309 of the Constitution of India, the Governor of Bihar is pleased to make following Rules

to regulate appointment and service conditions in the Library cadre under the Health

Department :-

1. Short title, extent & commencement.- (1) These Rules may be called as the

"Bihar Health Library Cadre (Recruitment and conditions of service) Rules, 2017".

(2) It will extend to the whole State of Bihar.

(3) It will come into force at once.

2. Definitions.- Unless otherwise required in the subject or context, in these Rules:-

(i)

'Government' means Bihar State Government;

(ii)

'Department' means Health Department;

(iii)

'Commission' means Bihar Staff Selection Commission;

(iv)

'Appointing Authority' means Director-in-Chief, Health Services, Bihar;

(v)

'Cadre' means Bihar Health Library Cadre;

(vi)

'Appendix' means appendix appended to these Rules; and

(vii) 'Library' means Libraries of different offices of the Health Department,

different Medical Colleges/Ayush Medical Colleges/Tibbi College.

3. Constitution of Cadre.- (1) The Health Library shall be State level Cadre. In

this cadre, number of posts in every category and total number of posts in the cadre shall be

as many as may be sanctioned by the Government, from time to time.

(2) The posts of Library Assistant Librarian etc in different offices of the Health

Department, different Medical Colleges/AYUSH Medical Colleges/Tibbi Colleges shall be

deemed to be included in this cadre.

4. Chain of posts in cadre.- Different Categories or chain of posts of this cadre

shall be such as is specified in the Appendix.

5. Recruitment.- Appointment in this cadre shall be in the basic category post of

Library Assistant by direct recruitment, on the basis of recommendation of the

Commission.

6. Qualifications.- (1)

For appointment by direct recruitment to the basic

Category post, (Library Assistant) minimum educational qualification shall be Graduation

degree from any recognised University and Diploma-in- Library & Information Science.

(2) For direct recruitment in the Library Cadre, minimum age-limit shall be 21 years

and maximum age-limit shall be the same as may be determined reservation categorywise,

from time to time, by the Government (General Administration Department).

(3) 1st August of the concerned year shall be deemed to be the cut off date for

determination of age.

7. Procedure of recruitment.-(1) The appointing authority, after calculating

vacancy on the basis of position as on 1st April of the year and getting roster cleared, shall

send reservation category wise requisition to the Commission latest by 30th April.

(2) In light of requisition, the Commission shall invite applications after advertising

vacancies. The total marks for educational qualification and Interview shall be 100 and the

Commission shall prepare merit list on following basis:-

(a)

For marks obtained in Graduation degree course

examination, ----------------------------------40 marks

(b)

For marks obtained in Diploma in Library & Information Science course

examination ------------------30 marks

(e)

For Interview----------------------------------------15 marks

Total 100 marks

Note.- The marks to be given to a Candidate for marks obtained in the Graduation degree

and Diploma in Library & Information Science examinations shall be determined by

multiplying percentage of total marked obtained in the aforesaid examination by

multiple of 0.4 and 0.3 respectively For example, if a candidate has obtained 50%

marks, he will be given 50%x0.4=20 marks for graduation examination and

50%x0.3=15 marks for Diploma in Library & Information Science examination.

(3) Procedure for interview shall be determined by the Commission.

(4) A minimum of 30 marks will be required for consideration for appointment. The

Commission shall prepare merit list, on the basis of Sub-rule(2). For preparation of merit list

the marks obtained in Interview shall be added to the marks obtained after calculation of

marks on the basis of educational qualification. Accordingly the merit list shall be prepared

on the basis of marks obtained. Preliminary scrutiny of the certificates and medical check up

shall be conducted by the Commission with the cooperation of the Appointing Authority,

and thereafter reservation categorywise final recommendation in accordance with the

requisitioned vacancies, shall be sent to the Appointing Authority. At the level of

Appointing Authority also, antecedents of candidates shall be caused to be verified after

scrutiny of certificates.

(5) (a) After receipt of recommendation of the commission, it shall be necessary to

comply with the instructions, issued by the Government, from time to time, with respect to

procedure of appointment.

(b) The recommendation of the Commission shall be valid for one year from the date

of its receipt.

8. Probation Period.-After appointment the candidates will be put on probation.

The Probation period will be of two years. In case, the service during probation period is not

found satisfactory, the probation period will be extended for one year. If the service is not

found satisfactory in extended period also, then the Appointing Authority may terminate the

service of such Library Assistant.

9. Training.- During probation period, the Library Assistant shall have to complete

such training as may be determined by the Department.

10. Departmental Examination.-On completion of probation period the Library

Assistant shall have to pass the Departmental Examination. The syllabus of the

Departmental Examination will be determined by the Department.

11. Confirmation.-On satisfactory completion of probation period successful

completion of training and passing of Departmental Examination, Library Assistant may be

confirmed in the service.

12. Seniority.- The inter-se seniority of Library Assistant shall be determined

according to the merit list prepared by the Commission:

Provided that the inter se seniority of persons appointed before coming into force of

these Rules shall be according to their dates of appointments.

13. Chain of promotion:-(1) Subject to availability of vacancy, confirmed Library

Assistant may be considered to be promoted on the post of chain of posts for promotion

mentioned in Appendix, according to seniority- cum merit.

(2) For promotion, it shall be necessary to comply the instructions relating to

'KALAWADHI' issued by the government, from time to time.

(3) Compliance of instructions issued by the Government, from time to time, with

respect to promotion, and Character Roll/P.A.R, allegation/ departmental proceedings/

criminal proceedings, etc shall be necessary at the time of consideration of promotion.

14. Departmental Promotion Committee.- Promotion may be considered on the

basis of recommendations of the Departmental Promotion Committee. The Departmental

Promotion Committee shall be constituted by the Department.

15. Reservation.- It will be necessary to comply with the Reservation Policy of the

Government and reservation roster for direct recruitment and promotion, issued by the

Government, from time to time.

16. The chain of posts mentioned in Appendix shall be effective only after approval

of the Government. If, in course of consideration of approval, any modification or

amendment is made by the Government in the chain of posts mentioned in appendix-1 then

the appendix-1 shall be deemed to be modified or amended accordingly and such

modified/amended level of posts shall be deemed to be the part of these Rules.

17. The personnel's appointed/promoted and working on the posts of Library

Assistant, Librarian etc in the different offices of the Health department/Medical

Colleges/AYUSH Medical College/Tibbi College prior to coming into force of these Rules,

shall be deemed to be automatically included in this cadre.

18. Residue matters.-For the subjects which have not been provided in these Rules,

Provisions of concerned Codes/ Rules/ Resolutions/ Instructions of the Government shall

apply .

19. Interpretation.- If any doubt arises with respect to the interpretation of any

provision of these Rules, it shall be referred to the Department and in this respect decision

of the Department after consultation with The Law Department, shall be final.

20. Removal of difficulties.- If any difficulty arises in implementation of provisions

of these Rules, the Department shall have powers to remove such difficulty by any special

order which is not in consistent with these Rules after consultation with Law Department

and General Administration Department.

21. Repeal & Savings.-(1) All Rules Resolutions, Orders, Instructions etc. issued

from time to time, by the Department with respect to this cadre prior the comming into force

of these Rules shall be deemed to be repealed with effect from the date of coming into force

of these Rules.

(2) Notwithstanding such repeal, any thing done or any action taken in exercise

of powers conferred by aforesaid Rules, Resolutions, Orders, Instructions etc shall be

deemed to be done or taken under these Rules, as it these Rules were in force on the date on

which such a work was done or such an action was taken.
