conferred under proviso to Article 309 of the Constitution of India, The Governor of Bihar

is pleased to make the following Rules for regulating the recruitment and other conditions of

service of the Draftsmen of the field offices of the Settlement and Chakbandi under Land

Records and Survey and Chakbandi directorate :-

Bihar Revenue Draftsmen Cadre (Recruitment and Conditions of Service) Rules, 2014

Short title, extent and commencement.- (1)These Rules may be called as "Bihar

revenue Draftsmen Cadre (Recruitment and Conditions of Services) Rules, 2014.

It shall extend to all Settlement and Chakbandi field offices/Revenue

(Survey) training offices in the entire state of Bihar.

(3)

It shall come into force with immediate effect.

Definitions. - In these Rules unless otherwise requires in the context

(i)

"Cadre" means the Draftsmen Cadre of field offices of settlement and Chakbandi

and Revenue (Survey) training offices;

(ii)

"State Government" means The State Government of Bihar;

(iii)

"Appointing Authority" means Director, Land records and Survey for Settlement and

revenue (Survey) training offices draftsmen cadre, and Director, Chakbandi for

Chakbandi office's draftsmen, cadre;

(iv)

"Cadre Controlling Authority" means Director, Land Records and Survey for the

settlement and revenue (Survey) training offices, and Director, Chakbandi for

Chakbandi office's;

(v)

"Department" means Revenue and Land Reforms Department;

(vi)

"Commission" means Bihar Staff Selection Commission;

(vii)

"Appointment on compassionate ground" means appointment of any one of the

dependents of the government servant in case of death during duty, as per relevant

circular/instructions;

(viii) "Department Promotion Committee" means The Departmental of Promotion

Committee notified by the department;

Cadre Structure.- (1) There will be two sub-cadres in the cadre of draftsmen, the

structure of which will be as follows:-

(i)

Draftsmen Cadre for settlement and revenue (Survey) training offices.

The Cadre strength of draftsmen, senior Draftsmen and Head Draftsmen and

their pay scale will be the same as it may be notified by the state government from

time to time.

(2)

Constitution of Service Cadre:- (i) The Bihar Settlement & Revenue/

Chakbandi Draftsmen Cadre will be of state level.

(ii)

The persons recruited and working in the said category prior to the

notification of these rules will be treated included in this Cadre.

Qualifications.- The minimum educational qualification for Draftsmen will be

intermediate science (10+2) pass or equivalent and Diploma in Draftsmanship from

a govt. recognized I.T.I with Knowledge of computer application.

Recruitment.- Direct recruitment in the Draftsmen Cadre will be made on the

recommendation of The Bihar Staff Selection Commission by Director, Land

Records & Survey for Settlement and Revenue (Survey) for training offices by The

Director Chakbandi, Bihar Patna for Chakbandi Offices.

Reservation.- Provisions of reservation & roaster as notified from time to time by

the State Government shall apply in the recruitment and promotion.

Probation Period:- Probation period for draftsmen will be of two years.

Training.- (i) All employees will be provided training by the department and

authorised training institute under the determined training programme, and on not

holding training by authorized training institutes on time or according to determind

programme, the promotion will not be obstructed.

(ii)

Passing in the Hindi Noting and Drafting Exam conducted by the

Rajbhasha Department is essential.

For draftsmen it will be compulsory to pass the computer efficiency test.

10.

Confirmation.- A probationer will be confirmed after satisfactory completion of his

probation period and passing the examination of Hindi Noting Drafting and as also

the computer efficiency test.

11.

Determination of Seniority.- Inter-se Seniority of draftsmen will be determined

accordance to the merit-list as determined by the Commission (Ayog), but the inter-

se seniority determined prior to the commencement of these Rules will remain

unchangable.

Provided that the person appointed on the compassionate ground shall be

junior to such persons who have been appointed in the concerned year on the basis

of Competition Examination, but the person appointed by promotion in any year will

be senior to the persons appointed by the competitive examination in the concerned

year.

12.

Promotion.- Promotion from basic category to a higher category in the cadre may be

given on completion of Kalawadhi determined from time to time by the General

Administrative Department of Bihar and on the recommendation of Departmental

Promotion Committee constituted by the department.

13.

Residuary Matters.- In respect of such matters which are not specifically covered

by these rules, the members of this Cadre shall be governed by the Rules and

regulations or orders applicable to the officers and employees at appropriate level.

14.

Removal of Difficulties.- The department may issue such general or special

directions in consultation with the Law Department from time to time, to remove the

difficulty coming in the implementation of any of the provisions of this Rule. which

is necessary and not inconsistent with the provision of these Rules.

15.

Interpretation.- Where any doubt arises as to the interpretation of any of the

provision of these Rules, the matter shall be decided by the Department in

consultation with Law Department and such decision will be final.

16.

Repeal and Saving.- (1) All resolution and instructions issued earlier with respect to

this cadre are hereby repealed.

(2)

Not with standing such repeal, anything done or any action taken under

such resolution, instruction shall be deemed to done or taken under these

Rules as it these Rules were in force on the day on which such thing or

action was done or taken.
