provision of article-309 of the Constitution of India, the Governor of Bihar is pleased to
make the following rules to regulate the appointment, promotion and service conditions of
Bihar Agriculture Subordinate, Service Category-7 ( Horticulture):-
1.
Short title, extent and Commencement :-
1)
These rules may be called Bihar Agriculture Subordinate Service Category-7
(Horticulture) Rules 2015.
2)
It shall extend to the whole of state of Bihar.
3)
It shall come into force at once.
2.
Definition :- In this Rules, unless otherwise requires in the context:-
1)
“Department” means Agriculture Department of the Government of Bihar.
2)
“Cadre” means cadre of Bihar Agriculture Subordinate Services, category-7
(Horticulture)
3)
“Commission” means Staff Selection Commission or State Technical Staff
Selection Commission (If working).
4)
“Years” means “financial year: i.e. from 1st April to 31st March of next year.
5)
“Competent authority” means Director Horticulture.
6)
“Member” means person appointed under Bihar Agriculture Subordinate Service
category-7 (Horticulture).
7)
“Appointing Authority” means Director Horticulture, Agriculture Department,
Bihar.
3.
Constitution of Cadre and hierarchy of Posts:-
1)
This service shall be a State Level Service and Directorate of Horticulture under
Agriculture Department shall be its Controlling Authority.
2)
First promotion of Block Horticulture Officer will be on the post of Horticulture
Officer.
4.
Appointment and promotion in the basic category:-
1)
For appointment into Service one must be a citizen of India. Sixty seven (67%)
percent post of Block Horticulture Officer and Horticulture Officer shall be filled by
direct appointment.
2)
The calculation of vacant posts for promotion and direct appointment, against the
sanctioned posts in the category, shall be made separately as on 1st April, every year.
This calculation shall be made on the basis of posts. It means that in case of direct
appointment, it shall be filled by in vacancy for direct appointment and in case of the
post for promotion falling vacant it shall be filled by promotion.
3)
The appointment made on the compassionate grounds and in view of Court order
shall be valid for direct appointment

5.
Post and Academic Qualification:-
1)
Block Horticulture Officer
Academic Qualification: Honours in (Horticulture/ Agriculture)/ Graduate/
Intermediate (Science/ Agriculture) with one year experience of Horticulture
Supervisor/ Inspector from recognised ICAR Institute.
Pay Scale- Rs 5200- Rs 20200, Grade Pay- Rs 2400
2)
Horticulture Officer:-
Academic Qualification: Honours Graduate in Horticulture/ Agriculture.
Pay Scale- Rs 9300- Rs 34800, Grade Pay- Rs 4200
6.
By Direct Appointment:-
1)
Direct appointment on basic category post of Block Horticulture Officer and
Horticulture Officer shall
be made from amongst the candidates recommended
on the basis of Competitive Examination conducted by the Commission.
2)
Age Limit:- The minimum age shall be 21 (Twenty One) years on the 1st August of
the year in which application is invited. The maximum age limit shall be the same as
may be prescribed by the Department of General Administration, from time to time,
for direct appointment in the services of the State Government but it may be
increased in special circumstances with reasons to be recorded in writing after
consultation with the General Administration Department.
3)
Reservation:- Provisions for reservation determined by the Department of General
Administration, from time to time, for direct appointment services of the State
Government shall be applicable.
4)
For direct appointment, the Department shall send the requisition with number of
general and reservation category wise vacancies every year 1st April to the
Commission.
7.
Subject and syllabus for competitive examination:-
1)
Competitive examination conducted by the Commission for the post of Horticulture
Officer shall be for 400 (four hundred) marks.
(i)
General Hindi
- 100 Marks (single paper)
(ii)
General Knowledge
- 100 Marks (single paper)
(iii)
Horticulture/ Agriculture Science
- 200 Marks (single paper)
It shall be compulsory to obtain a minimum of 30 percent marks in Hindi but the
marks obtained in this paper shall not be calculated for the purpose of preparation of
merit list. The merit list shall be prepared on the basis of total marks obtained in
Horticulture/ Agriculture Science and General Knowledge. The syllabus of Hindi
and General Knowledge shall be the same as may be determined by the Bihar Staff
Selection Commission for the Joint Competitive Examination organized by it. The
syllabus for Horticulture/ Agriculture science shall be prepared by the Department in
consultation with the Commission.
2)
For the Direct appointment conducted by commission to the posts of Block
Horticulture Officer shall be of 300 (three hundred) marks.
(i)
General Hindi
- 100 Marks (single paper)
(ii)
General Knowledge
- 100 Marks (single paper)
(iii)
Horticulture/ Agriculture Science
- 100 Marks (single paper)

8.
Recommendation of candidates by Commission:- The Commission shall prepare
merit list for General and each reserved category the basis of marks obtained in the
written Examination separately conducted by the Commission. The Commission
shall recommend to the Department amongst the lists prepared according to reported
requisition.

