The 27th October 2016

No. 2160—In exercise of the powers conferred by the proviso of Article 309

of the Constitution of India, the Governor of Bihar is pleased to the following Rules.

Chapter – I ( Preliminary)

1. (1) Short title, extent and commencement. These Rules may be called “Non-

gazetted Cadre of Sugarcane Industry Department (Recruitment and Service

conditions) Rules, 2016.” (Sugarcane Industry Department)”.

(2) It will extend to the whole of the state of Bihar.

(3) It shall come into force at once.

2. Definitions – In these Rules, unless in the subject or otherwise requires -

(i) ‘Government’ means, the State Government of Bihar,

(ii) ‘Department’ means, the Department of Sugarcane Industry,

(iii) ‘Commission’ means, the Bihar Staff Selection Commission ;

(iv) ‘Cadre’ means Lower Division Clerk Cadre, Steno-typist Cadre, Jan-Sevak

Cadre, Seed Production Assistant Cadre, Mobile employee cadre and

Vehicle Driver Cadre under the Department of Sugarcane Industry;

(v) ‘Appendix’ means Appendix-1 attached with these Rules;

(vi) ‘Appointing Authority’ means The Cane Commissioner, Bihar.

Constitution of Cadre –(1) The following sub cadres in shall be in the Non-

gazetted cadre:

(i) Lower Division clerk:

(ii) Steno- Typist :

(iii) Jan-sevak :

(iv) Seed production Assistant :

(v) Mobile employee:

(vi) Vehicle Driver :

(2) The category wise number of posts in each cadre shall be such may be

sanctioned by the Government from time to time.

4. Chain of Posts of The Cadres – Different categories and Chain of posts in each

cadre of this service shall be according to Appendix-1 of these Rules.

Chapter -2 (Recruitment)

5. Recruirement -(1) The appointment in this service shall be to the Posts of basic

category (level of Lower Division clerk, Steno typist, Jan-sevak, Seed production Assistant,

Mobile Employee and Vehicle Driver.

(2) The minimum educational qualification shall be as specified in appendix-1.

(3) The maximum age limit shall be the same as may be determined reservation

wise by the Government from time to time . Cut off date for determination of age shall be 1^st

August of the concerned year.

6. Process of recruitment – (1) The Department after calculating the vacancies on

the basis of position on 1^st April and roster clearance, shall send reservation wise requisition

to The Commission up to 30^th April.

(2) The Commission shall prepare merit list. After preparing merit list, the

Commission, with the help of the Department, shall cause the preliminary of certificates

and health check up of the candidates and thereafter the final reservation category wise

recommendation of successful candidates in cofirmity with the notified vacancy shall be

sent to the Department. The Department shall also get the Certificates and the past

antecedents of the successful candidates will be verified at the department level also of the

checking of the Certificates.

(3) After recommendation of the Commission compliance of instructions of the

Government, issued regarding procedure of appointment process from time to time, will be

compulsory.

Chapter-3

Probation/Departmental Examination/Confirmation

7. Probation Period– Every appointment shall be on probation for two years and

in special circumstances, it may be extended for one year by the Appointing Authority if

the probation period is not satisfactory. Such extension will only be made when in the

opinion of the Appointing Authority there is possibility of improvement in the

probationer. If the person is not found satisfactory even during the extended period the

concerned person shall be dismissed from the service. No notice or show cause will be

required to be served upon him/her. Written order will however, be issued to him.

8. Departmental Examination – An employee must have to pass the Departmental

Examination, conducted by the Board of Revenue, Government of Bihar.

9. Confirmation – A probationer shall be confirmed after satisfactory completion

of probation period and passing of the Departmental Examination.

10. Seniority – Inter-se-seniority of the members of the cadre shall be according to

their merit list determined by the Commission. Provided that the Inter-se-seniority

determined before the commencement of these Rules, shall remain unchangeable. Provided

further that persons, appointed on compassionate ground, shall be junior to the persons

appointed on the basis of the Competitive Examination in the concerned recruitment year.

Provided further also that persons, appointed by promotion in a particular appointing

year, shall be senior to the persons appointed on the basis of the Competitive Examination in

the concerned appointing year.

Chapter -4 (Promotion)

11. Promotion – (i) Consideration to give Promotion to the confirmed employee

may be made as per appendix-1 subject to the availability of post and seniority cum

suitability.

(ii) Compliance of the directions/orders issued by the Government from time to

time, regarding character roll/charge/departmental proceeding/ criminal proceeding etc.

shall be compulsory at the time of considering of promotion.

12. Departmental Promotion Committee- (i) Promotion shall be considered on the

basis of the recommendation of the Departmental Promotion Committee. The structure of

the Departmental Promotion Committee shall be in conformity the Departmental Promotion

Committee instructed for Service Departments issued by the Department of General

Administration from time to time.

13. Assured Career Progression(A.C.P.) – Compliance of the Pre-conditions which

will be applicable to regular promotion for A.C.P. also.

Chapter -5 (Miscellaneous )

14. Reservation – Compliance of the Reservation Act of the Government and the

reservation roster for direct recruitment and promotion, issued by the Government from

time to time, will be compulsory.

15. Appendix-(1) – The chain of post of mentioned in appendix-1 shall be effective

only after the approval of the Government. If any change or amendment is made in

appendix-1 by the Government in cause of consideration on the approval, appendix-1 will

be deemed to be changed or amended accordingly and such changed or amended chain of

posts shall be treated as part of these Rules.

(2) All employees already appointed/ promoted and working, before the

commencement of these Rules, on the posts mentioned in appendix 1, shall be deemed to be

included automatically cadre wise in this cadre.

16. The relevant service code /rules/resolution/ circular of the Government shall be

applicable to such subjects for which provisions cannot be made in these Rules.

17. Removal of Difficulty – If any difficulty arises in implementing any provision

of these Rules, the Department may remove such difficulty after consultation with the Law

Department by notification order which is not inconsistent with the provision of these Rules.

18. Interpretation – If there is any doubt related to the interpretation of any

provision of these Rules, the matter will be reffered to the Department whose decision after

consultation with the Law Department, in this regard shall be final.

19. Repeal and Saving – (1) All the resolutions /orders/ instruction circulars etc.

previously issued relating to this cadre are here by repealed.

(2) Not withstanding such repeal anything done or any action, taken under the

resolutions /orders/ instruction/circulars shall be deemed to be done or taken under these

Rules as it were in force on the day when such thing was done or such action was taken.
