Article 309 of the Constitution of The India the Governor of Bihar is hereby pleased to

make the following Rules to regulate the recruitment and service Condition to the Post of

Sub- Inspector Excise in the office of Excise situated in the State:-

1. Short title, extent and commencement.—(1) These Rules may be called the “Bihar Sub-

Inspector Excise Cadre Rules, 2014.”

(2)

It shall extend to the whole of the State of Bihar.

(3)

It shall come into force with immediate effect.

Definition. —In these Rules, unless anything repugnant to the context –

(i)

“Government” means the government of Bihar;

(ii)

“Appointing Authority” means Excise

Commissioner, Bihar;

(iii)

“Controlling Authority” means Excise Commissioner, Bihar;

(iv)

“Department” means Registration, Excise and Prohibition Department as

specified in the Executive Rules;

(v)

"Recruitment Agency” means Bihar Staff Selection Commission or any other

Agency selected by Registration, Excise and Prohibition Department, and

(vi)

“Sub-Inspector Excise Cadre” means the posts of Sub-Inspector Excise in the

offices of Excise in Bihar.

Cadre constitution. —In this cadre there will be the posts of Sub-Inspector Excise.

The number of the Posts in this cadre and their total number shall be such as it has

been sanctioned/determined by the government and as it may be notified by the

government in future.

4. Recruitment. —(1) Against total strength, 50 percent posts by direct recruitment on the

30 percent posts by promotion of Assistant sub-Inspector Excise grade, and

on the remaining 20 percent posts by re-employing Ex-military namely

Junior Commissioned officers/ Non-Commissioned officers will be filled .

On the said 20% posts prescribed for appointment shall be made directly by

inviting applications from Ex-Military Junior Commissioned officers/Non-

Commissioned officers through the Recruitment Agency. The maximum age-

limit for appointment in this grade shall be 50.

(3)

In case of non-availability of the requisite candidates as against of the said 20

percent posts fixed in any calendar year for Ex-Military as mentioned in Rule

4 (1) those posts may be filled in by the candidates of direct recruitment in

that calendar year.

5. Qualification.—(1) Educational Qualification.- Educational qualification of the

Candidates for direct recruitment shall be graduate passed from any

Age limit.- Minimum age of the candidate for direct recruitment shall not be

less than 21 years, and the maximum age shall be the same as it may be

determined by the General Administration Department of the State

Government from time to time.

(3)

Calculation of candidates of reservation category belonging to other states

shall be made as the candidates of general category and accordingly the age-

limit for them shall be such as it is applicable to the candidates of general

category.

Ground and method of appointment. —There shall be two sources of appointment

to the posts of sub-Inspector Excise:-

(1)

Direct recruitment through the Commission or any other Recruitment

Agency selected by the commission or the Department;-

(a)

The 50 percent posts of sub-Inspector Excise out of the posts of sub-

inspector Excise and the 20 percent posts reserved for Ex-military as

created and sanctioned by the state government from time to time

shall be filled by direct recruitment. The direct recruitment on these

posts, shall be made on the recommendation of the Recruitment

Agency. After receiving requisition from Registration, Excise and

Prohibition Department, The Recruitment Agency shall publish an

advertisement as per prescribed procedure.

(b) Procedure for direct recruitment.—The following stages will be for the

procedure of direct recruitment.

(i)

First Stage.- First of all, A written examination shall be

conducted by the Recruitment Agency.

(ii)

Second Stage.- Physical Test shall be made by the Board

constituted by the government.

(iii)

Third Stage.- Medical Examination shall be made by any

Medical Institution as directed by Excise commissioner,

Bihar, or by any Medical Team constituted by him. It will be

compulsory to keep a female doctor in the medical team for

female candidates.

(iv)

Final selection shall be made on the basis of written

examination, physical fitness test and medical examination.

(v)

The detail instructions for direct recruitment, physical fitness

test and medical test are mentioned in Appendix “A”.

(c)

A list of five times candidates more than the communicated vacancies

category wise shall be prepared by the Agency for the test of physical

fitness Test.

(d)

Physical fitness test shall be only qualifying and the candidates to be

successful in the physical fitness test shall be recommended for

appointment on the basis of merit list of the Written Examination.

(e)

Out of the list of the candidates five times more of the vacancies if the

candidates as per the number of vacancies do not succeed in physical

Fitness Test or Medical Test, then a list of candidates five times of the

remaining vacancies shall be re-prepared by the Recruitment Agency

and the above procedure shall be followed again.

