Preamble-

Information and Public Relations Department, as per the Bihar rules of executive

business and as per the provisions of Bihar Advertisement Policy 2008, has been given the

mandate for publicizing the schemes, programmes and achievements of the various

departments of the government including all the corporation, local bodies, boards, PSUs,

authorities, societies and other institutions through classified advertisement and other forms

of publicity and public awareness including tender notices and other notices in All India

Radio, Doordarshan, Electronic media, internet and newspaper and magazines of national

and international repute; and to ensure centralized released payment and monitoring of these

advertisements.

In the light of ever changing circumstances, emergence of new information and PR

techniques, changing environment of work and procedures, to know understand and get

feedback on the mood and perception of the common citizen on various issues along with

getting their reaction and response to various programs of the government; to ensure

dissemination and propagation of government programmes, schemes and achievements for

public awareness and education, establish effective public dialogue and to develop Brand

Bihar by professional use of various modern techniques of mass media; use of social media

viz. facebook, twitter, YouTube and outdoor publicity including other mediums for

effectively publicizing and disseminating information through advertisements; formation of

a society for the purpose of developing creative and for fulfillment of other objectives and

financial delegation etc., there is a need for amendment of certain existing provisions and

inclusion of certain new provisions in Bihar Advertisement Policy 2008. In these changing

circumstances and for the fulfillment of various responsibilities given to the department it is

necessary to make a new Bihar Advertisement Rules 2016 after superseding the old Bihar

Advertisement Policy 2008.

In the light of new Bihar Advertisement Policy 2016 and to execute the works

relating to advertisement and Public Relations through the use of modern techniques in

professional manner and for implementation of the new policy, Information and Public

Relations Department hereby frames Bihar Advertisement Rules 2016

2. Short Title

These rules shall be called " Bihar Advertisement Rules 2016"

ii.

These rules shall come into force from the date of its publication in the official

gazette

3. Objectives

The main aim of these rules is to fulfill the objectives of Bihar Advertisement Policy

2016 wherein in the light of ever changing circumstances, emergence of new information

and PR techniques, changing environment of work and procedures, to know understand and

4. Definition – In these rules, unless there is anything otherwise in subject or context-

"Newspaper" means "such newspapers which are registered by the Registrar of

newspaper, under the provisions of Press & Books Act, 1867 of Government of

India".

"News Magazine " means "such New Magazine" which are registered by the

Registrar of newspaper , Government of India" under the provisions of Press &

Books Act, 1867, published Weekly, Fortnightly, Monthly, Tri-monthly, Half-

yearly and yearly.

iii.

"Various Media" means News paper/Magazine/Electronic media's satellite

channel/ Cable channel/ Radio/ Website/ Social media/ Mobile apps/SMS,

including railway station for advertisement/bus stand/ mall/airport/ metro station/

train/ movies theater/publicity van/ pamphlet/ poster/brochure/ electronic display

board/ other electronic gadgets/ hoarding/flax/ wall painting/ exhibition/ songs

play/ street play and other media.

iv.

"Secretary" means "Principal Secretary/Secretary Information & Public Relations

Department".

"Director" means "Director Information & Public Relations Department".

vi.

"Empowered Committee” means "Advertisement Empowered Committee”

constituted under Rule 5.

vii.

"Rate Fixation Committee" means "committee constituted for the fixation of rate

of advertisement for different media" under Rule 6.

viii.

"DAVP" means "Directorate of Advertisement and Visual Publications of the

Ministry of Information & Broadcasting, under Government of India".

ix.

"Registrars" means "Registrar of Newspaper of G.O.I".

"A.B.C." means "Audit Beauro of Circulation".

xi.

"Undertaking" means "All Board/Body/Corporation/Public Enterprises/Society

under the ownership & control of "Government of Bihar".

xii.

"Bihar Samwad" means "Bihar Samwad Samiti constituted under Information &

Public Relations Department" under society Registration Act, 1860”.

xiii.

"Documentary" means "documentary produced for the advertising work and

development of "Brand Bihar" by Information & Public Relations Department".

xiv.

"Film" means "film produced for the advertising work and development of "Brand

Bihar" by Information & Public Relations Department".

xv.

"Advertisements" means the advertisement received from different department

and government undertakings, development of advertising material and its

publicity through various medium about programmes and achievements for public

awareness and public dialogue including awareness by Information & Public

Relations Department".

xvi.

"Radio Channel" means "Radio/Community Radio/FM channels".

xvii.

"Satellite Channel" means "those satellite channel which telecast, through the

Television/other electronic media".

xviii.

"Website" means "Internet Website/Portal/Social Media".

xix.

