BIHAR STATE URBAN AREAS (FOR HOMESTEADLESS FAMILIES OF SCHEDULED CASTES/

SCHEDULED TRIBES/ HOMESTEAD LAND POLICY, 2014.

The policy decision to make homestead land available to the homestead landless

families of scheduled castes and scheduled tribes is already effective in the rural areas of

the state. The homestead-land less on homeless scheduled casts/ scheduled tribes families

residing in urban areas of the state are facing acute problem due to non-formulation of

corresponding policy to provide homestead land or home. The State government is

congnisant of this fact that land/ home is a basic necessity and it is related to the dignity

and identity of mankind.

Now, therefore, after proper consideration on this subject the state government

determined the following policy to provide homestead land or home to homestead

landless or home families schedules castes/ schedule tribes residing in urban areas. Bihar

state urban area (for landless families of scheduled castes/ scheduled tribes). Homestead

land policy 2014.

1. SURVEY- The State government shall cause from time to time survey of the

homestead less homeless of families SC/ST residing in the urban areas of the state.

This survey shall reveal the number of homestead less/ Homeless families of

scheduled castes/ scheduled tribes residing in urban areas of the state, the nature

of the residential land and its area.

The Gair-Mazarua malik/ Khas mahal and Kaisar-e-hind lands (which are in

possession of the state government) available in urban areas and suitable for

residential purposes shall be identified in survey. The survey shall be conducted

under the supervision of the District Magistrates for which fund will be made

available by Revenue and Land Reform Department.

2. FAMILY - 'Family' means Husband-wife and minor children and old age- parents. It

also includes destitute widow/ Grass widow and unmarried single women family.

3. ELIGIBILITY- The homestead landless and homeless scheduled caste/ scheduled

tribes families residing in the urban areas of the state shall be included in the said

survey only on fulfilling the following conditions:-

(i)

Who is residing in urban area for at least 10 year or more;

(ii)

No member of his/her family possesses homestead land or home anywhere

in the state or outside the state.

(iii)

Whose name is included in urban BPL list.

4. PROOF FOR ELIGIBILITY- (i) The concerned family shall has to produce an affidavit

of this intent that it does not have homestead land or home as a proof of the fact

that the no member of the family has homestead land or home either within the

state or out of the state.

On finding the affidavit untrue in future, the land or the home given to such

family shall be taken back and criminal case shall be lodged against the family.

(ii)

They shall have to make available proof/ certificate after obtaining from

competent authority as the residential certificate and it shall be

compulsorily to have with them any other proof to this affect such as - entry

in the electoral roll/ electricity bill/ ration card/ certificate from the school

of the children etc. "competent authority" means, chief executive officer of

Municipal corporation/ Municipality/ Nagar Panchayat as the case may be.

5. ARRANGEMENT FOR HOMESTEAD LAND/ HOME-

(i)

The homestead less surveyed families, and which are settled on the Gair

Mazarua Malik/ Kaiser-e-hind land (which are in possession of Bihar

government)/ Khasmahal land, shall be allotted the land in their possession

on perpetual lease but the maximum limit for the land allotted on perpetual

lease shall not exceed 30 square meter.

(ii)

The action to allot the Gair Mazarua malik/ Kaise-e-hind land (Which are in

possession of Bihar Government/ Khas Mahal land as per above mentioned

sub-para(i) at other places in the same urban areas to the homestead less

surveyed families which are settled on Gair Mazarua Aam land but the

consent of the families on the land, so allotted, shall be necessary.

(iii)

If allotted suitable land as per the procedures mentioned above, is not

available 5 decimal land shall be purchased on MVR in the Panchayat in

proximity to the concerned urban areas and made available to the families

settled on the Gair Mazarua Aam land, but the consent of the families shall

be necessary in respect of the land to be purchased.

(iv)

The land allotted as per the above paras shall not be transferable to other

person. It shall be inheritable.

(v)

The agreement for perpetual lease shall be free of cost but symbolic salami

and rent shall be recovered one time at the time of agreement at the rate of

`1 per annum for 30 years.

(vi)

The Revenue and Land Reform Department shall, on the basis of availability,

make government land available to the Urban Development and Housing

Department for providing homes to the urban homestead less scheduled

castes/ schedule tribes families.

(vii)

The power to execute perpetual lease for homestead land or to purchase

land shall be vested in the District Magistrate. The District Magistrate may

delegate his powers to Additional Collector/ Sub-Divisional Officer/ Deputy

Collector land reform/ Circle officer as per requirement.

6. MISCELLANEOUS-

The Revenue and Land Reform Department shall issued direction as required for

the execution of this policy and the powers to remove difficulties in the execution

shall be vested in the said Department.

7. The policy shall come into effect from the date of issue of the resolutions.
