The 11^th November 2016

S.O. 287 dated the 11^th November 2016—In exercise of the powers conferred by

Section 10 of the Bihar Electricity Duty Act, 1948 (Bihar Act xxxvI of 1948), the Governor

of Bihar is pleased to make the following amendments in the Bihar Electricity Duty Rules,

1949 which has been previously published in the official gazette vide Notification No. 271

dated 07.10.2016 as required under the said section.

2. This notification shall come into force with effect from the date of its issue.

Amendment

1. Amendment in Rule 4 of the Bihar Electricity Duty Rules, 1949.- Sub-Rule

(1) of Rule 4 of the Bihar Electricity Duty Rules, 1949 shall be substituted by the following,

namely-

"(1) When the appropriate authority referred to in sub-rule (2) of rule 3, after making

such inquiry, as he considers necessary, is satisfied that the applicant has correctly given all

the required information and that the application, is otherwise in order, he shall, register the

applicant and grant him a certificate of registration in Form-II within thirty days from the

date of receipt of the application."

2. Insertion of a new rule 9B in the Bihar Electricity Duty Rules, 1949.- After

Rule 9A of the Bihar Electricity Duty Rules, 1949 the following new rule 9B shall be added,

namely:-

"9B. Notwithstanding anything contained in the Rules, the Commissioner,

Commercial Taxes, by notification, may issue an order to file return specified in the

rules, through electronic device."

3. Amendment in Form-I prescribed under the Bihar Electricity duty Rules,

1949 :- After Sl. No. 1 in Form-I prescribed under the Bihar Electricity duty Rules, 1949

the following Sl. No. 1A, 1B and 1C shall be added, namely:-