"Mobile Apps" means "media for publicity, based on mobile software and

internet".

xx.

"SMS" means "mode of publicity of information by mobile".

xxi.

"Approved list" means "Approved List of state government for the release of

advertisement, maintained by Information & Public Relations Department".

"Cable T.V." means" Telecast on T.V., the signals, received from satellite

channel through M.S.O. by Cable".

xxiii.

"Department" means "Information & Public Relations Department".

xxiv.

"Bihar Advertisement Rules, 2016" means "Bihar Advertisement Rules, 2016"

framed by Information & Public Relations Department.

xxv.

"Classified Advertisement" means "Recruitment, Tender, Notice and other

declarations which are published under special Title in different newspapers".

xxvi.

"Display Advertisement" means " Dissemination of the material based on topics

of mass-campaign, programme, important policy, achievement, announcement of

new policy and historical and socio-economic topics in an attractive manner".

xxvii.

"DAVP Rate" means "Rate fixed by DAVP under Information & Broadcasting

Ministry, government of India".

xxviii.

"Departmental Rate" means " Rate fixed by Rate Fixation Committee to released

any advertisement"

Advertisement Empowered Committee - Various media will have to apply in a

prescribed format to the department for inclusion in the Approved List and fixation

of the departmental rate. The recommendation of Rate Fixation Committee along

with the application for the empanelment shall be put up before the Advertisement

Empowerment Committee. The composition of the empowerment committee will be

Department, in the interest of work can call a meeting of the committee as per requirement.

The Advertisement Empowered Committee, keeping in mind the requirements, the

practicality and the state interest, may recommend various media, from amongst those

applying for empanelment, in the approved list, as it may deem fit. It would not be binding

upon the Committee to include, any media in the approved list merely because it fulfills the

eligibility criteria. The Committee shall have the freedom and the competency to delist any

enlisted media in the interest of the state or work, from the approved list.

The committee after due consideration may recommend release advertisement for

those media who at present do not have any departmental rate after the recommendation of

the Rate Fixation Committee.

After the recommendation of the Empowered Committee the empanelment and

departmental rate shall be fixed with the approval of the departmental minister.

6. Rate Fixation Committee –

In the interest of state and public interest the department can determine

departmental rate for publication of advertisement and other materials in various media

website etc. and recommend the same before their inclusion in the approved list

For determination of departmental rate of newspapers/magazines, Electronic

channels and other various media, whether in the approved list or outside the approved list,

the committee shall consider the access and reach of the said advertisement to the targeted

group, its priority, requirement, use, the achievement of the goals and aims of the

advertisement giving consideration to the DAVP rate and keeping the interest of the state

and public interest paramount and recommend a departmental rate which after the approval

of the department will be valid for one year (April to March) in general. The departmental

rate can be revised/reviewed every year. Fixed departmental rate will remain enforce till

revision of rate.

Eligibility for the inclusion in the approved list -

( I)

For inclusion in the approved list, the essential eligibility criteria shall be as follow:-

The newspaper/periodical must be published either in Hindi or English or Urdu

language.

ii.

The newspaper/periodical must be registered under the provisions of the Press and

Registration of Books Act 1867 by the RNI, New Delhi.

iii.

It should be empanelled with the DAVP Govt. of India but before its inclusion in

the approved list the department shall fix its departmental rate for release of

iv.

For Hindi and English Daily Newspapers the minimum publication area shall be

20,000 sq cms., for Urdu it would be 10,000 sq cms., and for periodicals 24,000 sq

cms.

The circulation for Hindi newspapers should not be less than 60,000, for English

newspapers it should not be less than 40,000 and for Urdu newspaper not less than

25,000. For Magazines the minimum circulation should be 25,000. Regarding

authenticity of circulation, the certification from ABC or other standard

organization shall be necessary.

vi.

The newspaper, Magazine must have a regular and uninterrupted publication for at

least twelve months. Regularity and place of publication would be verified by the

Information & Public Relations Department, Bihar through the Headquarter and/or

district level.

(II)

Eligibility and provisions for empanelment of Electronic Media/Cable T.V.

channels in approved list:-

Those Electronic Media/cable T.V. channels who broadcast news, current affairs

programmes, social, economic, cultural and professional programmes and cover

nationally/within the state of Bihar a substantial area of population will be eligible

for release of advertisements. But mere fulfillment of these eligibility criteria, will

not be binding upon the Information and Public Relations Department for release of

advertisements.

ii.

It must be empanelled with DAVP, Government of India, but before inclusion in

approved list the department would fix the "departmental rate" for release of

advertisements.

iii.

