The 25^th January 2016

No. 470—In exercise of the powers conferred by proviso to 309 of Indian

Constitution of India, the Governor of Bihar is pleased to make the following Rules to

amend The Bihar General Provident Fund Rules, 1948:-

1. Short title, extent and commencement.— (1) These rules may be called the

"Bihar General Provident Fund (Amendment) Rules, 2016".

(2) It shall extend to the whole of the State of Bihar.

(3) It shall come into force with immediate effect.

(4) It shall be applicable for only those subscribers, whose final authority letter for

payment has not been issued as yet.

2. Following provisos shall be added after sub-rule (3) of Rule 14 of the Bihar

General Provident Fund Rules, 1948:-

"Provided that where there has been delay in payment of salary and allowances in

lieu of pay or leave of a subscriber and consequently in the recovery of his

subscription towards the Fund, the interest on such subscriptions shall be

payable from the month in which the pay or leave salary of the subscriber

was due under the rules, irrespective of the month in which it was actually

drawn:

Provided further that in the case of an amount forwarded to the Account Officer in

accordance with the proviso to sub-rule (2) of Rule 13, the date of deposit

shall be deemed to be the first day of the month in which deduction has been

actually made from the salary:

Provided further also that where the emoluments for a month have paid on the last

working day of the same month, the date of deposit shall, in the case of

contribution to the General Provident Fund, be deemed to be the first day of

the succeeding month."
