के ूावधान* के काया0% वयन म2 कोई

कYठनाई उh प% न हो तो उस कYठनाई को दूर करने के िलए वभाग, समय-समय पर ऐसा

सामा% य या वशेष िनदेश जो इस िनयमावली के ूावधान* से असंगत न हो, जारC कर

सकेगा।

िनव0चन ।

िनव0चन ।- जहॉं इस िनयमावली के ूावधान* म2 Yकसी के िनव0चन के संबंध म2 कोई

शंका उh प% न हो, वहॉं मामला सामा% य ूशासन वभाग/व' वभाग ारा विन;sत Yकया

जायेगा और उसका िनण0य अंितम होगा।

िनरसन एवं c या

िनरसन एवं c यावृ' ।

वृ' ।

वृ' ।-(1) इस संवग0 के संबंध म2 पूव0 म2 िनग0त सभी संकQ प एवं

अनुदेश एतv ारा िनरिसत Yकये जाते है।

(2) ऐसा िनरसन के होते हुए भी ऐसे संकQ प, अनुदेश के अधीन Yकया गया कोई

काय0 या क1 गयी कोई कार0वाई इस िनयमावली के अधीन Yकया गया या क1 गयी समझी

जायेगी मानो यह िनयमावली उस Yदन ूवृ' थी ;जस Yदन ऐसा काय0 या ऐसी कार0वाई क1

गयी थी।

proviso to Article 309 of the constitution of India, the Governor of Bihar is pleased to make

following Rules to regulate recruitment and service-condition of Technical Cadre (Fitter,

Electrician, Welder and Turner range establishment) of Bihar Building Construction

Department.

Chapter: - 1

Preliminary

Short title, extent & Commencement-(I) These Rules may be called as the

"Technical Cadre (Fitter, Electrician, Welder and Turner) (Recruitment & service

condition) Rules, 2014" of the Chief Engineer's range office of the Building

Construction Department.

(II) It will extend to whole state of Bihar.

(III) It will come in to force at once.

Definitions- In these Rules, unless otherwise require in the subject or context:-

(I)

''State Government'' means the Government of Bihar.

(II)

''Department" means Building Construction Department.

(III)

'Cadre' means all such posts of Technical Cadre (Fitter, Electrician,

Welder and Turner Range establishment) of Building Construction

Department having equal nature of work and carries similar pay scale and

it's unification is necessary in the interest of work and due to equality of

promotional posts. The post of Fitter, Electrician, Welder and Turner,

shall be treated to be basic grade post in it's respective Cadre and, the

chain of promotion shall be according to structure mentioned in rule-3.

(IV)

'Commission' means Bihar staff selection commission:

"Appointing Authority" means the Chief Engineer, Building Construction

Department of the concerned range.

(VI)

"Fixed date" means the date of coming in to force of these Rules. And

(VII) "Member" means any personnel and all the personnel appointed in the

cadre before coming in to effect of these Rules.

Constitution of cadre- Structure of Technical Cadre (Fitter, Electrician, Welder

and Turner) shall be according to the following:-

Note:-

The order relating to the pay scale of these posts shall be issued with concurrence

of Finance Department. The present chain of post of Basic Category, First

Promotional Category, Second Promotional Category and Third Promotional

Category of Technical Cadre (Fitter, Electrician, Welder and Turner) shall

remain continue till further order.

Cadre strength- The Cadre strength shall be same which may be determined by

Building Construction Department from time to time.

Chapter: 2

Recruitment

(1) Total Post (100%) of Technical Cadre (Fitter, Electrician, Welder and

Turner) shall be filled up by direct recruitment.

(2) All recruitment to the post of basic category shall be made on the

recommendation of the commission.

(3) The appointing authority, after calculating vacancy on the basis of position as

on 1^st April of the year, shall send requisition to the Commission latest by 30^th

April of that year.

(4) The Commission shall advertise the vacancy and shall select candidates on

the basis of Competitive examination. After preparation of merit list in order of

merit, the Commission shall send the recommendation to the concerned

Appointing Authority. The validity of merit-list shall be up to one year from the

date of receipt of recommendation in the Department.

(5) The Appointing Authority after proper verification, shall appoint the

candidates for two years on probation.

Qualification-(I) Minimum educational qualification shall be Pass in

matriculation or equivalent and I.T.I. pass in Fitter/Electrician/ Welder/Turner

trade with three years work experience.

Age limit- Minimum Age limit for appointment shall be 21 years and maximum

age limit shall be the same which may be determined by the state Government

(General Administration Department) from time to time.

Reservation-Compliance of Reservation Act of Government and reservation

roster issued from time to time, by the Government shall be necessary,

Probation-Every recruitment shall be for two years on probation. In special

circumstances it may be extended for one year, if the appointing authority is

satisfied that there is a chance of improvement in the probationer. If the service

is not found satisfactory in extended period also, the concerned person shall be

terminated from service.

Confirmation-The probations shall be confirmed after completion of

satisfactory probation period.

11.

Seniority- The inter-se Seniority of the member of the cadre shall be according

to their merit positions determined by the Commission but the inter-se seniority

determined prior to coming in to force of these Rules shall be unchangeable.

12.

Promotion-(1) Promotion from basic category to the higher post may be given

after completion of Kalawadhi as determined by General Administration

Department from time to time and on recommendation of Departmental

promotion Committee.

(2) Departmental promotion Committee shall be Constituted as follows:-

(I) Chief Engineer

Chairman.

(II) Superintending Engineer

Member

(III)

An officer of S.C/S.T as determined by the chairman

(Who shall not be below the rank of Executive Engineer)-

Member

(IV)

Senior Technical officer

Member Secretary

nominated by the Chief Engineer

Chapter:-3

Pay and efficiency bar

13.

Pay Scale- The pay scale admissible by the state government of different

categories of the post and corresponding pay scale will declared by the state

government from time to time.

Chapter:-4

General/Miscellaneous

14.

Level of cadre-The Cadre shall be at the level of range Chief Engineer, but in

case of transfer of the personnel from one range to another on his own request,

the concerned personnel shall be deemed to be junior most in the transferred

range.

15.

Transfer/Posting-The Chief Engineer of the concerned range shall be competent

authority to make transfer/posting of the personnel. Transfer/posting from one

range to another shall be made every year in the month of June in the light of

instructions of Building Construction Department, Cabinet Secretariat

Department and General Administration Department issued, from time to time.

In case transfer/posting is made in any month other than the month of June. It

shall be necessary to obtain approval of the officer of the above rank.

16.

Residual Matters-In respect of such cases, which are not covered specifically

these

Rules,

the

Member

cadre

shall

codes/Rules/Resolutions/Orders applicable to the officers/ employees of

appropriate level of the state government.

17.

Removal of difficulties- If any difficulty arises in implementation of provisions

of these Rules, the Department may issue general or specific instructions which

are not inconsistent of the provision of these Rules from time to time to remove

such difficulty,

Interpretation-Here any doubt arises in respect of interpretation of any

provision of these Rules, it shall be determined by General Administration

Department/Finance Department and its decision shall be final.

19.

Repeal & savings-(1) All the Rules and resolutions issued earlier in respect of

the Cadre are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the

aforesaid Rules, resolutions, orders instruction etc. shall be deemed to be done or