Those electronic media /Cable T.V. channels which are not empanelled either in

DAVP or the approved list of state, may also be released advertisements under

specific circumstances/ purposes/ occasion or campaign in the interest of state or in

greater public interest at the departmental rate, fixed by the Rate Fixation Committee

as per Rule-6 and the order of competent authority after the recommendation of

Empowerment Committee.

(III)

Eligibility for enlistment to Radio/FM Radio/Community Radio in approved

list:-

Radio channel/FM Radio/ Community Radio channel of Government of India/ State

government / Prasar Bharti would be automatically included in the Approved list.

ii. Such Radio channel/FM Radio/ Community Radio channel, having license from

government of India, broadcasting news, current affairs programmes, social,

economical, cultural and professional programmes through radio waves covering a

substantial area of population nationally or within the state, will be eligible for

release of the advertisements. But mere fulfillment of these eligibility criteria, will

not be binding upon the Information and Public Relations Department to release the

advertisements.

iii

Eligibility for enlistment of Internet Website/Social Media in approved list:-

Those Internet Website/Social Media listed in DAVP and having departmental rate

who broadcast news, current affairs programmes, social, economic, cultural and

professional programmes and telecasting events will be eligible for release of

advertisements. But mere fulfillment of these eligibility criteria, will not be binding

upon the Information and Public Relations Department for release of advertisements.

ii. Those Internet Website/Social Media which are not empanelled either in DAVP or the

approved list of state, may also be released advertisements under specific

circumstances/ purposes/ occasion or campaign in the interest of state or in greater

public interest at the departmental rate, fixed by the Rate Fixation Committee as per

Rule 6 and the order of competent authority after the recommendation of Empowered

Committee..

(V) Empanelment of other various media for release of advertisement:-

Other various media like Railway Station/ Aero drum/ Bus stand/ Mall/ Metro Station

and such other public places whose management has authorized and/or selected

agencies for doing publicity in their premises through hoardings/flax, electronic

display boards etc. such agencies can be empanelled for release of advertisements.

Such authorized and/or selected agencies will have to submit the authorization

letter/work allotment certificate for empanelment. Advertisement can be released to

such authorized and/or selected agencies under specific circumstances/ purposes/

occasion or for specific and targeted campaigns in the interest of the state at the

departmental rate fixed by Rate Fixation Committee as per Rule 6, by the order of

competent authority on the recommendation of Empowered Committee.

ii. The digital satellite media as used in cinema hall/ movie theatre/ cable TV could also

be empanelled in the approved list and advertisement can be released to such

authorized and/or selected agencies under specific circumstances/ purposes/ occasion

or for specific and targeted campaigns in the interest of the state at the departmental

rate fixed by Rate Fixation Committee as per Rule 6 by the order of competent

authority on the recommendation of Empowered Committee.

Eligibility criteria for the Release of Government Advertisement-

(a) The eligibility criteria for release of government advertisement to news papers/

magazines will be as follows :-

For realization of the objectives of the advertisement policy and work interest,

advertisements will be released generally to such news papers/magazines including

other various media empanelled in approved list of the Information & Public Relations

Department, after the approval of the competent authority.

ii. The various media including newspaper/magazine, willing to be empanelled in

approved list will have to apply in prescribed format under the parameters fixed by the

department.

iii. The advertisement will be released at 'departmental rate' to the Newspapers /

magazines and other various media included in the approved list after the approval of

competent authority and in work interest for the fulfillment of the objectives of

advertisement policy.

iv. Those media which are not empanelled in the approved list of state and do not have

the departmental rate may also be released advertisements under specific

circumstances/ purposes/ occasion or campaign in the interest of state or in greater

public interest if necessary at the departmental rate, fixed by the Rate Fixation

Committee as per Rule 6 and the order of competent authority after the

recommendation of Empowerment Committee.

Effective management of Public dialogue, creation of Brand Bihar and Public

awareness for programmes, policies and schemes of the Government.

(i)

For publicizing the achievements of various departments and the culture and

heritage of Bihar, the department can publish coffee table books and other

printable material for circulation within and outside the state during special

occasions/purpose/campaigns.

(ii)

For publicizing various government programs and schemes useful for public

awareness, the department can arrange conclaves and workshops on its own

and as per requirement can also arrange for such conclaves and workshops in

collaboration or in participation with other media agencies such as T.V.

channels, newspaper groups and other institutions. The departmental rates

for these will be decided by the Rate Fixation Committee.

