Definition, Identification and Protocol for Bihar Black Spots
No-06/Road Safety (Court)-1879— In exercise of the power conferred by section 135 (1) (a)
of Motor Vehicle Act, 1988 the Government of Bihar is hereby pleased to formulate the definition
and protocol i.e. an annual calendar or time table for identification of Black Spots, their rectification,
monitoring to check the efficacy of rectification action taken and allocat specific responsibilities to
the designated authorities.
1. Preamble.—Globally, road crashes kill an estimated 1.3 million persons a year and injury
more than 50 millions, affecting a huge economic losses and to irreparable loss of human life of the
poor. More than half the road deaths in developing countries are of pedestrians and cyclists. Bihar
one of the low income states of the country is no exception. Although lower than the national
average, rapid motorization and road development programmes in the state are likely to increase
road fatalities. The Government of Bihar is keen to take concrete measures to control the road
accidents and ensure safe travel for all road users.
2. Black Spot.—“Black Spot” means a road section categorically spread over 200 meters in
urban areas, 400 meters in suburban areas and 600 meters in rural areas junction or a spot having 10
accidents in a calendar year to be declared as Black Spot.
3. Protocol for the Identification of Black Spots.—
(i)
For the identification of a Black Spot, the Crime Investigation Department of Police
under Home Department shall collect, store and analyse the fatalities/accident data.
(ii) A standardized accident reporting form shall be made mandatory to collect
fatalities/accident data in a uniform manner state-wide.
(iii) After the end of every calendar year, the Senior Superintendent of Police/
Superintendent of Police of the District shall prepare a list of Black Spots, based on
the analysis of fatalities/accident data under consideration, between 15th of January
to 31st of January of the current year.
(iv) The District Magistrate of every district shall convene a meeting of the District Road
Safety Committee in the first week of February every year to discuss and prepare a
list of Black Spots allocating inter-se first priority, second priority, third priority etc.
to each.
(v) The Senior Superintendent of Police/Superintendent of Police of the concerned
district shall make available the list of Black Spots to Crime Investigation
Department, latest by 15th of February every year.
(vi) The Crime Investigation Department shall prepare a consolidated State list of Black
Spot based on the analysis of fatalities/ accident data and make it available to the
State Road Safety Council, latest by 15th of March Every year.
(vii) The Secretary of the Bihar State Road Safety Council shall convene a meeting of the
Executive Committee latest by 15th of April of the current year to discuss, prepare
and notify the finally consolidated list of the Black Spots. Such list shall be made
available to concerned Engineering Departments for necessary action i.e. NH, SH,
RCD, RWD, etc, immediately.
4. Rectification of Black Spots.—
(i)
After obtaining the approved State list of Black Spots, the executing agency shall
take necessary action for preliminary joint inspection of the identified site by
Highway Engineers, Police Officials, Road Safety Expert (s) and mandatory
consultation with Road Safety Expert (s) and obtain his/her recommendations on the
required remedial majors in respect of each identified site.

(ii) Discussions with the public and representatives of local bodies may also be duly
undertaken in identifying the reasons/remedial measures for repeated accidents/
fatalities.
(iii) On the basis of output of the identification exercise, the executing agency shall
prepare a list of black spots district wise i.e. according to the jurisdiction of the road
owning/managing agencies in the district.
(iv) For the determination of black spots as describe in above (ii) and (iii) a maximum
length up to 1.0 Km may be considered for a particular Black Spot.
(v) After finalisation of such black spots, the executing agency shall frame estimate and
obtain approval/sanction from the Executive Committee of the Council, as per
guidelines issued from time to time.
(vi) If road related issues cannot be readily identified, it should be concluded that the
accidents are possibly due to reasons other than those attributed to road (like
mechanical problem in vehicle, driver’s fault or any other issues).
(vii) In such circumstances, no further road related action shall be required and it should
be declared so and be removed from the list of Black Spots, with the prior approval
of the Executive Committee within three months.
(viii) In such cases where the road related deficiencies, which might have caused the
accidents, are identified, the execution of the remedial measures including
acquisition of the land for implementation of the road safety measures for removal
of Black Spots should be taken up on priority and the same should be completed in
minimum possible time commensurate with the size/complexity of the remedial
measures, as per the respective contract conditions.
(ix) In any case, short term measures like installation of road signs, road making, speed
reduction measures and repairing of damages causing in safe condition on roads
shall be taken up immediately and completed within 3 months of identification of
Black Spots.
(x) The progress of the execution of these remedial measures shall be regularly reported
to Nodal Agency i.e. Transport Department.
(xi) After the execution of remedial measures and post rectification evaluation of each of
those sites in a fix timeframe, the concerned Black Spot shall be removed from the
list, with the prior approval of the Executive Committee.
5. Monitoring Mechanism.—
(i) The Executive Committee shall have the power to review the work allotted to the
different stakeholder departments/agencies and organizations.
(ii) Those departments, agencies and organizations who have failed in executing
responsibilities shall be identified and brought to the notice of the Council by the
Executive Committee.
(iii) The Council after due deliberation may report to the Government for taking action
against those stakeholders, who have failed in the execution of their responsibilities
& duties.
6. Power of removal of difficulties.—If any difficulty arises in giving effect to the
provisions of these Rules, the Bihar State Road Safety Council may, as the occasion may require, by
order, do anything, which appears to it necessary for the purpose of removing the difficulty:
