Enquiry officer without appreciating the relevent fact and in absence of any

documentary evidence and witness has wrongly held the charge to have been proved

against me nearly on presumption and assumption which is not permissible in the eye

of law.

Further the reasoning by the enquiry officer was totally immaterial for proving

the charge and inthus perverse for the follwoing reasons :-

(i)

The enquiry officer has also failed to appreciate that the work was

executed by C.E. WRD, Balmikinagar and it is a responsibility of the C.E. But the Chief

Engineer, Ram Pukar Ranjan through several latter's has done the formality only.

When such irregularity were committed within the knowledge of the C.E. the payment

should have been stopped and both the circle and division officers along with office

were at waking distance of the work site and appears that the Chief Engineer through

conspiracy falsely implicated me to state their skin and tried to shift the onus on me for

their illegal gains by violating the condition mentioned in agreement.

(ii)

The enquiry officer has also failed to appreciate that through letter no.

358 dated 07-07-10 it is evident that within the Zone officer C.E. is equipped with

qulity control laboratory has been establisehed from 14-04-11 to 16-04-11 a visit by

the Hon'ble Minister of WRD along with me. After visit guidelines were issued by

Hon'ble Minister that work was done as per the clasue mentioned in SBD and incase if

the work is not found as per the agreement penal actions be taken against the persons

responsible which is evident from letter no. 612 dt. 28-4-11 and the Chief Enginner as

per the PWD code is responsible for such illegal activities and the officers posted

within that zone is accountable for such misconduct.

(iii)

Enquiry officers has also not appreciated the fact that from 10.11.11 to

12.11.11 the chief Engineer has carried a inspection and directed to get the work done

as per the clause of SBD. Further from 16-11-11 to 17-11-11 meeting under the

chairmanship of Principle Secretary was conducted and it was directed that the

supervision has to be carried out weekly. But it is surprising that no body to say such

irregularity and suggests that I have been falsely implicated and roped by than C.E. is

conspiracy with contractor for their illegal gratification.

(iv)

Further through letter no. 627 dt. 26-04-12 necessary direction to C.E.

were issued regards to his different letters. Despite that the local material used by

contractor was stopped by the Engineers posted there and no actions against the

contractor has been taken and their connivance can not be ruled out and payment

were not stopped. the above stated facts and Engg. posted were purposely allowed the

contractor to use the local material for their gain for which they are responsible.

(v)

The enquiry officer has also not considered the fact that upon the

complain with regard a flying squared was constituted through letter no. 769 dt. 19-

07-12 and investigation from 08-04-13 to 11-04-13 was carried out.

Enquiry officers has failed to appreciate that dispite the direction by the

C.E. for stopping the payment through memo no. 480 dt. 31-03-12 to the E.E.&S.E. has

not taken any action against the contractor like loading FIR or showing him defaulter.

For this the C.E. is responsible and as per SBD clause he is vested with such power and

in spite of taking any action the C.E. started writing letter no me for shifting his onus

and liability and responsibilty.

(vii)

The Enquiry officer has not consider the letter 437 dt. 30-03-12 issued

by C.E. to me. and tried to mislead me as well as the department by starting in the said

letter. It is submitted that in the said letter it has been also mentioned by C.E. the

proper direction/ Guidelines were issued to SE and EE that the work should be done as

per agreement. But no any information with regard to action taken by C.E. was either

communicated to me or department with regard to this work.

(viii) Further the enquiry officer has failed to appreciate that the payment

made after 28-03-2012 against 6th, 7th, 8th and 9th bill was passed by the EE and

amount paid after 28-3-12 amounting Rs. 12,74,07,988/- was made in connivance with

CE with EE and it is surprising that the CE and EE were having the knowledge that local

material are being used and order for stopping the payment has been passed vide ltter

being followed by his subordinate EE. For which the chief Enginner is competent to

initiate action against him. For which there is no requirement as the CE is competent to

take action against them under the code.

Further the report of Technical Vigilance was received on 31-05-2013 in

department. After 08 month the report was brought to my notice dt. 23-01-14 and the

moment I can to know that the irregularity on the very next day i.e. 24-01-14 directed

to the C.E. with regard to the said work not to make any payment against any bill and

other direction, there after direction of Technical vigilance a three man committee was

constitute and in the report submitted by committee that the Excess amount paid was

8,99,33,624/- which was also raise dispute upon the report submitted by technical

vigilance.

Further the Enquiry officer has not considered under rule 15A of PWD

code is the authority to take action against the officer and the CE is responsible for any

misconduct within their zone. The role of Engineer is Chief and the Chief Engineer is

also the administrative and processional head of that zone and having the power to

recommend to Govt. removal transfer and posting.

The Enquiry officer has also not consider the fact that the Chief Engineer

through its letter 687 dt. 10-5-12 requested for suspension of one AE & JE. When

through letter no. 739 dt. 24-05-12, I directed the CE to submit memo of charge along

with specific allegation against them. same was not provided by the chief Engineer so

in absence of memo of charge, I was not in a position to take any action against those

The Enquiry officer has wrongly relied upon the statement made by

Rajeev Nandan Maurya, AE as for the reason that he was posted there for a very short

duration from 24-05-12 to 16-09-12 and he was not aware with the proper fact of this

proceeding. during that period of his posting nothing has been alleged against me. for

the said period or any role for participation as been brought by Sri R.M. Maurya with

regard to my participation in relation to the excess payment.

(xiii) Further it is relevent to mention here that the Technical Vigilance has

concluded his investigation on 29-5-13 and after a laps of Eleven months on 18-02-14

a show cause has been issued and to which, I replied on 28-02-14 and there after

without considering my show cause and after my retirement a proceeding has been

initiated under Rule 43(B) is not permissible under the pension rule. But in the present

case much after my retirement on 08-09-15 the proceeding has been conducted under

43(B) which is clear viloation of pension rule 43 (B).

(xiv) Further it is submitted that from the above mentioned fact it is evidence

that no charge alleged against me is being proved and for the irregularities posted in

the said work is responsible for the said irregular payment.