(iii)

Non empanelled various media, global advertizing, hoarding, wall writing,

exhibition, Song and drama, street plays, pamphlet, brochure, poster, booklet,

publicity

vans

etc.

including

social

media

such

facebook/twitter/YouTube/mobile app/sms/and others can also be used for

creating public awareness and publicity of achievements, policies, schemes

and programmes of government in an effective manner as per established

norms and procedures.

(iv)

The department can take the services of professional agencies and experts

including professionals for mass-communication and public awareness,

effective publicity and fulfillment of various objectives including

development of Brand Bihar.

(v)

The aforesaid works can be implemented by the department itself or through

its society "Bihar Samwad".

10.

Production of creatives, documentaries, films and their payment rate

For publicity through various media the department can produce creatives/

documentary/film at departmental rate. In the case of non availability of the

departmental rate, the production and payment of creative/documentary/film can be

done after the approval of competent authority on the basis of the recommendation

of Empowerment Committee, at the departmental rate fixed by rate fixation

committee according to Rule 6 of these rules.

11.

Approved list, Departmental and DAVP rate is not the basis of getting

advertisement –

Mere inclusion in approved list and having departmental / DAVP rate for

different media, shall not be construed as right to obtain the advertisement. The

advertisement shall be released to various media depending upon the utility need,

benefit to the targeted audience, the effective reach of the media its area specific

circulation and thriftiness.

12.

Expulsion from the approve list and Withdrawal of amount-

Any empanelled media can be expelled from approved list by the department

for twelve months with immediate effects on the recommendation of Advertisement

Empowerment Committee if

found to have deliberately submitted false information regarding circulation

or otherwise; or

ii.

found to have discontinued its publication, changed its periodicity or its title

or have become irregular or changed its premises/press without due

intimation; or

iii.

it has failed to submit its Annual Return to the Registrar Newspaper of India

(RNI) or its Annual Circulation Certificate from the prescribed agencies; or

iv.

indulged in unethical practices or anti national activities and has been

indicted by court of law for such activities; or

it refuses to accept and carry an advertisement issued by the departments on

more than two occasions.

vi.

any complaint or irregularity found regarding aforesaid para (i) to (iv) the

department can on its own and as per requirement get it enquired into and

place the enquiry report to the Empowered Committee for consideration

vii.

in case of aforesaid para (i) (ii) & (iii), the payment done earlier to the

concerned media could be withdrawn by the department. Till such

withdrawal, no advertisement shall be released to it.

13.

Right to act against allegations/complains:-

On getting complain against different media, Principal Secretary/ Secretary/

Director or Information and Public Relations Department shall have right to

ask show cause to concerned media. The Principal Secretary/ Secretary/

Director can independently enquire against such media against which

complain has been registered. Principal Secretary/ Secretary can withhold the

issue of advertisement to that media immediately after full satisfaction and

truthfulness of the complaint and submit the enquiry report to Empowered

Committee within maximum of six months, which will give its

recommendation to the department upon which action could be taken after

the approval of the departmental minister.

ii.

The Empowered Committee can report/recommend for expulsion of any

media empanelled in the approved list in the interest of the state/work, any

time without giving any reason. The concerned media can be delisted

permanently / temporarily from the approved list after getting approval of the

departmental minister.

14.

Advertisement Rate-

The departmental Rate for the publication of advertisement in different media

while recommending the departmental rate of any media shall take into

with the interest of the state and public at large. Departmental rate will be

decided with the approval of the department which will be valid for one year

in general and shall be revised each year.

ii.

The advertisement rate for the newspaper/magazine in approved list will not

be more than departmental rate. In case of publication of coloured creative

advertisements 15% discount shall be applicable after adding 40% in

departmental rate. In case of black and white classified and other

advertisements 15% discount shall also be applicable from departmental rate

if such advertisements are released after full composition and ready to use

state.

iii.

In special circumstances, purpose, occasion or special campaigns,

advertisements can also be issued in public and state interest to non

empanelled newspapers/magazines/electronic channels/websites social

media comprising twitter, facebook, youtube /SMS/mobile apps and other

media of international and national repute, which are not in the approved list

and do not have departmental rate, but in such cases if the state governments

wants to advertise in such media then it can be done for a special period,

special issue or full campaign after fixation of the department rate by the

Rate Fixation Committee as per Rule 6, the recommendation of the

Empowered Committee and after the approval of the competent authority.

iv.

The department, in the larger interest of the state and public, can revise the

departmental rate for the particular media included in approved list for

special circumstances and occasions, purpose and campaigns with the

approval of the department after the recommendations of Rate Fixation

Committee and Empowered Committee which will the applicable for that

particular circumstance, occasion and campaign.

15.