(f)

Medical Test . Candidates qualifying in the physical fitness test shall

be subject to the medical test. The assessment of his/her suitability

shall be made according to the criterion mentioned in Appendix “A”

and the appointment shall be made only after the candidates being

physical fit.

(g)

After considering the report of medical test, the Appointing Authority

will have power to accept or reject the candidature of any of

candidates of the recommended list of Recruitment Agency.

Promotion from Assistant sub-Inspector Excise.

(1)

Promotion to the 30 percent posts of sub-Inspector Excise cadre shall be

given to Assistant Sub-Inspector Excise cadre on the recommendation of the

Departmental Promotion Committee constituted by the Appointing

Authority.

(2)

Minimum qualifying service or kalawadhi for such promotion shall be the

same as it may be determined by the General Administration Department

from time to time.

(3)

Minimum educational qualification for promotion from the post of Assistant

sub-Inspector Excise shall be intermediate pass, and seniority-cum eligibility.

Reservation. —The promotions of the Bihar Reservation Act applicable from time

to time, shall apply to all recruitments and promotions and the benefit of reservation

in recruitments and promotions shall be admissible only to the permanent residents

of the Bihar States.

Probation period. —The probation period for the newly-appointed staff shall be of

two years from the date of the first appointment to this post. On not found

satisfactory service during the probation period, the probation period may be

extended to one year. Such official may be removed from service on not found

satisfactory service even during the extended probation-period.

10.

Training. —All the candidates appointed by direct recruitment shall be required to

undergo such training or to pass such departmental examination during the probation

period it may be prescribed by the Cadre Controlling Authority from time to time.

11.

Confirmation. —The services shall be confirmed by the Excise Commissioner,

Bihar on satisfactorily completion of the probation period and after passing the

Departmental Examination.

12.

Pay Scale. —The pay scale as prescribed by the state Government from time to time

for the notified cadre and accordingly other allowances shall be admissible.

13.

Seniority. —

(1)

The seniority of sub-Inspector Excise appointed by direct recruitment shall

be determined on the basis of the merit list issued by the Recruitment

Agency.

(2)

The seniority of promoted Sub-Inspector Excise shall be determined

according to the provisions prescribed by the General Administration

Department.

14.

Status of Cadre. —This Cadre, according to the classification issued by the State

Government from time to time shall be of Group ‘C’ or other wise. The Cadre shall

be state level.

15.

Discipline, Appeal and Penalty.—The provisions of the Bihar Government Servant

(classification, control and Appeal) Rules 2005 (as amended from time to time) and

the Bihar Excise Manual shall apply to all the members of this Cadre.

16.

Removal of difficulties.—The Excise Commissioner, Bihar, with approval of

Government, may remove any difficulty arising in the implementation of any

provision or out of these Rules is made enforceable.

17.

Repeal and Savings:—

(1)

The Sub-Inspector Excise Recruitment Rules, 1954 and provisions of the

other all rules/resolutions/circulars/orders are hereby repealed.

(2)

Notwithstanding such repeal, anything done or any action taken under the

said Rules/ Resolutions/ Circulars and orders shall be deemed to be done or

taken under these Rules as if these rules come in to force when such thing

was done or such action was taken.

APPENDIX – A

[Please see rules 6 (1) (b) (v) and (f)]

For appointment to the post of Sub-Inspector Excise, the Recruitment Agency shall

hold an examination in which a list shall be prepared as per order of merit in proportion to

those vacancies and the Recruitment Agency shall send its recommendation of the

successful Candidates of Sub-Inspector Excise.

The Recruitment Agency, after conducting such examination, shall prepare a list of

sub-Inspectors of Excise reservation wise on basis of candidature and shall send the list to

the Board constituted for physical fitness test.

Written Examination.—

(i)

50 percent posts of direct recruitment for Sub-Inspector Excise cadre and 20

percent posts of direct recruitment reserved for Ex-military shall be filled on

the basis of the Written Examination conducted by the Recruitment Agency,

from time to time.

(ii)

The number and nature of questions and the Period of time shall be

determined by the Recruitment Agency.

(iii)

The Recruitment Agency shall prepare a list of the successful candidates five

times more than the notified category wise vacancies on basis of the written

examination and shall send the list to the Excise Commissioner, Bihar for the

physical test.

