No. Sa.Pra. 11/2012 B.S.A.-384—In exercise of the powers conferred under Article

309 of the Constitution of India, the Governor of Bihar is pleased to make the following

rules for regulating process of recruitment and condition of services to the sanctioned posts

of Group 'B' under Bihar State Archives Directorate and Regional Archives falling under its

jurisdiction.

Short title, extent and commencement. - (1) These Regulation may be called the

"Bihar State Archives Group 'B' (Appointment and service conditions) Rules,

2014"

It shall extend to whole of the State of Bihar.

(3)

It shall come into force at once.

Definitions.- In these Rules, Unless otherwise requires in the context :-

(i) "State Government" means the Government of Bihar;

(ii) "Commission" means Bihar Staff Selection Commission;

(iii) "Department" means Cabinet Secretariat Department;

(iv) "Appointing Authority" means Director of Archives, Bihar, Bihar State

Archives Directorate; and

(v) Cadre means post of Group 'B' in Bihar State Archives and Regional Archives

falling under its Jurisdiction.

Constitution of Cadre. - This cadre shall include the posts of different categories

according to Annexure - 1. Pay scale of the posts of above noted categories will be

such as may determined by the State Government (Finance Department).

Cadre Strength.- The cadre strength of these categories of this cadre shall be such

as may determined by the State Government from time to time. Cadre strength may

be changed by the State Government.

Recruitment.- Educational qualification and process of recruitment of posts

mentioned in the Rule shall be according to Annexure -1.

Qualification. - Qualification for direct recruitment to several posts of the Cadre

shall be according to Annexure -1.

Reservation.- The provisions of Reservation Act and Reservation roaster prescribed

by the State Government, from time to time will be applicable in the appointment to

the posts of this Cadre.

Probation Period.- Probation period will be two years after the date of appointment.

If the service is not found satisfactory during probation period, it can be extended for

one year. If the service is not found satisfactory even during the extended period, the

person concerned may be removed from service without any notice.

Training. - Training for different categories of the cadre shall be determined

according to Annexure-1.

Departmental Exam and Syllabus.- Departmental exam and syllabus for different

categories of the cadre shall be according to Annexure-1.

11.

Confirmation.- The personnel appointed in this Cadre may be confirm in service by

the 'Appointing authority' after completion of probation period and passing the

essential training/exam determined for the post.

12.

Determination of Seniority in the Category.- Seniority will be determined on the

merit list recommended by the Commission.

13.

Residuary Matters.- The matters points for which provisions have not been made in

these Rules in respect of them the provisions of relevant Rules of State Government

will be deemed to be applicable.

14.

Removal of Difficulties.- If any difficulty arises in the implementation of the

provisions of these Rules, the Department may, remove such difficulties in

consultation with the Law Department subject to the provisions of these Rules.

Interpretations.- The Department will be competent for interpretations of any

provision of these Rules after in consultation with Law Department, and its decision

shall be final.

16.

Repeal & Saving.- (1) All Rules, Resolutions and Circulars etc. issued earlier with

respect to this cadre are hereby repealed.

(2) Notwithstanding such repeal, any thing done or any action taken under the Rules.

Resolutions and Circulars will be deemed to be done or taken under these Rule as if

it were come into force on the day on which such thing was done or such action was

taken.