The Procedure for the release of advertisement and payment:-

All works pertaining to release of Government advertisements, including Local

Bodies/ Corporations/PSU's etc./establishment/Authority/ Boards under the ownership and

control of Bihar Government, excluding the Judiciary, will be centralized under the

Information & Public Relations Department. The payment of all kinds of advertisement will

be done through RTGS /NEFT.

The centralized release of advertisement and payment process for newspaper/

magazines will be as follows:-

Each and every department of Bihar Government, Boards, Undertakings,

corporation, etc. will identify the head of the offices at Headquarter and field

level, who will be empowered to release the advertisements for the concerned

department. A list of such authorised heads of offices would be made

available to the Information and Public Relations Department.

ii.

The head of the office authorized to issue advertisements for the concerned

departments of the state Government will make available the hard and soft

copies of the advertisement material to be released, normally 15 days before

the date fixed for sale of Bill of quantities (BOQ). In case of short

notice/emergent works the same would be made available 7 days before the

date fixed for sale of bill of quantities (BOQ) to the Information and Public

Relations Department and a receipt would be issued to them.

iii.

After the receipt of the advertisement material, the competent authority

would select the newspapers for release of advertisement keeping in view the

nature of advertisement, estimated amount, the target group etc. One the

selection of news papers/magazines in which advertisement is to be

published is done; the financial sanction will be accorded by the same

competent authority. The advertisement would then be released for

publication.

iv.

After the approval for the release of advertisement, the Information and

Public Relations Department will issue a release-order in which apart from

other information, size, nature, date, edition of the advertisement will be

enumerated and it will be mandatory for the publisher to fully adhere to the

terms and conditions of the release order, failing which no payment would be

done for the published advertisement.

Newspapers/magazines included in the approved list shall be responsible for

submission of their bills in duplicate along with release order and 3 tear-

sheets of published advertisements released during the month to the

Information and Public Relations Department before 7^th of the next month.

vi.

The payment will be made after receiving the said bill and getting it

crosschecked and obtaining the order of the competent authority.

vii.

Payment of advertisement bills in respect of Local Bodies/Corporations/

PSUs/Authorities/Societies under the ownership and control of Bihar

Government shall be done centrally by the Information and Public Relations

Department. Newspapers/magazines included in the approved list shall be

responsible for submission of their bills in duplicate along with release order

and 3 tear-sheets of published advertisements release during the month to the

Information and Public Relations Department before 7^th of the next month.

Concerned Local Bodies/Corporations/PSUs/ Authorities/Societies, at the

start of the financial year, will be responsible to deposit the earmarked

budgeted amount for advertisement in the Bank account maintained

especially for this purpose by Information & Public Relations Department.

Information & Public Relations Department will make payment from the

amount deposited by it against requisition by the said Local Bodies/

Corporations/PSUs/Authorities/Societies. Whenever the amount deposited

falls short, the Information and Public Relations Department will inform

them to make available the fund. A separate register will be maintained for

the fund received from the concerned Local Bodies /Corporations

/PSUs/Authorities/Societies in which the account of the fund received and

the expenditure incurred on the advertisement will be maintained. The

Information and Public Relations Department shall stop the release of

advertisement until it further receives the funds.

viii.

The publication house will not be paid more than the amount mentioned in

the release order as per departmental rates. No claim will be entertained if the

publication of Advertisement is not done in accordance with the provisions

of the release-order.

ix.

The publication house will be responsible to make available the copy of

Newspaper/ magazine carrying the relevant advertisement to the concerned

party and Information and Public Relations Department.

For newspapers /magazine not enlisted in the approved list :-

Advertisements to those newspapers/magazines, which are not listed in the

approved list of Information and public Relations Department, the

advertisement could be released to such unlisted newspapers/magazines, on

the recommendation of the "Advertisement Empowered Committee" by the

order of the competent authority at the departmental rate fixed by the Rate

Fixation Committee under the provisions mentioned in Rule 6.

ii.

While releasing advertisements to newspapers/magazines not listed in the

approved list, it would be specially borne in mind that the advertisement, as

far as possible covers that target group for which the publication of

advertisement is intended.

iii.

After due scrutiny of the advertisement bills received, the payment would be

done with the sanction of the competent authority.

iv.

Mode of payments for newspapers/magazines not listed in the approved list

of the department would be the same as is provided for in the case of

newspapers/ magazines listed in the approved list.

For Souvenir/ In-House magazines:-

Under special circumstances, advertisements may be released to Souvenirs/

In-House magazines on the recommendation of the Advertisement

Empowered Committee, at the rate fixed by the Rate Fixation Committee for

the souvenirs/In-House Magazines mentioned in Rules-6 by the order of

competent authority.

ii.

