the following Rules for regulating and other conditions of service of the clerical cadre the

field offices of the settlement and chakbandi offices under Land Records and Survey and

Chakbandi Directorate :-

Bihar Revenue Clerical Cadre (Recruitment and Condition of Service) Rules, 2014

Short title, extent and commencement - (1) These rules may be called

the

Bihar Revenue Department Clerical Cadre (Recruitment and condition of service) Rules,

2014;

(2)

It shall extend to all settlement and Chakbandi field offices/Revenue

(Survey) training offices in the entire State of Bihar;

(3)

It shall come into force with immediate effect;

Definition - In these rules unless otherwise requires in the context,

(i)

"Cadre" means the clerical cadre of field offices of settlement and Chakbandi offices

and revenue (Survey) training offices;

(ii)

"State Government" means The State Government of Bihar;

(iii)

"Appointing Authority" means Director, Land Records and Survey for settlement

and revenue (survey) training office's clerical cadre and director chakbandi for

Chakbandi offices clerical cadre;

(iv)

"Cadre Controlling Authority" means Director, Land Records and Survey for

settlement and revenue (survey) training offices, and Director, Chakbandi for

Chakbandi offices;

(v)

"Department" means Revenue and Land Reforms Department;

(vi)

"Commission" means Bihar Staff Selection Commission;

(vii)

"Appointment of compassionate ground" means appointment of any one of the

dependents of the government servant in case death during duty as per relevant

circulars/instruction;

(viii) "Departmental promotion committee" means The Departmental Promotion

Committee notified by the department;

Cadre Structure:- (1) There will be two sub Cadre in clerical cadre which structure

will be as follows:-

(i)

Settlement and Revenue (Survey) training offices clerical cadre:-

Cadre strength:-

The cadre strength and scale of lower division clerk, upper division clerk,

head Clerk and office superintendent will be the same as it may be notified by

the state government from time to time

(2)

Constitution of Service Cadre:-(i) The Bihar Settlement & Revenue/

Chackbandi Clerical Cadre will be of State level.

(ii)

The persons recruited and working in the said category prior to

the notification of these rules will be treated included in this cadre.

(iii)

According to Sankalp No. 7788 dated 02-12-2006 of finance

department Moharirs appointed and working before dated 20-

12-2000 will be categorised as Upper Division Clerk and rest will be

categorised as Lower Division Clerk.

(iv)

All posts of Copiest/Peshkar/Comparing Clerk /Head Peshkar/

Munsrim/Abhilekhpal -cum- siristedar/Surveyor Munsrim/Survey

Inspector/ Head Survey Inspector/Typist/Steno Typist sanctioned

before these Rules shall be merged in clerical cadre, which shall be

categorised as lower/upper division clerk in accordance with scale.

Qualification:- The minimum educational qualification shall be intermediate

(10+2) equivalent to it with knowledge of computer operation and computer

typing

for

appointment at lower division clerk post.

Recruitment:- (1) 85% posts of Lower Division Clerk shall be filled up through

direct recruitment and rest 15% posts shall be filled up from amongst

the eligible of

appointment of clerical post out of on seniority basis of Group "D" employees 10% of 85%

posts for direct recruitment, shall be reserved for

the appointment on compassionate

ground.

(2)

All recruitment shall be made from the category of Lower Division Clerk on

the recommendation of the commission.

(3)

Appointment by Promotion:- Appointing authority shall prepare gradation

list of those group "D" staff who are eligible for the post of lower division

clerical on seniority basis.

Reservation:- Provision of reservation/roaster as notified from time to time by the

state Government shall apply in the recruitment and promotion.

Probation Period:- Probation period for clerical cadre will be of two years.

Training:- (i) All employees will be the provided training by the department &

authorized training institute under the determined training programme and on

not holding training by the authorized training institute, on time or according to

determined programme the promotion will not obstructed.

(ii)

Passing in Hindi Noting and Drafting examination conducted by The

Rajbhasha Department is essential.

Departmental Examination and syllabus:—For clerical post it will be compulsory

to pass Hindi noting drafting & accounts conducted by Board of Revenue along with

computer efficiency test.

10.

Confirmation:- A probationer will be confirmed after satisfactory completion of

his probation period and passing the Examination of Hindi noting, drafting, accounts

and computer efficiency test .

11.

Determination of Seniority:- Inter-se Seniority of the clerical cadre will be

determined accordance to the merit list as determined by the commission (Ayog),

but the inter-se seniority determined prior to the commencement of these rules will

remain unchangeable.

Provided that the person appointed on the basis of compassionate ground

shall be junior to such persons who have been appointed in the concerned year on

the basis of Competitive Examination but the person appointed by promotion in any

year will be senior to the persons appointed by the Competitive Examination in the

concerned year.

12.

Promotion:- Promotion from basic category to higher category in the cadre

may be given on completion of kalawadhi determined from time to time by the

General Administration Department of Bihar and on the recommendation of

Departmental Promotion Committee constituted by the department.

13.

Residuary matters:-In respect of such to matters which are not specifically covered

by these Rules, the members of the cadres shall be governed by the Rules, Regulations or

Orders applicable to the officers/ employees of appropriate level.

14.

Removal of Difficulties:- The department may issue such general or special

directions in consultation with the Law Department from time to time, to remove the

difficulty coming in the implementation of any of the provisions of this Rule. which is

necessary and not inconsistent with the provision of these Rules.

15.

Interpretation:-Where any doubt arises as to the interpretation of any of the

provision of these Rules, the matter shall be decided by the Department in consultation with

Law Department an such, decision will be final.

16.

Repeal and saving:- (1) All resolution and instruction issued earlier with respect to

this cadre are hereby repealed

(2)

Not with standing such repeal, anything done or any action taken under such

resolution, instruction shall be deemed to done or taken in under these Rules

as if these rules were in force on the day on which such thing or action was

done or taken.
