The 24th December 2014

No. Aa.Ni.(01) 26/2013/Shtha.-1140—In exercise of the powers conferred under

proviso to Article-309 of the Constitution of India, the Governor of Bihar is pleased to make

the following Rules to regulate the recruitment and conditions of service of the Clerical

Cadre of the Bihar Regional Prosecution offices:-

Short title, extent and commencement.-(1) These Rules may be called the Bihar

Regional Prosecution Office Clerical Cadre (Recruitment and Conditions of Service)

Rules,2014.

(2)

It shall extent to all Regional Prosecution Offices of the whole of the State of

Bihar.

(3)

It shall come into force at once.

Definitions.- In these Rules, unless otherwise requires in the context.-

(i)

“Government” means Government of Bihar;

(ii)

“Order of Government” means Executive Orders passed under the powers

conferred in Rules of Executive Business made under Article 166 of the

Constitution of India;

(iii)

“Department” means Home Department as specified in Rules of Executive

Business;

(iv)

“Appointing Authority” means the Director General, Prosecution, Bihar;

(v)

“Controlling Authority” means the Director General, Prosecution, Bihar;

(vi)

“General Administration Department” means General Administration

Department as specified in Rules of Executive Business;

(vii)

“Directorate” means Directorate of Prosecution, Bihar;

(viii) “Cadre” means the clerical cadre of the Regional Prosecution Offices;

(ix)

“Commission” means the Bihar Staff Selection Commission;

(x)

“Appointed day” means the date of Commencement of these Rules;

(xi)

“Member” means a person appointed in the cadre and it includes all the

persons appointed in the cadre before Commencement of these Rules;

(xii)

“Departmental Promotion Committee” means Departmental Promotion

Committee constituted by the Department;

(xiii) “Appointment on compassionate ground” means appointment of any one of

the dependents of the government servant dying in harness on

compassionate ground as per relevant circulars/ instructions.

Cadre structure.-

The cadre structure of the clerical cadre shall be as follows:-

Pay Scale and Grade Pay of all categories shall be the same as may be

determined by the State Government, from time to time.

Cadre strength.-

The cadre strength shall be such as may be determined by the

Department, from time to time.

Level of Cadre.-

This cadre will be of State level which will extend to all

Regional Prosecution Offices of the State of Bihar.

Recruitment.-(1)

85% post of Lower Division Clerk shall be filled up by direct

recruitment and 15% posts shall be filled up by promotion on the basis of seniority

from amongst the eligible Group “D” employees having qualification for the

appointment to the post of Lower Division Clerk.

(2)

All Direct recruitments shall be made in the grade of Lower Division Clerk

on the recommendation of the Commission.

(3)

The Appointing Authority shall calculate the vacancies on the basis of the 1^st

April of every year and shall send the requisition to the Commission by the 30^th

April.

(4)

The Commission shall advertise the vacancies and after selection of

successful candidates on the basis of Competitive Examination shall recommend the

names of the candidates in order of merit to the Appointing Authority. The validity

of the merit list shall be one year from the date of receipt of recommendation.

(5)

The Appointing Authority, after due scrutiny, shall appoint the candidate on

probation for two years.

Qualifications-(1)

The minimum educational qualification shall be Intermediate

(10+2) Pass or equivalent, with knowledge of computer operation and computer

typing.

(2)

Minimum age for recruitment shall be eighteen years and maximum age shall

be the same as may be determined by the State Government, from time to time.

Reservation.-Compliance of reservation/roster as notified by the State Government,

from time to time, in recruitment as well as in promotion, shall be necessary.

Recruitment by promotion.-(1)

The Appointing Authority shall prepare the

seniority list of Group “D” employees having qualifications for the appointment to

the post of Lower Division Clerk.

(2)

The promotion shall be given according to seniority, on the recommendation

of the Departmental Promotion Committee.

10.

Probation.-

Each recruitment shall be on probation for two years and it may be

extended for one year, in special circumstances, by the Appointing Authority, if the

probation period is not satisfactory. Such extension shall be made only if the

Appointment Authority is of the opinion that the probationer has a chance to

improve. If the service is not found satisfactory even in the extended period, the

person concerned shall be removed from the service.

11.

Departmental Examination.-(1) Departmental Examination shall be conducted by

the Board of Revenue.

(2)

There shall be two papers in Departmental Examination and it shall be

necessary to obtain 40% marks in each paper for passing the examination.

Paper-1 Service Rules.- Bihar Service Code, Pension Rules, Laws of Seniority and

Promotion, Noting and Drafting.

Paper-2 Financial Rules.- Treasury Code, Financial Rules, Practice and Procedure,

Board Miscellaneous Rules, General Provident Fund Rules, Travelling Allowances

Rules, Insurance Rules.

Confirmation.- A probationer shall be confirmed after completion of satisfactory

probation period and passing of the departmental examination and computer

competency test.

13.

Seniority.- Inter-se seniority of the members of the cadre shall be according to their

merit position determined by the Commission, but the seniority decided before

notification of these Rules shall remain unchangeable:

Provided that the person appointed on the basis of compassionate ground

shall be junior to such persons who have been appointed on the basis of Competitive

Examination in the concerned recruitment year:

Provided further that the person appointed by promotion in a recruitment

year shall be senior to the person appointed by Competitive Examination in the

concerned recruitment year.

14.

Promotion.- (1) Promotion from basic category to higher category may be given on

completion of KALAWADHI as determined by the General Administration

Department, from time to time and on the recommendation of Departmental

Promotion Committee.

(2) Promotion to the all posts of Upper Division Clerk may be given to such Lower

Division Clerks who have been declared passed by last level in first and second

papers of Departmental Examination conducted by the Revenue Board, Bihar on

the fixed date of consideration for promotion and are also confirmed.

(3) Promotion from Upper Division Clerk to Head Clerk may be given on the

recommendation of Departmental Promotion Committee made on the basis of merit-

cum-seniority.

15.

Residual Matters.- With regard to matters not specifically covered by these Rules,

the members of the cadre shall be governed by the Rules, Regulations or Orders

applicable to the officers/ employees of the State Government at appropriate level.

16.

Interpretation.- Where any doubt arises as to the interpretation of any of the

provisions of these Rules, the matter shall be decided by the Department in

consultation with the Law Department whose decision shall be final.

17.

Removal of difficulties.- The Government ( Home Department) may, from time to

time, issue such general or special direction, in consultation with the Law

Department, which is not in consistent with the provisions of these Rules and is

necessary, to remove the difficulty coming in implementation of any of the

provisions of these Rules.

18.

Repeal and Savings.-(1) All resolutions and instructions issued earlier with respect

to this cadre are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under such

resolutions, instructions shall be deemed to have been done or taken under these

Rules as if these Rules were come in to force on the day on which such thing or

action was done or taken.