While releasing advertisements to Souvenirs/In-House magazines not listed

in the approved list, it would be specially borne in mind that the

advertisement, as far as possible covers that target group for which the

publication of advertisement is intended.

iii.

The payment for advertisement, released to Souvenirs/In-House magazines

would be made as per the rate recommended by 'Rate Fixation Committee &

Advertisement Empowered Committee', on receipt of the bill along with tear

sheet and release order. The procedure for submission of tear sheet bills etc

and the procedure for payment would be the same as has been prescribed for

newspapers/magazines listed in the approved list.

The advertisement can be released at departmental rate to various publicity

media

Radio/Community

Radio/Social Media and others media, included in approved list and the procedure

for the payment will be the same as admissible for the newspapers/magazines of

approved list.

To such Electronic Channel/Website/Radio/FM Radio/Community Radio/

Social Media/ Railway Station/Airport/Metro Station/Mall/Movies theatre and others

media which do not have any departmental rate and/or are not included in approved

list of the state government, advertisement can be released to them, under specific

circumstances, occasion/ events, keeping in mind the state interest, at the

departmental rate fixed by 'Rate Fixation Committee' in Rule 6 and on the

recommendation of the Empowered Committee with the approval of the

departmental minister. The payment would be made with the approval of the

competent Authority.

16.

Global Advertisement-

The Global Advertisement is required by various Departments/ Local Bodies

/Corporations /PSUs/Authorities/Societies of the government. Under such

circumstances they will provide advertising material and the name of the

newspaper/magazine/channel/website and other media, to the department, forty days

in advance. The advertisements could be released after the approval of the

departmental minister, on the recommendation of Empowered Committee at the

departmental rate fixed by Rate Fixation Committee as per Rule-6, of Bihar

Advertisement Rules, 2016. The payment will be made to that media by the

procedure fixed by the department.

17.

Publicity through Hoardings, Wall Paintings, Exhibitions, Song & Drama,

Street Plays/Pamphlets/Brochures/Posters/ Booklet/Publicity van etc :-

The department can do the work of publicity as per requirement and in the

interest

targeted

group

through

pamphlet/

brochures

/poster/

booklet/publicity van including hoarding, wall painting, exhibition etc at the

departmental rate fixed by 'Rate Fixation Committee' as per Rule 6 by the

order of competent authority. For this purpose the department can get the

work done by Bihar Samwad or through tender empanelling or selecting

suitable organizations/agencies/ team/firm etc.

ii.

The department can create public awareness of the programmes and policy of

the government through special drives and campaigns and functions through

cultural programmes and street plays. For this purpose the Information and

Public Relations Department, considering prevalent rate of other

departments, market rate, size of the team, the skill and performance of the

cultural team/street play group, the department fix the rate on the

recommendation of 'Rate Fixation Committee' mentioned in Rule-6 or the

department could get work done by selecting the cultural/street play team

through open tender. For this purpose the department could get work done by

suitable agency/agencies/team/firm etc. at departmental rate selected through

Bihar Samvad.

iii.

The department under the specific circumstances, occasion and special

campaigns can publicize through the hoarding installed by other

departments/organizations/ establishments etc for the advertising by the order

of competent authority, at the rate fixed by the said department/organization.

iv.

The department can advertise through hoardings/ flexes/ wall paintings done

on the property owned by others at the rate/ proper compensation/ rent/lease

as fixed by 'Rate Fixation Committee' as per Rules-6 and by the order of the

competent authority.

Electronic display boards/hoardings/flexes can be installed at important

public place with the approval of the concern organizations/departments/

establishments in their premises for publicity either free of cost or at the

departmental rate fixed by the 'Rate Fixation Committee' as per Rules-6 by

the order of competent authority.

18.

Publicity of the government policies, programmes, schemes and achievements

for mass awareness using Facebook/ Twitter/ Youtube/ Mobile Apps./SMS

under Social Media:-

As per the new techniques of public awareness through uses of internet and

other social media, publicity of the government policies, programmes, schemes and

achievements for public awareness can be achieve through Facebook/ Twitter/

Youtube/ Mobile Apps. /SMS and other Social Media in affective manner at the rate

fixed by the 'Rate Fixation Committee' as per Rule 6 with the approval of competent

authority. For this purpose the department could get work done by suitable

agency/agencies/team/firm etc. at departmental rate selected through open tender/

Bihar Samvad.

19.

