No. 03/F-01-41/2014 -640—In exercise of the powers conferred by the proviso to

Article 309 of the Constitution of India, the Governor of Bihar is hereby pleased to make the

following Bihar Service (Second Amendment) Code, 2014 to amend the Bihar Service Code

1952:-

The Bihar Service (Second Amendment) Code 2014

1. Short title extent and commencement- (1) This may be called The Bihar

Service (Second Amendment) Code, 2014

(2) It shall extend to the whole of the State of Bihar.

(3) It shall come into force with immediate effect.

2. Amendment in Rule 220 of the Bihar Service Code, 1952 - The figure "135"

used in sub- rule (Kh) of Rule 220 of the said Code, 1952 is substituted by the figure

"180".

3. Insertion of new Rule 220A after Rule 220 of Bihar service code, 1952: - The

following new Rule 220A shall be inserted after rule 220 of the said Code, 1952 :-

"220A Child Care Leave.- (1) Women employees having minor Children may be

granted Child Care Leave by an authority competent to grant leave, for a maximum period

of two years (i.e. 730 days) during their entire service period for taking care of upto only

two children for rearing or to look after in case of their examination, sickness etc.

(2) Child Care Leave shall be treated like the earned leave and shall be sanctioned

like wise.

(3) Child care leave may not be claimed as a matter of right. In any circumstances,

any employee may not proceed on Child Care Leave without prior proper permission of the

leave by sanctioning authority and proper sanction.

(4) Child Care Leave will not be sanctioned for less than 15 days.

(5) Saturdays, Sundays, Gazetted holidays etc. falling during the period of leave will

also be included in child care leave.

(6) Child Care Leave will not ordinarily be sanctioned during the probation period

except in the case of certain extremly by dificult situations where the leave sanctioning

authority is fully satisfied about the need of Child Care Leave to the probationer. It may also

be ensured that the period of this leave during probation is minimum.

(7) Child Care Leave will not be sanctioned more than thrice in a calendar year.

(8) Child Care Leave may be sanctioned with any other leave due but any other

leave applied for in continuation of Child Care Leave may be sanctioned only on request

supported by a medical certificate issued by Government Medical Practitioner.

(9) Child care leave shall be admissible for two eldest surviving children below the

age of 18 years.

(10) During the period of such leave, the women employees shall be paid such leave

salary as she is drawing immediately before proceeding on leave.

(11) Child care leave may be sanctioned even if earned leave is due to the concerned

women employee.

(12) Child care leave shall not be debited against the leave account.

(13) The leave account for child care leave shall be maintained in the prescribed

Performa enclosed, and it shall be kept along with the Service Book of the women

Government servant concerned."
