Section 94(1) read with section 146 of the Bihar Panchayat Raj Act, 2006 (Bihar Act 6 of

2006), the Governor of Bihar is pleased to make the following Rules –

CONDITIONS AND DUTIES) RULES, 2014 .

Short title, extent and commencement :-

(1) These Rules may be called the Bihar Gram Katchahry Secretary (Employment,

Service Conditions and Duties) Rules, 2014 ;

(2) It shall extend to the whole of the State of Bihar ;

(3) It shall come into force from the date of issue of notification .

Definitions – In these Rules, unless otherwise required in the context :-

(a) ''Act'' means the Bihar Panchayat Raj Act, 2006 (Bihar Act 6 of 2006) ;

(b) ''Government'' means the State Government of Bihar ;

(c) ''District Officer'' means the District Magistrate of a district appointed by the

State Government ;

(d) ''Commissioner'' means Divisional Commissioner ;

(e) ''Gram Katchahry'' means the Gram Katchahry established under sub-section

(1) of section 90 of the Bihar Panchayat Raj Act, 2006 ;

(f) ''Sarpanch'' means the elected Sarpanch of the Gram Katchahry under section

93(1) of the Bihar Panchayat Act, 2006 ;

(g) ''Panch of the Gram Katchahry'' means the elected Panch of a Gram Katchahry;

(h) ''Sub-Divisional Magistrate'' means a Sub-Divisional Magistrate of a Sub-

Division appointed by the State Government ;

(i) ''Block Development Officer'' means an officer appointed as such by the State

Government ;

(j) ''Suit'' means a suit triable by a judicial bench of Gram Katchahry ;

(k) ''Block Panchayat Raj Officer'' means an officer appointed to this post in the

Block ;

(l) All the words and terms used but not defined in these Rules shall have the same

meaning as are assigned to them in the Act.

Employment of Secretary, Gram Katchahry :- A Secretary may be employed on

contract basis for each Gram Katchahry for execution of functions and discharge of

responsibilities as assigned in Rule 11 of these Rules.

On being satisfactory service as Secretary, Gram Katchahry, the concerned

employee may be continued to be in service till the age limit determined by the General

Administration Department, Government of Bihar for the employment on contract basis,

otherwise he may be removed by action under Rule 12 of these Rules.

Reservation – (1) The rules applied, from time to time, by the General

Administration Department, Government of Bihar for reservation at district level will also

be applicable for employment of Secretary, Gram Katchahry.

(2)

As far as practicable, fifty per cent women candidates will be employed to the

earmarked posts of each reserved category. In case of non-availability of women candidates,

the said post may be filled by male candidates of the same reservation category.

Qualifications for employment – (1) Educational Qualification – Educational

qualification will be intermediate (10+2) pass or equivalent qualification declared by the

State Government;

Provided that the bachelor degree holders or holders of equivalent qualification

declared by the State Government shall be given weightage in determination in order of

merit.

(2) Age – The minimum and maximum age as on first August of the calendar year

in which the appointment is being made, will be the same as determined by the General

Administration Department, Government of Bihar for the appointment to the post of class

three employees;

Provided that the maximum age limit for a candidate who has previously worked on

the post of Secretary, Gram Katchahry shall be fifty five years.

(3) The age limit determined to continue in service by appointment on contract by

the General Administration Department, Government of Bihar, from time to time, shall also

be effective for the employment to the post of Secretary, Gram Katchahry .

(4) Work experience – Any type of previous work experience shall not be

mandatory;

Provided that weightage shall be given in determination in order of merit, for the

work experience on the post of Secretary, Gram Katchahry.

Procedure of employment – (1) The details of reserved categorywise vacancies of

all Secretary, Gram Katchahry in the district on basis of the roster applicable at district

level, conditions of employment and qualification for employment shall be widely

publicized. It shall also be published on notice boards of the offices of the concerned

Panchayat Samiti, concerned Gram Panchayat, concerned Gram Katchahry and Zila

Parishad of the district .