Government Public Dialogue

Department, by itself or through "Bihar Samwad" can develop suitable

mechanism and infrastructure to understand the mood, perception and get feedback

of the general public on various issues, understand their reaction & response to the

news published/broadcast in media and arrange quick response to place the views of

the government on these issues and educate the masses about the facts of the case.

For this purpose the department can take the services of professionals, experts,

agencies and persons through out sourcing or through the Bihar Samvad Society.

20.

To obtain resources of Bihar Samwad as a facilitator-

The department can utilize, as per need, the resources of Bihar Samvad

Society as a facilitator for making the process of receipt, release and payment of

advertisement on line and transparent through suitable software; as per need the

department can also use these resources of Bihar Samvad for development and

design of classified and creative advertisement, tender composing of advertisement

of different departments and Local Bodies/Corporations/PSUs/Authorities/Societies

for release to the newspaper/magazines and various media against which the

department will pay suitable fees with the approval of the Finance Department.

21.

Supply of newspaper to client advertiser-

Every newspaper will be obliged to send one copy each of the newspaper on

their own carrying advertisements issued through Information and Public

Relations Department to the client at the address mentioned in the release order

and also to Information and Public Relations Department failing which payment

for the advertisement may not be considered.

ii. Newspapers have to inform Information and Public Relations Department within

48 hours, if they have not been able to publish the advertisement on the due

date..

22.

Publication of advertisement without release order-

No newspaper will publish advertisement released without receipt of the

relevant release order of the Information and Public Relations Department.

23.

Date of publication of the advertisement-

The newspaper will be obliged to strictly adhere to the date of publication of

advertisements as given in the Release Order. Publication of advertisement on dates

other than that given in the Release Order will not be accepted and no payment shall

be made if it is found that such publication does not fulfill the objectives of the

advertisement.

24.

Decorative/Display advertisement-

Information & Public Relations Department will not only release

advertisement (classified, display etc) of department and various

corporations/body/board/public undertakings/enterprises/authority under it,

but also do selection of newspaper/Magazine for the publication of that

advertisement, fixation/reservation of space for advertisement. The decision

of the department in selection of newspaper/Magazine for the release of

advertisement shall be final.

ii.

The design of advertisement and content/material would be sent by the

advertiser before the date of publication as per rules. The right to modify

and change the design and size of the advertisement, received from

various departments/corporation/body/society/public undertaking/enterprises/

authority etc. and to publish decorative advertisement after designing, related

to the achievements of the department, and its payment, will be vested with

the Information & Public Relations Department. Certain important

advertisement can be changed to "Display advertisement", by the Information

and Public Relations Department as per need and priority.

iii.

Department, on its own can release display and creative advertisements for

the publication on the important occasions/special events, such as

Independence Day, Republic Day, Bihar Divas, important festivals/birthdays

/martyr day of legendry personalities/important policies, programmes,

schemes and achievements of the government.

iv.

Information & Public Relations Department can release advertisements

whenever required on the special occasions related to inaugurations of

schemes, programmes, policies, important campaigns of the government for

general awareness.

Department can publish display masseges of H.E Governor, Hon'ble Chief

Minister & Hon'ble Ministers on specific ocassions.

25.

Change in the Size, Design & Creative of the Advertisement–

The right to change in the size, design & creative of the advertisement (classified,

display, etc.) of the various department & corporation/body/board/public enterprises/

establishment/ authority, under it would be vested with Information & Public Relations

Department which the departmennt could get amended as per requierment.

26.

Selection of News Papers –

After receiving the advertising material the selection of news papers for the

advertisement will be done by the competent authority on the basis of the nature of

advertisement, estimated amount considering the targeted group. The financial

sanction of its publication after the selection of news paper will be accorded by the

same competent level and it will be released to the newspaper for publication. The

decision of department in the selection of news paper/ papers for the release of

advertisement shall be final.

27.

Use of modern information techniques for publicity of the policies/programmes/

schemes/achievement of the government for public awareness; to obtain

services of professionals, experts and competent agency to develop "Brand

Bihar" through outsourcing,

Department on its own or through Bihar Samwad can develop advertising

material for different media at departmental rate.

In order to develop Brand Bihar and to publicize the programmes, policies,

schemes achievements for mass awareness in effective way, the use of modern

information techniques through professionals, experts and competent agencies can

be taken by the department through outsourcing and for this work the department

can make required payments.

28.

De-enlistment of newspapers/magazines/radio channels/ electronic media

channels/websites and other various media from the approved list

The Secretary shall be empowered to de-enlist various medium from the

approved list and stop issue of advertisements to them under one or more of the

circumstances mentioned below:-

If, it is proved at any time that the said media has given false information for

getting the government advertisement at the time of application or it still

carries false information continuously since applying for enlistment or it has

violated any conditions mentioned in the rules.

ii.