(iv)

30 percent vacant posts of the Sub-Inspector Excise cadre shall be filled from

seniority-cum-ability and on the recommendation of the Departmental

Promotion Committee.

Physical Fitness.—

(1)

Physical fitness Test shall be taken by the Board constituted for candidates

recommended category wise by the Recruitment Agency against the notified

vacancies. It is essential for the candidates to be fit as per prescribed physical

norms.

(2)

The norms of the test for physical fitness before the board.-

(i)

The candidates should be fit both physically and mentally and they

should be free from such disease or infirmity by which there may be

impediment in performing their duty efficiently.

(ii)

They should not have weak body construction and obesity, symptoms

of knocking knees and flat – feet.

(iii)

The height of the male candidates (for General Class, Backward Class

and Extremely Backward Class) should be minimum 165 c.m. and for

scheduled castes/ scheduled tribes minimum 160 c.m.

(iv)

For female candidates, the height and the weight should be minimum

160 c.m. and minimum 48 k.g respectively.

(v)

It is advised to the candidates in their interest that they should get

themselves inceptive Medical fitness test on their own capacity for

fungous infection of earfilth, eye refraction defect, skin and etc before

reporting for the test of physical fitness.

(vi)

The chest should be well developed and the minimum measurement

should be 81 c.m. and for scheduled castes/ scheduled tribes

candidates it should be 79 c.m. After full breathing the measurement

of the extended chest should be minimum 86 c.m. and for scheduled

castes/ scheduled tribes candidates it should be minimum 84 c.m. The

measurement shall be made by a measuring tape in such a manner

that the tape’s lower portion should touch the front nipple and the

tape’s upper portion should touch the lower angle of the back

shoulder blade.

(vii)

Running - 1 mile within 6 minutes

(viii) High Jump - Minimum 4 feet (for all male candidates)

(ix)

Long jump - minimum 12 feet (for all male candidates)

(x)

Shot put 16 pounds - minimum 16 feet (for all male candidate)

Physical fitness test shall be only qualifying test.

Medical Test .—

(a)

For direct recruitment

(i)

Candidates should not have symptom of knocking knees and flat feet.

(ii)

Candidates should be able to hear in a normal way and candidates

should be capable to hear aloud whispering by each ear from the

distance of 6'10" in a peaceful room.

(iii)

If any candidate suffers from hernia or hydrocele problem, the

candidature shall be considered only after surgery.

(iv)

Candidates should not have any of serious eye defects. The eye -

vision with or without glasses should be 6/6. There should not be

nyctalopia or colour blindness.

(b) Norms of medical test for the appointment from Ex-military.- (i) Candidates

should not have symptom of knocking knees and flat feet.

(ii)

candidates should be able to hear in a normal way and there should

not be compelling to use hearing aid.

(iii)

If any candidate suffers from hernia or hydrocele problem, the

candidature shall be considered only after surgery.

(iv)

Candidates should not have any of serious eye defects. The eyes

vision with or without glasses should be 6/6. There should not be

nyctalopia or colour blindness.

Provisions regarding Ex-military candidate.—

"Ex-military" means the person who has served as combatant or non-combatant to

any rank in a regular army, navy and air force of the Union of India; but it does not

include the persons who have served in defence security care, General Reserve

Engineering Force, Public Auxiliary Army and Paramilitary forces; and

(1)

Who have got retirement after drawing pension; or

(2)

Who has been relieved from such a service on the basis of health norms

applicable to military service or under such circumstances beyond own

control; and he / she has been provided medical or infirmity pension; or

(3)

Who has been relieved from service in consequence of reduced service being

retrenched otherwise; than on his/her request or

(4)

Who has been relieved from a service on his / her own request or due to bad

behaviour or improficiency or discharge otherwise completing the period of

service conditions; and who has been granted gratuity and it includes the

personnel of lower categories of territorial army

(i)

Pension holders for persistant combined service,

(ii)

Infirmity Pensioners on the basis of military service norms ; and

(iii)

Gallantary Award Winner

(5)

There will be compulsory for Ex-military only to appear in the medical test

and they shall be exempted from the test for physical fitness test.

(6)

In case of arising any kind of controversy, there shall be admissibility of the

claims regarding appointment only under the provisions of Ex-military

Re-employment Rules 1979.
