The 21st September 2017
No. 11/Ni 1-03/10 (Part)-2238/Preample—Whereas in the light of 74th amendments of
Constitution of India, the responsibility of work of employment of teachers has already delegated to
urban local bodies considering the important role of Municipal corporation and other similar
instutions. The state Government after careful consideration has decided to handover the
responsibility of employment of such candidate to the post of secondary/high secondary teachers and
Librarian, who have passed the teacher eligibility test. For this purpose under special planning, in
respect of training with pay in the secondary/high secondary schools, it is necessary and expedient to
make amendments in The Bihar Municipal Secondary/High Secondary Teacher (Employment and
Service Condition) Rules, 2006 (as amended from time to time).
Now, therefore, in exercise of the powers conferred under the article-243 B of the
Constitution of India, read with section-45,47 (4) and 419 of the Bihar Municiapl Act, 2007 the
Governor of Bihar is pleased to make the following Rules to make amendment, in The Bihar
Municipal Secondary/High Secondary Teacher (Employment and Service Condition) Rules, 2006
(as amended from time to time).
1. Short title extent and commencement—
(1)
These Rules may be called the Bihar Municipal Secondary/High secondary
(Employment and Service Condition) (Second Amendment) Rules, 2017.
(2)
It shall extend to the whole of the State of Bihar.
(3)
It shall come into force with immediate effect.
2. Substitution of sub-Rule (v) of Rule-8 of the said Rules, 2006—
Sub-Rule (v) of Rule-8 of the said Rules, 2006 shall be substituted by
the following—
“(v)
It is essential for the employed un-trained teachers to obtain teachers training as
per the guidelines determined by the Education Department. The trainees
admitted in the Training Institutions determined by the Education Department
shall be allowed session wise leave with pay. The leave with pay shall be allowed
from the training session of 2015-2017 of B.Ed. The leave with pay during the
training period shall be allowed with the condition that they will do the teaching
work for the minimum period of 5 years after training. In case of leaving the
service before completion of the determined period, he/she will have to deposite
the amout of pay etc received in the training period in the Government Treasury.
It is essential for concerned teacher to furnish a bond to this intent. Recoverable
amout shall be recoverable as public demand.
