The 18th January 2016
No. Aa. Ni. (01) 02/2013/EST-53—In exercise of the powers conferred under
proviso to Article-309 of the Constitution of India and under section-25(A) of the Code of
Criminal Procedure, the Governor of Bihar is pleased to make the following amendments in
the Bihar Prosecution Manual, 2003 with immediate effect :-
Amendments
1. Rule-5 of the Bihar Prosecution Manual, 2003 Shall be substituted by the
following:-
“5 (1) Director, Prosecution shall be at the Head of the Directorate of
Prosecution.
(2) The eligibility criterion for the Director, Prosecution shall be the following:-

(i) District Prosecution Officer or the officer equivalent holding or superior
post of the Bihar Prosecution service.
(ii) Must have an experience of minimum 10 years in the Bihar Prosecution
Service.
(iii) Officers applying for the Limited Competitive Examination to be
conducted by the Bihar Public Service Commission should have at least three years of
service remaining on the last date fixed for submission of application.
(3) The Bihar Public Service Commission shall send a panel of three officers on the
basis of the limited competitive examination. The panel of three officers received from the
Commission shall be sent, through proper channel, for concurrence, to the Hon’ble Chief
Justice, Patna High Court, Patna. After the concurrence, the selected officer shall be
appointed to the post of Director, Prosecution.
(4) The nature and syllabus for the limited competitive examination to be conducted
by the Bihar Public Service Commission shall be in conformity with annexure-‘A’.”
2.
The following new sub rule (cc) shall be added after sub rule (c) of rule 6
of Bihar Prosecution Manual, 2003:-
“(cc) A panel of three senior most officers amongst District Prosecution Officer or
equivalent category of the Bihar Prosecution Service, having at least two years of service
remaining on the 1st August of the selection year, shall be sent for concurrence to the
Hon’ble Chief Justice, Patna High Court, Patna. The officer selected from the panel shall be
posted to the post of Deputy Director, Prosecution.”
3. The words ‘Director General, Prosecution’ shall be substituted by the words
“Director, Prosecution”, used wherever in the Bihar Prosecution Manual, 2003.

Annexure-‘A’
Pattern and Syllabus for the proposed Limited Competitive Examination to be conducted for
the post of Director, Prosecution.

The apex post of the Directorate of Prosecution, Director Prosecution shall be filled
through the Limited Competitive Examination. The examination shall be conducted by the
Bihar Public Service Commission.
2. The eligibility criteria of candidates applying to the Bihar Public Service
Commission for the post of Director, Prosecution shall be as follows:-
(i)
District Prosecution Officer or officer equivalent thereof or holding a
superior post of the Bihar Prosecution Service.
(ii)
Must have an experience of minimum 10 years in the Bihar
Prosecution Service.
(iii)
Officers applying for the Limited Competitive Examination
conducted by the Bihar Public Service Commission should have at
least three years of service remaining on the last date fixed for
submission of application.
3.
Examination-
(A)
There shall be two papers in the examination.
(i)
The first paper shall be called the General Paper and questions shall
be asked from Hindi, English, General Knowledge(including Current
Affairs), General Science and Analytical Ability containing
20+20+20+20+20=total 100 questions. Thus, there shall be 100

questions worth 200 marks. The question shall be objective and
multiple choices. There shall be negative marking and 1 mark shall be
deducted for each wrong answer.
(ii)
The second paper shall be called the Law Paper and questions shall be
asked from Indian Penal Code, Code of Criminal Procedure, Indian
Evidence Act, Prevention of Corruption Act, Dowry Prevention Act,
Scheduled Caste/Scheduled Tribe Atrocities Prevention Act, Arms
Act, Prevention of Unlawful Activities Act, Prevention of Human
Trafficking Act and NDPS Act. The question paper shall be
subjective. The paper shall carry 400 full marks.
(B)
Level of question of General Paper shall be of standard equivalent to
entrance examination for Law Universities. Level of the Law paper shall be
of the standard equivalent to examination for Law graduate degree.
(C)
All candidates shall have to appear in the interview. There shall be 200 full
marks for the interview.
(D)
The Commission shall recommend a panel of three officers to the State
Government for appointment to the post of Director, Prosecution on the basis
of marks obtained in written examination and interview.
