No. ds0@dkjk@v0fu0 21@2008&6977—In exercise of the powers conferred by proviso to

Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the

following Rules to regulate the recruitment and other service conditions of Clerks in Prisons

situated in the State:-

“Bihar Prisons & Correctional Services Clerks Cadre (Recruitment and

Service Conditions) Rules, 2016.”

1. Short title, extent and commencement – (1) These Rules may be called “Bihar Prisons

& Correctional Services, Clerks Cadre (Recruitment and Services Conditions) Rules, 2016.”

(2) It shall extend to the whole of Bihar.

(3) It shall come into force at once.

2. Definitions - In these Rules, unless otherwise requires in context-

(i)

“Cadre” means the Clerk cadre of the prisons of the State;

(ii)

“Commission” means The Bihar Staff Selection Commission;

(iii)

“Appointing Authority” means Inspector General, Prisons & Correctional

Services, Bihar.

(iv)

“Department” means The Home Department as mentioned in Executive

Rules;

(v)

“Prisons & Correctional Services Inspectorate” means the office of Inspector

General, Prisons & Correctional Services, Bihar.

(vi)

“Fixed date” means date of commencement of these Rules;

(vii)

“Regularly appointed Personnel of Group-D” means those personnel of

Group-D whose services have been confirmed;

(viii) “Member” means any person appointed in the cadre and it includes all the

persons already appointed before the commencement of these Rules;

(ix)

“Appointment on the compassionate ground” means the appointment of

anyone dependent of the deceased Government Servant of the department

died in the service period as per relevant circulars, instructions.

3. Constitution of the cadre - (1) Hierarchy of the cadre shall be as follows:-

Lower Division Clerk

Basic category

Upper Division Clerk

First promotion level

Head Clerk

Second promotion level

(2)

Number of posts in each category and their total number shall be such as it

has been determined by the Government and in future as it will be sanctioned

or notified by the Government from time to time.

(3)

The pay scale of posts of this cadre shall be the same as it will be sanctioned

by the Government, from time to time.

4. Recruitment - (1) Entry point in the cadre shall be the post of “Lower Division Clerk”.

(2)

All the direct recruitment shall be made on the post of Lower Division Clerk

on the recommendation of the Commission.

(3)

The appointing authority shall calculate vacancies as on 1^st April of every

year and shall send the requisition to the Commission by 30^th April of every

year.

(4)

85% Post of lower Divisional Clerk shall be filled up through direct

recruitment and 15% post shall be filled up from Group-D eligible employees

who have Intermediate or equivalent qualifications.

(5)

The Commission shall advertise vacancies and after selecting successful

candidates on the basis of Competitive Examination, shall recommend the

names in order of merit. The merit list shall be valid for one year from the

date of receipt of recommendation in the Department.

(6)

The Appointing Authority will appoint the candidates on probation of two

years after due enquiry.

5. Recruitment through Promotion - (1) The Appointing Authority shall prepare seniority

list of Intermediate Passed Group-D employees.

(2)

Promotion shall be given according to the seniority on the recommendation

of the Departmental Promotion Committee.

6. Qualification - (1) The minimum educational qualification shall be intermediate (10+2)

pass or equivalent alongwith knowledge of computer operation and computer

typing.

(2)

Age:- Minimum and maximum age limit for recruitment shall be the same as

decided by the State Government (General Administrative Department),

from time to time.

7. Reservation - For appointment and promotion it shall be necessary to follow the

Reservation/ Roster as notified by the State Government, from time to time.

8. Probation Period - The period of probation shall be for two years for every recruitment

(including recruitment on compassionate ground), and it may be extended for one year by

the appointing authority, if the probation period is not satisfactory. Such probation period

shall be extended only if in the opinion of the appointing authority there is chance of

improvement in the employee.

If the service is not found satisfactory even in the extended period, the service of the

employee on probation shall be terminated.

9. Departmental Examination - (1) The Departmental examination shall be conducted by

the Board of Revenue.

(2)

Departmental Examination shall comprise of two papers and it will be

necessary to secure 40% marks to pass in each paper.

(A)

First paper-

Service Rules:- Bihar Service Code, Bihar Pension Rules, Rules regarding

Seniority & promotion, Noting & Drafting.

(B) Second paper -

Financial Rules:- Bihar Treasury Code, Bihar Finance Rules, Practice and

Procedure, Board of Miscellaneous Rules, General Provident Fund Rules, Travelling

Allowance Rules, Insurance Rules.

10. Confirmation - Any probationer shall be confirmed only after satisfactory completion

of the probation period, passing of departmental accounts examination and Computer

efficiency test.

11. Seniority – The inter-se-seniority of employees shall be determined as per their merit

position determined by the Commission; but their seniority already determined before the

enforcement of these rules shall remain unchangeable.

Provided that the person appointed on compassionate ground shall be junior to those

employees who have been appointed directly on the basis of the Competitive Examination

in the concerned recruitment year.

Provided further also that the employee appointed through promotion in the

concerned recruitment year shall be senior to the person directly appointed on the basis of

Competitive Examination.

12. Promotion - (1) Only confirmed employees shall be considered for promotion.

Besides, promotion in upper grade of the Cadre shall be given on completion of Kalawadhi

determined by the General Administrative Department from time to time and on the basis of

seniority-cum-merit only, on the recommendation of the Departmental Promotion

Committee.

(2) The Departmental Promotion Committee shall be constituted as follows:-

(a) Inspector General, Prisons & Correctional Services

- Chairman

(b) Joint Secretary-cum-Director (Administration)

- Member

Member

Secretary

(d) One officer of S.C/S.T. determined by the Chairman

- Member

(e) One officer of minority community determined by the Chairman- Member

13. Level of the cadre - This cadre shall be a State Level Cadre and the power of transfer

and posting shall vest in Inspector General, Prisons & Correctional Services, Home

Department, Bihar, Patna.

14. Residual Matters – In respect of such matters which have not been particularly covered

under these rules, members of the Cadre shall be governed by the rules, regulations or

orders applicable to the officers/staff of the State Government of appropriate level.

15. Removal of Difficulties - The State Government (Prisons & Correctional Services,

Home Department) may issue general or specific direction if any difficulty arises in giving

effect to the provisions of this Rule after consultation of The General Administrative

Department and Law Department.

16. Interpretation - Whenever there is any doubt regarding any of the provisions of these

Rules, such issues shall be decided by Inspectorate of Prisons & Correctional Services,
