conferred under section 115 of the Bihar State Housing Board Act, 1982, following

amendment is made in the Bihar State Housing Board (Management and Disposal of

Housing Estates) Regulation 1983:-

Amendments

1. Regulation no.9 (Income category) of the Bihar State Housing Board

(Management and Disposal of Housing Estates) Regulation is substituted by the following:-

“9. The applicant must belong to the particular income group in which category the

dwelling unit or flat or site applied for is available. The various income groups are indicated

as follows:-

(A)

Economically Weaker Sections (EWS)-

Income group

Rs.1,00,000/- or less (Annual).

(B)

Lower Income Group

-Above Rs.1,00,000/- and upto Rs.2,00,000

(Annual)

(C)

Middle Income Group-Above Rs.2,00,000/- and upto Rs.5,00,000/-

(Annual)

(D)

High Income Group-Above Rs.5,00,000/- (Annual)

2. Regulation no. 10(2) of the Bihar State Housing Board (Management and Disposal

of Housing Estates) Regulation is substituted by the following :-

“(2). The allotment of the remaining housing units (House/Flat/Site) after the

allotment under sub-regulation (1) will be made according to the quota as follows:-

(A)

General-

50 Percent

(B)

Scheduled Caste-

16 Percent

(C)

Scheduled Tribe-

01 Percent

(D)

Extremely Backward class-

18 Percent

(E)

Backward class-

12 Percent

(F)

Handicapped-

03 Percent

In the light of the points mentioned herein above, 10 Percent from the reserved

category will be kept reserved for the ex-servicemen/ dependants of the said reserved

category. In case application of ex-serviceman/dependants of particular category is not

received then the allotment will be made in the said category.

In the context of aforesaid subject, following persons are included in the category

of dependants of ex-servicemen:

(i)

Wife;

If second marriage has been performed with the prior permission of the

government, then second wife but the preference of the first wife will be the first and the

application of other wives will be considered only when the first wife/senior wife has given

no objection and affidavit. However, further proceeding will be made only after verification

about the truthfulness of such no objection and affidavit. The application of other

dependants will be considered in accordance with their preference and on the basis of no

objection and affidavit of live legal wives.

(ii)

Son;

(iii)

Unmarried daughter;

(iv)

Widow of son;

(v) Adopted son

In case of Hindu provided adoption

(vi) Adopted unmarried daughter

has been made according to Hindu

Adoption and Maintenance Act and

such claim is valid under the aforesaid Act;

(vii)

Divorced/ deserted daughter provided that divorce/ dissolution of marriage has

been made by competent court and she is the only dependant in the family of the

deceased ex-serviceman apart from his widow;

(viii)

Younger brother (in case of unmarried ex-serviceman) when younger brother is

the dependant of such deceased ex-serviceman;

(ix)

Unmarried younger daughter (In case of unmarried ex-serviceman) when

unmarried younger daughter is the dependant of such deceased ex-serviceman;

(x)

Widow mother (in case of unmarried ex-serviceman) when widow mother is

the dependant of such deceased ex-serviceman;

In case of missing serviceman, request for allotment can be considered under the

following conditions:-

(i)

First Information Report has been registered in the police station in

this respect;

(ii)

It is difficult to trace out the missing person;

(iii)

Competent authorities feels that the matter is true;

(A)

The aforesaid benefit will not be available in the case of such serviceman:-

(i)

Who is to retire within two years from the date of missing;

(ii)

On whom there is suspicion of cheating or there is suspicion of involvement in

any militant organization or there is suspicion of going to foreign;

(B)

Like other matters in case of missing serviceman also, allotment shall be not a

matter of right and such allotment may be made after fulfilment of all the conditions

including the availability of estate.

(C)

At the time of considering such allotment, result of police investigation will also

be kept in the mind.

(D)

If the missing serviceman appears after allotment to the dependant of such

missing serviceman, such allotment shall be deemed to be cancelled and the money which

has been received at the time allotment will be refunded.

Regulation No.-10 (2) Note-iii of The Bihar State Housing Board (management

and disposal of housing estates) regulation 1983 is here by deleted.

This notification will come in to force with immediate effect.