Sevak Cadre having matriculation or equivalent certificate.
3)
kalawadhi for promotion shall be the same as may be determined by the State
Government, from time to time.
4)
The provision for reservation in promotion will be applicable as prescribed by the
Department of General Administration.
5)
Inter-se-Seniority of the employees appointed on the recommendation of Staff
Selection Commission and promoted from the lower posts shall be determined by the
Department of General Administration.
6)
The inter-se-seniority of the employees appointed by promotion shall be the same as
it was in the cadre before the promotion.
10.
Probation :-
1)
Every member appointed by direct recruitment in the service, shall be on probation
for a period of 2 (two) years from date of his joining but in special circumstances,

this period may be extended for one more year. If the appointing authority records
that there is a chance for improvement by the person concerned. If performance of
employee is not found satisfactory during extended period, services of the member
of such cadre may be terminated by the Government, without asking any show
cause, but they shall be given written notice with reasons.
2)
The period of probation shall be calculated in the regular service.
11.
Training:-
1)
It will be compulsory to obtain training for promotion from the institute
determined by the department for the members appointed in the Bihar Agriculture
Subordinate Service category- 7 (Horticulture). The training Institute will be
selected by the Department from time to time.
2)
In the training programme in the service shall be organised by the Department of
Agriculture in which participating of the cadre members will be compulsory.
Based on above activity, Benefit of promotion will be admissible on the said
ground but in case of failure to organise training programme, by the Department of
Agriculture, The candidates will not be debarred from promotion.
12.
Departmental Examination :-
1)
It shall be compulsory for the grade-C employees to pass in Hindi noting and
drafting examination duly conducted by Rajbhasha Department, Bihar, as well as in
the Departmental Examination conducted by the Department.
2)
Second annual increment in the pay scale of basic category shall be only admissible
after passing in the aforesaid examination.
3)
Held-up increments of the employees shall be non – cumulative and all increments
will be payable after passing in the examination.
4)
After attaining 50 years of age, employees will exempted from the essentiality of
passing the Departmental Examination under the circulars/ instructions issued from
time to time by the department of General Administration.
13.
Confirmation of Service :-
1)
The services of the member of the direct appointment, shall be confirmed against
permanent posts in the basic category, only after successful completion of probation
period, passing in the Departmental Examination, completing the training
programme with fair service.
2)
Confirmation of Service appointed by promotion in basic category as described
under sub-rule 9 (1) may be made on the conditions.
14.
Determination of Seniority:-
The seniority of employees will be determined in the light of policy determined
by the General Administration Department.
15.
Promotion on higher posts from the post of basic Category:-
1)
Promotion on higher post in the hierarchy of service cadre shall be given to the
employees working just below the promotional post, on the basis of seniority
and in the light of instructions issued by the General Administration Department
from time to time. But this promotion shall be admissible to the employees only
after participating in the training as provided under Rule-7.
2)
In case the department/ Institute fails to conduct/ organize training in time,
employees will not be debarred from promotion.
3)
Promotion shall be given by the competent Authority based on seniority,
confirmation of the working officers in basic category, confidential remarks,
internal clearance, clearance of vigilance, and report of Lokayukta available
vacancy along with clearance of reservation.

16.
Departmental promotion committee :-
Case of promotion will only be considered on the recommendation of the
Departmental promotion committee. The Departmental promotion committee
will be constituted separately in the light of resolutions/ instructions issued by
the General Administration Department, from time to time.
17.
Miscellaneous- Removal of difficulty:-
1)
The department will be competent enough to explain any rule of these rules and
regulations, it is necessary to obtain opinion of General Administration
Department, Law Department and Finance Department.
2)
The department may remove difficulty coming in implementing any of these
Rules after consultation of Law Department and by order published in the
Official Gazette.
3)
The provisions for the time being in forced in the Code/Rules/ Regulation/
Resolution/ Instructions made by the State Government in respect of those
subjects or point for which provisions are not in the Rules.
18.
Repeals and Savings:-
1)
All circulars/ instructions/ resolution regarding appointment of staff/ service
conditions, of this cadre, are hereby repealed.
2)
Notwithstanding such repeal anything done or any action taken under the said
circulars/ instructions/ resolutions shall be deemed to be done or taken under
these Rules as if it were enforced on the day on which such thing was done or
such action was taken.
