साथ Pदनांक 21.09.2015 को आदेश पा!रत Pकया था।

(ख)

No. सं0सं0 मा0 व0-14( व वध)> याय-07/2015-327923— In compliance of the order passed by

the Hon'ble Patna High Court on 21.09.2015 in the CWJC No. 19529/2011 Sadanand Yadav &

Others Versus State of Bihar and Others and other batch cases, Government of Bihar vide

notification no.- 258459 dated 18th January, 2016 decided to appoint a three member Judicial

Commission of Enquiry for fixing the responsibility for the loss of residual food grain after the

closing of Sampurn Gramin Rojgar Yojana and National Food for Work Scheme between 2002 to

2006, in exercise of powers conferred under Section 3(1) of the Commission of the Enquiry Act

1952 (No. 60, 1952). The government initially approved the tenure of the Commission for six

months and extended its tenure for another six months twice vide notification no. 278530 dated 18th

July 2016 and 298341 dated 27.01.2017, which expired on 17.07.2017.

The order passed by the Hon'ble Patna High Court on 02.08.2017 in C.W.J.C. No.-

5638/2011 in reference to Interlocutory Application No. 5268 of 2017 and on the request of

Commission the Governor of Bihar is pleased to make it one member Commission headed by Justice

Uday Sinha (Rtd.) and extend the tenure for another six month from 18.07.2017 to 17.01.2018.

(2) The terms of reference of the Commission as notified vide notification no. 258459 dated

18.01.2016 shall be modified as follows—

(a)

The Commission shall cause an enquiry only with regard to the grievances of

such of the persons who had filed the Writ Petition before the Honourable High

Court pertaining to which orders were passed on 21.09.2015 in C.W.J.C. No.-

19529/2011 and analogous cases.

(b)

The persons or PDS dealers who are not parties in the Writ Petitions or who had

not ventilated their grievances in the Writ Petitions shall not be permitted to take

up the issue before the Commission.

(c)

As per order of Hon'ble High court only such PDS dealer shall be heard by the

Commission who deposit 50% of certificate amount before appearance,

(3) The Commission shall submit its report before 17.01.2018.
