No. F.S.C. 20/2012-1272(15)—In exercise of powers conferred by proviso to Article

309 of the Constitution of India, the Governor of Bihar is pleased to make following Rules

to regulate the appointment and service-conditions in the Food Safety Service under the

Health Department:-

Chapter-1: PRELIMINARY

Short title, extent & commencement .– (1) These Rules may be called as the

“Bihar Food Safety Service Rules, 2014”.

It shall extend to the whole of the state of Bihar.

It shall come into force at once.

Definitions. – Unless otherwise required in the subject or context, in these Rules –

(i)

‘Government’ means Bihar State Government;

(ii)

‘Department’ means Health Department;

(iii)

‘Commission’ means Bihar Public Service Commission;

(iv)

‘Appointing Authority’ means Governor of Bihar;

(v)

‘Service’ means Bihar Food Safety Service;

(vi)

‘Cadre’ means Food Safety Cadre and Food Analyst Cadre;

(vii)

‘Act’ means The Food Safety and Standards Act, 2006 (Central Act 34 of

2006);

(viii) ‘Rules’ means Food Safety and Standards Rules, 2011;

‘Appendix’ means appendix appended to these Rules;

(x)

‘Central Examination Committee’ means the Central Examination

Committee under the Board of Revenue, Bihar; and

(xi)

‘Commissioner of Food Safety’ means the Commissioner of Food Safety as

defined under the Act.

Constitution of Service. – (1) The Bihar Food Safety Service shall be a state level

service. In this service, there will be two cadres, namely -

(a)

Food Safety Cadre, and

(b)

Food Analyst Cadre.

(2)

In this service, the number of categorywise posts in each cadre shall be as

many as are sanctioned by the government, from time to time.

Chain of posts of the Service .– Different categories and chain of posts in each

cadre of this service shall be according to Appendix-1.

Chapter 2 : RECRUITMENT

Recruitment .– (1) The appointment in this service shall be made by direct

recruitment to the basic category posts (Food Safety Officer and Food Analyst) on

the basis of recommendation of the Commission.

(2) (a) For direct recruitment in both the cadres of the Bihar Food Safety Service,

minimum educational qualification shall be as specified in Appendix -1.

(b)

For direct recruitment, minimum age-limit shall be 21 years and the

maximum age – limit shall be the same as may be determined reservation

categorywise, from time to time, by the Government. (General Administration

Department). 1^st August of the concerned year shall be deemed to be the cut off date

for determination of age.

Procedure for recruitment .– (1) The Department, after calculating vacancy on the

basis of position as on 1^st April of the year and getting roster cleared, shall send

reservation categorywise requisition to the Commission latest by 30^th April.

(2)

In light of requisition, the Commission shall invite applications by advertising

vacancies and shall prepare merit list on the basis of following :–

(a)

Food Safety Officer –

(i) For marks obtained in Bachelor or equivalent

Degree in the subjects mentioned in Qualification

column of Appendix-1

80 Marks

(ii) For Interview

20 Marks

Total -

100 Marks

Note: The marks to be given to a candidate for bachelor or equivalent degree shall be

determined by multiplying percentage of marks obtained in the examination of

aforesaid course by multiple of 0.8. For example, if a candidate has obtained 50%

marks, he will be given 50% x 0.8 = 40 marks.

(b)

Food Analyst –

(i) For marks obtained in Bachelor or equivalent

Degree in the subjects mentioned in the Qualification

column of Appendix-1

80 Marks

(ii) For Interview

20 Marks

Total -

100 Marks

After preparing merit list on the basis of sub-rule (2), preliminary scrutiny of the

certificates and medical checkup shall be conducted by the Commission with the co-

operation of the Department, and thereafter, reservation category wise final

recommendation, in accordance with the requisitioned vacancies, shall be sent to the

Department. At the level of Department also, antecedents of candidates shall be

caused to be verified after scrutiny of certificates.

After recommendation of the Commission, compliance of instructions issued by the

Government from time to time, with respect to procedure of appointment, shall be

necessary.

