The 24^th February 2016

S.O. 59, dated 25^th February 2016—In exercise of the Powers conferred by section

112 of the Factories Act, 1948 the Governor of Bihar is pleased to make the following

Rules to amend the Bihar Factories Rules 1950:-

1. Short title extent and commencement:-

(1) These Rules may be called the Bihar Factories (Amendment) Rules, 2016.

(2) It shall extend to the whole state of Bihar.

(3) It shall come into force from the date of publication in official gazette.

2. Substitution of Rule-100 of the Bihar Factories Rules, 1950.

Rule 100 of the said Rules, 1950 shall be substituted by the following:-

''100 (1) Annual Returns: - The manager of every factory shall furnish, annual

returns of the subsequent year to the Chief Inspector not later than the 15^th January of the

present year in Form- 20:

Provided that-

(a) The information being canteen in every factory shall be furnished annual

returns of the subsequent year only by the manager of every factory notified by the State

Government wherein more than 250 workers are ordinarily employed.

(b) The information regarding crèche facility in such all factories shall be furnished

only by the manager of every factory wherein more than 30 women workers are ordinarily

employed, and

by the manager of every factory wherein more than 150 workers are ordinarily employed.

(2) Annual Returns of Holidays: - The manager of every factory shall, before the

end of each year, furnish a return to the Chief Inspector giving notice of all the days on

which it is intended to close the factory during the next year. This return shall be submitted

whether the Factory is or isn’t working during the year to which it relates:

Provided further that The State Government, may exempt any specified factory or

any class of factories or factories of any special areas from this returns provided that if the

system of approval of the Holidays instead of showing the actual date or dates of Holidays,

it will mentioned relating to the following:-

(a) Sundays are observed as weekly holidays regularly,

(b) A fixed day in the week is observed as a holiday regularly, or

Factories.

Provided that where the manager of any factory makes any change in the said

holidays or a list of holidays, prior intimation of the same shall be given to the Inspector.

“Provided that the Government may allow to furnish the above return manually or

on line or in digital formats”.
