No. 6/Est. Appointment- 6/2010&118—In exercise of powers conferred under provision to

Article- 309 of the Constitution of India, The Governor of Bihar is pleased to make the following

Rules for regulating the Recruitment and Service Conditions of Non-Gazetted Posts in the

Service/Cadre of the Field Assistant of Bihar Agriculture Farm under the Agriculture Department.

1. Short title, extent and commencement.–(1) These Rules may be called, the Bihar

Agriculture Farm / Field Assistant Services Rules, 2017.

(2)

It may be extended to the whole of State of Bihar.

(3)

It shall come into force at once.

2. Definitions.— In this Rules, unless otherwise requires in the context:-

(1)

"State Government" means, State Government of Bihar;

(2)

"Department" means, Agriculture Department, Bihar;

(3)

"Cadre Controlling Authority" means, Director of Agriculture, Bihar;

(4)

"Director" means, Director of Agriculture, Bihar;

(5)

"Cadre" means, Field Assistant Cadre of Agriculture Farm, Bihar;

(6)

"Appeal Authority" means, Principal Secretary/ Secretary, Agriculture

Department, Bihar;

(7)

"Appointment Authority" means, Director of Agriculture, Bihar;

(8)

"Category" means, Categories specified in Rule- 3;

(9)

"Equivalent Post" means, the Post of Agriculture Inspector equivalent to Post of

Farm Manager;

(10)

"Commission" means, Bihar Staff Selection Commission, and

(11)

"Appointed Date" means, effective date of these Rules;

Constitution of Cadre and Hierarchy.—

(1)

The structure of Field Assistant Cadre and Appointing Authority of Agriculture

Farm, Bihar will be according to the following:-

The Pay structure of Cadre posts shall be the same as it may be determined by the

State Government from time to time.

(3)

Persons already working and adjusted on the basis of appointment/ deputation in

the said category before the commencement of these Rules, shall be deemed to be

included in this Cadre automatically.

(4)

This Cadre will be of State level.

4. Cadre Strength.— The number of posts of each category of Cadre strength and its total

number will be as many as it is approved/determined by the State Government till the effective date

of The Cadre Rules, 2017 and after that as it may be sanctioned or determined by the State

Government.

5. Appointment.—Appointments shall be made on the basis of the General Competitive

Examination, organized by the Bihar Staff Selection Commission from time to time for this purpose

of in the Cadre of Field Assistant by direct recruitment. The Administrative Department, calculating

the reservation category wise vacancies, on the basis of 31st March of every year shall made

available requisition to the Commission up to 30th April. The recommendation List of the successful

selected candidates on the basis of reservation category wise merit list shall be made available to the

Department by the Commission The appointment will be made by the Department from the

recommended category wise merit list of the Commission.

6. Educational Qualification:-

(1)

For the appointment in this cadre, the minimum educational qualification will be

I.Sc./Diploma in Agriculture.

(2)

Age-Limit- For the candidates, the age-limit will not be less than 18 years on the

1st August of the year of issuing /publishing the Advertisement by the

Commission and the maximum age-limit will be the as it may be determined by

the State Government (General Administration Department) from time to time.

7. Probation.—Field Assistants will be declared on probationer from the date of joining

(appointment). The Probation-period will be of two years. At the time of probation, it will be

essential to complete the activities of the serve and to execute departmental liabilities fully in the

probation period. At the time of test, if On service not found satisfactory in the Probation period,

Probation period may be extended for one year and he may be terminated from service on grave

allegation against him.

8. Confirmation.— The service of the person appointed on probation will be confirmed by

the Administrative Department on passing the Departmental Examination organized by the

Department and completing the required period of probation satisfactorily.

9. Seniority.— Inter-se-seniority of the members of the Service already appointed in any

category before the appointed date, will be determined according to their inter-se-seniority as

determined before such date. But if the seniority of any member or members of the service specially

not be determined before of that date, the determination of his seniority will be made by the Cadre

Controlling Authority.

(2) All the employees included automatically in any category will be senior from those

employees whose appointments have been made on any date after the appointed date

in that category.

(3) The inter-se-seniority of the appointed Field Assistants on the basis of Competitive

Examination conducted by Commission will be according to merit- order

determined by the Commission. The seniority list of each category of Cadre will be

maintained separately.

For promotion in cadre, confirmation of service will be essential.

12. Kalawadhi,— It will be essential to complete kalawadhi determined by the State

Government from time to time for the promotion.

13. Departmental Promotion Committee.— The promotion in Cadre will be given on the

recommendation of the Departmental Promotion Committee. Departmental Promotion committee

will be constituted by the Department, for promotion.

14. Promotion:-

(1) On the recommendation of Departmental Promotion Committee, all the promoted

posts will be filled up by cent percent promotion.

(2) Criterion of selection for Promotion.— Criterion of suitability for promotion in

the Cadre will be the principle of Seniority-cum-Qualification.

15.(1)

Administrative Control on the Members of the Cadre.— Agriculture Department,

Bihar will be the Administration Department of the posts of all categories of

this Cadre who will keep Administrative Control on the members of the Cadre.

(2)

Operation Control-In which Sub.— Division/District/Division, the members of

this Service/Cadre will remain posted, they will remain in the operational control

of that Sub-Divisional Agriculture Officer/ District Agriculture Officer/Divisional

Joint Director (Agriculture).

(3)

The Head Office of the Members of all the categories of the Cadre will be the

Agriculture Department.

(4)

The Cases relating to creation of new posts, selection, service confirmation of the

employees and promotion of all the posts/ appointment/transfer/posting and

deputation etc. in the cadre will be maintained at the Departmental level.

16. Disciplinary Action.— All the members of this Cadre will be governed under the Bihar

Government Servant (Division, Control and Appeal) Rules, 2005(As amended from time to time).

17. Relaxation of the Rules.— If the Government is satisfied that any difficulty is arising

in implementing any rule relating to service-conditions of any category, it may remove such

difficulty after consultation with the General Administrative Department and Law Department, by

order which is not inconsistent with the provision of these rules.

18. It will be essential to follow the Reservation Act and other provisions related there to

enforced in the state and the Reservation Roster for Direct recruitment and promotion issued from

time to time.

19. Miscellaneous subjects.— In the context of the cases not covered by these Rules or

Orders, issued there under, members of this Service will be governed by appropriate level of the

Code / Rules / Resolution / instructions enforced to the level of employees of the State Government..

20. Interpretation.— On doubt arising in regards to interpretation of any provisions of

these Rules, it will be referred to the concerned Department and in this regards, the decision made by

the Department, after consultation of the law Department, will be final.

21. Power to make Regulation.— For implementation of the prescribed provision in these

Rules, The regulation may be made by the State Government.

22. Repeal and Savings.—

(1) Previous Resolutions/ Rules/ Orders etc. relating to this service/ Cadre issued by

the Department from time to time are hereby repealed.

(2) Not withstanding such repeal, anything done or any action taken under the said

Resolution / Rules / Orders etc, Previously issued will be deemed to be done

under these Rules as if, these Rules were enforced on the date on which such

anything was done or such action was taken.