(2) With objectives of openness, transparency and proper maintenance of records,

only online applications in prescribed form (Schedule – 1) shall be obtained in the office of

the Block Development Officer in the manner prescribed by the Panchayati Raj Department.

(3) A panel for employment of new Secretary, Gram Katchahry shall be prepared on

the basis of merit- marks by the Block Development Officer or the officer nominated by him

(4) 2.5 % marks shall be admissible for every complete year of service spent as

Secretary, Gram Katchahry . If after computation of every complete years, the balance

period comes to more than six months, it shall be treated as one complete year and 2.5 %

marks shall be admissible for that period but the weightage obtained thus shall not exceed

12.5 % .

(5) In addition to the marks provided for work experience in sub-rule (4), bachelor

degree holder candidates shall be given 10 % weightage of marks and post graduate degree

holder candidates shall be given 20 % weightage of marks.

(6) Employment of Secretary, Gram Katchahry will be made by the Gram Katchahry

Employment Committee constituted at the Gram Katchahry level as follows :–

(a) Sarpanch of the Gram Katchahry - Chairman

(b) Up-Sarpanch of the Gram Katchahry - Member

- Member Secretary

nominated by him

(Note – Where the post of Sarpanch is vacant, the Up-Sarpanch shall be the Chairman.

In case of such Chairman, such a Panch shall be nominated as member who possesses the

maximum educational qualifications).

(7) The merit list shall be put up for approval in meeting of the Committee by the

Member Secretary of the Employment Committee.

(8) The approved merit list shall be published on the notice board of the Gram

Katchahry and fifteen days time shall be given for submitting objections, if any, on it. The

objections shall be duly acknowledged. The committee shall dispose of the objections

received within a week and the merit list shall be republished and a copy thereof with

complete proceeding shall be sent to the Block Development Officer.

(9) The Block Development Officer shall examine the list and endeavor to approve it

within a maximum period of fifteen days. If no information regarding approval or any notice

of otherwise objection by the Block Development Officer is received within twenty one

days, the list shall deem to have been approved by him and the approved list shall be re-

published on the notice board of Gram Katchahry, and employment letter (Schedule-II) with

signature and seal of the Sarpanch shall be issued to the successful candidate through

registered post. If any objection is received from the Block Development Officer, such

objection shall be removed by the Committee.

(10) The joining of successful candidate on the basis of his letter of consent

(Schedule-iii) and verification of the certificates regarding qualification shall be accepted by

the Committee. If any certificate is found to be forged or false, the employment shall be

cancelled and other legal action may also be taken.

Appeal - Any appeal, in the matter related to the employment of Secretary, Gram

Katchahry under these Rules, may be preferred before the concerned District Panchayat Raj

Officer within 30 (thirty) days from the date of such employment . The District Panchayat

Raj Officer shall be competent to take a final decision on the appeal . If no adverse order on

the appeal is passed by the District Panchayat Raj Officer within a maximum period of 45

days, the employment shall be kept intact.

Other conditions related to the service – (1) The Gram Katchahry shall make

payment of the fixed honorarium to the Secretary, Gram Katchahry employed by it. The

fixed honorarium of the Secretary, which will not be less than the amount of grant received

from the Government, will be determined after calculation of own sources of income of

Gram Katchahry, which will include the grant received from the State Government. Amount

of fixed honourarium will be fixed by the State Government from time to time.

(2) The employed Secretary shall mark his presence on every working day in an

Attendance Register maintained at the Gram Katchahry Office .

(3) On reasons mentioned in Rule 12 or otherwise, the service found unsatisfactory,

the Secretary may be inflicted minor or major punishment after giving him sufficient

opportunity of self defence .