Chapter 3: PROBATION / DEPARTMENTAL EXAMINATION / CONFIRMATION

Probation Period.– After appointment, the probation period will be of two years. In

case, the service during probation period is not found satisfactory, the probation

period will be extended for one year. If the service is not found satisfactory in

extended period also, then the Government may terminate service of such Food

Safety Officer / Food Analyst.

Training .– (1) During probation period, it will be necessary to get training and

treasury training under an institute or institution as specified by the Commissioner of

Food Safety.

(2)

Persons appointed as Food Safety Officer / Food Analyst shall have to undergo all

specialized in - service training programmes as specified by the Commissioner of

Food Safety, from time to time.

Departmental Examination .– In addition to satisfactorily completing probation

period and successfully completing training (including treasury training), it will be

necessary to pass in the Departmental Examination also. The syllabus of

Departmental Examination will be determined by the Department, in consultation

with the Central Examination Committee.

10.

Confirmation .– After satisfactory completion of probation period, successful

completion of training and passing of Departmental Examination, a Food Safety

Officer / Food Analyst may be confirmed in the service.

11.

Seniority. – The inter-se- seniority of Food Safety Officer / Food Analyst shall be

determined according to the merit list prepared by the Commission.

Chapter 4: PROMOTION

12.

Promotion .– (1) Subject to availability of vacancy, Food Safety Officer / Food

Analyst confirmed in service may be considered to be promoted in the chain of posts

mentioned in Appendix-1, according to merit-cum seniority.

(2)

Compliance of instructions issued by the Government regarding KALAWADHI for

promotion, from time to time, shall be necessary.

(3)

Compliance of instructions issued by the Government, from time to time, with

respect to promotion and Character Roll / P.A.R. allegation / departmental

proceeding / criminal proceeding, etc. shall be required at the time of consideration

of promotion.

13.

Departmental Promotion Committee. – Promotions may be considered on the

basis of recommendations of the Departmental Promotion Committee. The structure

of the Departmental Promotion Committee will be the same as may be determined

by the Government for Service Departments, from time to time:

Provided that the meeting of the Departmental Promotion Committee to

consider promotion in the maximum grade – pay shall be presided over by the

Chairman or any Member of the Commission.

Chapter 5: MISCELLANEOUS

14.

Reservation .– Compliance of Reservation Act of the Government and reservation-

roster for direct recruitment and promotion, issued by the Government, from time to

time, shall be necessary.

15.

The chain of posts mentioned in Appendix-1 shall be effective only after approval of

the Government. If, in course of consideration of approval, any modification or

amendment is made by the Government in the chain of posts mentioned in

Appendix-1, then the Appendix-1 shall be deemed to be modified or amended

accordingly and such modified / amended chain of posts shall be deemed to be the

part of these Rules.

16.

The personnels already appointed / promoted and working on the posts of both the

cadres of this service, mentioned in Appendix-1, before coming into force of these

Rules, shall be deemed to be automatically included in this cadre.

17.

For the subjects which have not been provided in these Rules, provisions of

concerned Codes / Rules / Resolutions / Instructions of the Government shall apply.

18.

Removal of difficulties .– If any difficulty arises in implementation of provision of

these Rules, the Department may, in consultation with the Law Department remove

any such difficulty by general/special order which is not inconsistent with the

provisions of these Rules.

19.

Interpretation .– If any doubt arises with respect to interpretation of any provision

of these Rules, the Department may take a decision after consultation with the Law

Department, and it will be final decision.

20.

Repeal & Savings .– (1) The Rules, Resolutions, Instructions, Orders, etc. issued

earlier, from time to time, by the Department, with respect to this cadre, are hereby

repealed with effect from the date of coming into force of these Rules.

(2)

Notwithstanding such repeal, any work done or any action taken under such Rules,

Resolutions, Instructions, Orders, etc. shall be deemed to be done or taken under

these Rules, as it these Rules were in force on the date on which such a work was

done or such an action was taken.