The said media/medium getting advertisement has not obeyed the provisions

of Press and Books Registration Act 1867, Cable TV Network Act,

Information Technology Act and other related rules/ regulations/ordinances/

released, time to time.

iii.

It has published any material or comment or such content adverse to national

interest and public decorum and moral parameters.

iv.

It does not follow the code of conduct promulgated by Indian Press Council

(IPC).

It has been indicted by any court/competent authority after the confirmation

of the complaint of immoral/anti social activities.

29.

Responsibilities of newspapers/magazines :–

The publishers of newspapers/magazine listed in the approved list of the

Information & Public Relations Department, to whom advertisements are

released, would invariably provide copies of their newspapers/magazines to

the Information & Public Relations Department and client.

ii.

If any advertisement is published in a wrong and erroneous manner, the

publisher would get it corrected and republished without any extra charge.

The publishers would publish the advertisements according to the release

order (RO). They will not make any change at their own level.

30.

Delegation of powers for release of advertisement :–

The financial power to sanction and release the advertisement to publicity

media having departmental rate & included in the approved list upto Rs.

5,00,000/- (Five Lac) will be vested with the Director, Information and

Public Relations Department, to the Principal secretary/secretary up to Rs.

25,00,000/- (Twenty Five Lac) and the departmental minister above

25,00,000/- (Twenty Five Lac).

ii.

Financial power to release advertisement to those media who are not in the

approved list or do not have departmental rate, shall vest with the Principal

Secretary/Secretary up to 25,00,000 (twenty five Lac) and with the

departmental minister above 25,00,000 (twenty five Lac) on recommendation

of the Empowered Committee at the rate fixed by the ‘Rate Fixation

Committee’.

iii.

The department could amend the aforesaid financial power as per

requirement with the approval of Finance Department.

iv.

The executive and financial power vested with departmental minister, in

these rules, could be delegated totally or partly by him in the interest of work

to the Principal Secretary/ Secretary.

31.

Strengthening of the Information & Public Relations Departments-

To ensure proper implementation of the Bihar Advertisement Rules, 2016 the

department will endeavour to strengthen the infrastructure of the advertisement

wing/section of the department & its field offices with modern and new information

technology and equipment, along with procuring the services of the expert

personnel/agency through outsourcing.

32.

Annual review of the approved list and departmental rate-

In general, the approved list would be valid for two years. The Empowered

Committee shall annually review the approved list and on the basis of its recommendation

annual extensions will be given by the department.

The annual review of the departmental rate of the different media would be done by

the rate fixation committee. If due to some unavailable circumstances, the new departmental

rate could not be determined, then, in that case till new departmental rates are decided, the

old departmental rate shall be valid. On the basis of which the department would revise the

departmental rate of the said media after the recommendation of rate fixation committee and

empowered committee.

The application in prescribed Performa shall be submitted by various media desiring

enlistment and departmental rate in the month of February each year. Annual revision on the

basis of the received application by such media will be considered by the Rate Fixation

Committee and the Empowered Committee on the basis of the quality of published

advertisements, the publication of news in general public interest, the information and

dissemination of various schemes of the government, the good work done during law and

order and communal situations and during natural and manmade disasters and its DAVP rate

etc. The department after due consideration of the recommendation of both the committees

shall annually revised the departmental rates.

33.

Miscellaneous-

(a)

With the coming into force of these Advertisement Rules, all orders,

directions issued on this subject in the past stands repealed. Notwithstanding

such repeal, anything done or any action taken in the exercise of any power

conferred by or under the said orders, directions shall be deemed to have

been done or taken in the exercise of the powers conferred by or under these

rules as if these rules were in force on the day on which such thing or action

was done or taken.

(b)

The Bihar Advertisement Rules, 2016 will be applicable with immediate

effect to all departments of the Government of Bihar and various

corporations/body/board/public undertakings/ enterprises/ authority under the

ownership and control of Government of Bihar.

(c)

The department will assess the implementation of these rules from time to

time and make amendments as required.

(d)

The department can decide the departmental rate, from a fixed date, through

the Rate Fixation Committee for various media which are already in the

approved list prior to coming into effect of these new rules. Till the new

departmental rates come into effect the old rates will be applicable.

34.

The concurrence of Finance Department, Home Department, Law Department, and

approval of Cabinet has been obtained in Bihar Advertisement Rules 2016.

Order- It is ordered that a copy of this resolution be published in the issue of Bihar (extra

ordinary) gazette for the information to the public and to send its copy to all related

department.