(4)

If the post of Secretary becomes vacant in a Gram Katchahry, the concerned

Block Development Officer may depute a Secretary of the contiguous Gram Katchahry for

the period until a new appointment is made in that Gram Katchahry . 30 (thirty) per cent

amount of the fixed honorarium as deputation allowance, for a maximum period of six

months, will be payable by that Gram Katchahry to the deputed Secretary where he has

been deputed.

With completion of the tenure of Gram Katchahry, the contract of the

candidate employed on contract to the post of Secretary, Gram Katchahry shall terminate

automatically;

Provided that the State Government, if it so desires, may, by notification, extend

their contract period;

Provided also that till a fresh employment on contract by the newly constituted Gram

Katchahry is made, he/she will continue to discharge the functions and responsibilities of

the Secretary, Gram Katchahry and on completion of the procedure of employment, make

over his/her charge to the newly appointed Secretary, Gram Katchahry.

Payment of fixed honorarium – The payment of fixed honorarium will be made

with the joint signatures of Sarpanch and Up-Sarpanch on the basis of absentee report/

statement;

Provided that on being vacant of post of either Sarpanch or Up-Sarpanch or one of

the two posts or both, the payment of the fixed honourarium shall be made with the joint

signatures of one/two Panches, elected by the majority of the Panches from amongst

themselves.

10.

Leave – (1) 12 (twelve) days casual leave shall be admissible to the Secretaries,

Gram Katchahry in a year . Not more than 5 days casual leave can be taken at a time.

(2)

The abovementioned leave shall be sanctioned by the Sarpanch or in his

absence by the Up-Sarpanch, Gram Katchahry.

11.

Functions and responsibilities of the Secretary, Gram Katchahry –

(1)

Maintenance and custody of the case registers and record registers of the cases

filed in the Gram Katchahry;

(2)

Maintenance and custody of the Accounts Book/Cash Book and other books of

the Gram Katchahry;

(3)

Production of records and registers of cases before the Sarpanch/Judicial

Bench and service of notice/summons to the parties of the case;

(4)

Execution of all other works relating to the Gram Katchahry / Judicial Bench .

(5)

Any other responsibility as may be assigned to him/her from time to time in

relation to the conduct of business of the Gram Katchahry .

12.

Disciplinary action – (1) In case of charges relating for being present irregularly,

not marking his/her presence in time and negligence of duties, the Sarpanch or in his

absence the Up-Sarpanch may ask for explanation from the Secretary and after review of the

explanation may consider to penalise him accordingly;

Provided that on two censures served during the employment period, his service

shall be deemed automatically to be terminated.

(2)

In case of charges of corrupt practices, misconduct and mental insolvency, the

Sarpanch or in his/her absence the Up-Sarpanch may, after asking explanation from the

Secretary and after examining it, consider to terminate his/her services.

(3)

The Secretary Gram Katchahry shall automatically stand suspended during the

period spent in jail in any case. 50 (fifty) per cent amount of fixed honorarium shall be

admissible as sustenance allowance during the suspension period.

(4)

If a Secretary Gram Katchahry is found guilty after proper verification in

course of a departmental action/proceeding in which charges have been framed, he may be

inflicted the following punishments –

(i)

punishment – Censure

(ii)

The employment shall be deemed automatically to be terminated on giving

two censures.

13.

Appeal against the decision of Sarpanch – An appeal against the decision of

Sarpanch may be preferred before the District Panchayat Raj Officer within 30 (thirty) days

from the date of such decision, which shall be heard by the District Panchayat Raj Officer.

14.

Power of removal of difficulties - The State Government may remove any

difficulty arising in implementation of any of the provisions of these Rules by notification.

15.

Repeal and Savings – (1) The Secretary, Bihar Gram Katchahry (Employment,

Service Conditions and Duties) Rules, 2007 and orders, instructions etc issued thereunder

are hereby repealed from the date of enforcement of these Rules.

(2) Notwithstanding such repeal, anything done or any actions taken under the Rules,

orders, instructions shall be deemed to be done or taken under these Rules as if it were come

into force on the day on which such thing was done or such action was taken.
